A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
MAKING DETERMINATIONS AND APPROVING THE REORGANIZATION OF
TERRITORY DESIGNATED "RANCHO RiNCONADA 98-09% CONSISTING OF 1)
ANNEXATION OF ABOUT 325 ACRES OF TERRITORY GENERALLY BOUNDED
BY MILLER AVENUE, STEVENS CREEK BOULEVARD, LAWRENCE
EXPRESSWAY, BOLLINGER ROAD AND TANTAU AVENUE; 2) A PORTION OF
THIS TERRITORY, 0.19 ACRE (APN 375-12-010), WILL BE ALSO ANNEXED TO
THE FIRE DEPARTMENT OF SANTA CLARA COUNTY, SANTA CLARA
COUNTY LIBRARY SERVICE AREA AND LIBRARY BENEFIT ASSESSMENT
AREA AND DE-ANNEXED FROM THE CITY OF SAN JOSE; 3) A PORTION OF
THIS TERRITORY, ABOUT 288 ACRES, WILL BE DETACHED FROM THE
COUNTY LIGHTING SERVICE AREA
WHEREAS, a petition for the annexation of certain territory to the City of
Cupertino in the County of Santa Clara consisting of 325 acres and generally bounded by
Miller Avenue, Stevens Creek Boulevard, Lawrence Expressway, Bollinger Road and
Tantau Avenue, has been filed by numerous property owners and residents of the area;
and
WHEREAS, on February 1, 1999, the City Council adopted Resolution No. 99-
033 initiating proceedings for annexation of the area designated "Rancho Rinconada 98-
09"; and
WHEREAS, Section 35150.5 of the California Government Code states that the
Local Agency Formation Commission shall not have any authority to review an
annexation to any City in Santa Clara County of unincorporated territory which is within
the urban service area of the city of the annexation if initiated by resolution of the
legislative body and therefore the City Council of the City of Cupertino is now the
conducting authority for said annexation; and
WHEREAS, said tenitory is inhabited and all owners of land included in the proposal
have not consented to this annexation; and
WHEREAS, in accordance with Section 57026 of the California Government Code, the
City Clerk of the City of Cupertino has provided mailed notice of the heating on the
reorganization to all property owners of record, residents and other interested parties and
notification of their eligibility to protest this City-initiated proceeding with instructions
on how to prepare a valid, written protest; and
WHEREAS, the City of Cupertino shall conduct a public heating on the reorganization in
accordance with Section 57050 of the California Government Code, to accept protests,
objections or evidence which is made, presented, or filed; and

WHERAS, the City of Cupertino, at the close of the public hearing, intends to determine
the value of the written protests in order to take the appropriate action on the
reorganization.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino as follows:
1. That it is the conducting authority pursuant to Section 35150.5 of the Government
Code for the reorganization of territory designated "Rancho Rinconada 98-09",
more particularly described in Exhibits "A & B";
That the following findings are made by the City Council of the City of
Cupertino:
a. That said territory is inhabited and comprises approximately 325 acres.
That the annexation is consistent with the orderly annexation of territory
within the City's urban service area and is consistent with the City policy
of annexing when providing City services.
The City Council has completed an initial study and has found that the
reorganization of said territory has no significant impact on the
environment, and previously approved the granting of Negative
Declarations.
The City Council on three separate occasions, prezoned portions of the
subject territory that constitute the entirety of the subject reorganization as
follows:
1) Prezoned 12+ lots along Stevens Creek Boulevard "P-Planned
Development" on May 16, 1983,
2) Prezoned about 320 acres R1-5, R1-6, R1-7.5, RI-10 and BQ
onMay 18, 1998
3) Prezoned 3 lots on Stem Avenue R1-5 on October 19, 1998.
Annexation to the City of Cupertino will affect no changes in special
districts.
That the territory is within the city urban service area as adopted by the
Local Agency Formation Commission (LAFCO). That the city petitioned
and obtained LAFCO approval to de-annex one residential lot in the City
of San Jose described as APN 375-12-010 and adjust the urban service
area and sphere of influence boundaries between the cities of Cupertino
and San Jose on August 10, 1998.

That the annexation is made subject to the following terms and
conditions:
"As a result of the annexation of Rancho Rinconada, the City of Cupertino
intends no change, in whole or in part, in the existence, functions and
activities of the Rancho Rinconada Recreation and Park District, nor any
merger of said district."
That the County Surveyor has determined the boundaries of the proposed
reorganization to be definite and certain, and in compliance with the
Commission's road annexation policies. The City shall reimburse the
County for actual costs incurred by the County Surveyor in making this
determination.
That the proposed annexation does not create islands or areas in which it
would be difficult to provide municipal services.
That the proposed annexation does not split line of assessment of
ownership.
k. That the proposed annexation is consistent with the City's General Plan.
That the City has complied with all conditions imposed by the
commission for inclusion of the territory in the City's urban service area.
That the territory to be annexed is contiguous to existing City limits under
provisions of the Government Code.
That nine (9) valid protests to the reorganization proceedings were
received by the Clerk of the City of Cupertino, and the value of those
protests submitted prior to the close of the public heating constitute
0.42% of the 2,150 registered voters residing in the affected territory.
That said reorganization is hereby ordered without election pursuant to Section
35151 et seq. of the Government Code.
That the Clerk of the City Council of the City of Cupertino is directed to give
notice of said reorganization as prescribed by law.
BE IT FURTHER RESOLVED that upon completion of these reorganization
proceedings the territory described by the assessor parcel numbers below will be detached
in whole from the Santa Clara County Lighting Service District; and
