A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING THE CITY MANAGER TO FILE AN APPLICATION FOR
FEDERAL SURFACE TRANSPORTATION PROGRAM AND CONGESTION
MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING
WHEREAS, the City of Cupertino is an eligible project sponsor for Surface Transportation
Program and Congestion Mitigation and Air Quality Improvement Program funds; and
WHEREAS, the City of Cupertino wishes to submit a grant application to Metropolitan
Transportation Commission for funds from the for Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program in fiscal year 1999-2000 for the
following project:
City of Cupertino Interchange
Improvements-Ramp Meter Signal/
Arterial Traffic Signal Interconnection
$500,000
WHEREAS, the Metropolitan Transportation Commission requires, as part of the
application, a resolution stating the following:
1. The commitment of necessary local matching fimds of at least 11.5 percent; and
2. That the sponsor understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding is fixed at the
programmed amount, and therefore, any cost increase cannot be expected to be
funded with Surface Transportation Program and Congestion Mitigation and Air
Quality Improvement Program funds; and
3. The assurance of the sponsor to complete the project as described in the application
and if approve, as programmed in Metropolitan Transportation Commission's
Transportation Improvement Program.
4. That the sponsor understands that funds must be obligated by September 30, 2001, or
the project may be removed from the program.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino
hereby authorizes the City Manager to execute and file an application for funding under the
Surface Transportation Program and the Congestion Mitigation and Air Quality Improvement
Program of TEA 21 in the amount of $500,000 for interconnect ramp meter signal/arterial traffic
signal intemonnection; and

BE IT FURTHER RESOLVED that the City of Cupertino does hereby state that:
1. The City of Cupertino will provide $57,500 (11.5 percent) in local matching funds;
and
2. The City of Cupertino understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding for the project
is fixed at $500,000, and that any cost increases must be funded by the City of
Cupertino from local matching funds, and that the City of Cupertino does not expect
any cost increases to be funded with Surface Transportation Program and Congestion
Mitigation and Air Quality Improvement Program funds; and
3. The City of Cupertino Interchange Improvements-Ramp Meter Signal/Arterial Traffic
Signal Interconnection will be built as described in this resolution and, if approved, as
programmed in Metropolitan Transportation Commission (MTC) Transportation
Improvement Program (TIP).
4. The program funds are expected to be obligated by September 30, 2001.
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the
Metropolitan Transportation Commission in conjunction with the filing of the application; and
BE IT FURTHER RESOLVED that the Metropolitan Transportation Commission is
requested to support the application for the project described in this resolution and to program
the project, if approved, in the Metropolitan Transportation Commission's Transportation
Improvement Program.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 5th day of April, 1999, by the following vote:
