A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC
NECESSITY, HEALTH, SAFETY OR WELFARE REQUIRES THE
FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON STEVENS CREEK
BOULEVARD BETWEEN TANTAU AVENUE AND STERN AVENUE
WHEREAS, it is necessary for the City of Cupertino to place conduits crossing Stevens Creek Boulevard to
avoid any cutting of the street after the overlay is completed and;
WHEREAS, Stevens Creek Boulevard is extensively used by the general public and carries a heavy volume
of vehicular traffic; and
WHEREAS, an underground utility district is necessary in order to require property owners to underground
their overhead services; and
WHEREAS, the cost of the conversion would be funded by the City; and
WHEREAS, forming this district is consistent with the City's policy of undergrounding.
NOW, THEREFORE, BE IT RESOLVED THAT:
NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of
Cupertino on April 5, 1999, at the hour of 6:45 p.m., in the Council Chamber of City Hall,
Cupertino, California, to ascertain whether the public necessity, health, safety or welfare requires
the formation of an underground utility district on Stevens Creek Boulevard between Tantau
Avenue and Stem Avenue.
At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may
be continued from time to time as may be determined by the City Council.
The City Clerk shall notify all affected property owners as shown on the last equalized assessment
roll and utilities concerned of the time and place of such hearing by mailing a copy of this
resolution to such property owners and utilities concerned at least ten (I0) days prior to the date
thereof.
The area proposed to be included in the district is shown upon that certain map entitledRANCHO
RJNCONADA UNDERGROUNDING DISTRICT NUMBER 17. CUPERTINO, CALIFORNIA,
which is on file in the office of the City Clerk of the City of Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 15th day
of March, 1999, by the following vote:
