BACKGROUND: The applicant began construction on a new replacement fence at his residence, and was required to apply for a fence exception because the fence is located in the front yard setback, at the corner of Stevens Creek Boulevard and Orange Avenue. The fence ordinance allows a maximum of height of three feet in the front yard setback. The new fence would be six feet high and would be set back six feet from the north (front) property line and six feet set back from the east (side) property line. An exception is also needed to locate the fence within the 40-foot corner triangle. DISCUSSION: The master bedroom has a patio and yard area adjacent to the proposed fence along Stevens Creek Boulevard. The applicant desires to replace the old fence in its existing location so they can maintain this yard area. Locating it closer to the house and patio would reduce their existing yard area. I-I July 5,2007 Page 2 EXC-2007-10 The fence would consist of redwood slats and concrete posts. Landscaping is proposed between the fence and the sidewalk. The landscape plan is schematic. Public Works staff reviewed the proposal and does not have any problem with locating the fence within the 40-foot corner vision triangle. However, a condition of approval requires that the landscaping not exceed three feet in height. The plants selected on the landscaping plan are low-growing. Staff supports the application because the fence is located in the same location as the old fence, and is also in line with neighboring fences, and it meets the fence exception findings, in that it is not detrimental to public safety and is needed to ensure adequate screening and/ or privacy. Conditions of approval are proposed that require additional climbing plants on the fence and provision of a drip irrigation system for the landscaping. BACKGROUND: Strike is an entertainment venue consisting of a bowling alley, restaurant and bar, which is currently under construction at Cupertino Square. It is located on the east side of Wolfe Road, with the entrance located under the bridge, as shown below. Valko Fashion Park, now called Cupertino Square, has a Development Agreement with the City that states that tenants with exterior entrances shall be allowed one or more exterior building mounted signs with formal approval of ASAC [now DRC] before installation. Approval shall be based upon height, setback and visibility of the sign. Strike is constructing a metal canopy at the entrance, which would include two illuminated signs. DISCUSSION: Each sign would be located on the northwest and southwest sides on top of the canopy. They would be approximately 20 feet from the curb. The signs would consist of aluminum letters attached to multi-colored panels, with channel letters that are halo and face-lit. Each sign is proposed to be 10 feet in length and approximately 4.5 feet high. Additional lighting on the walls and columns would also brighten the area. j-I July 5, 2007 Page 2 ASA - 2007-07 Staff supports the proposed signs. The size is appropriate to the location, which is difficult to see because of the bridge. Two signs are appropriate for the same reason, and so that they are visible from both directions on Wolfe Road. In terms of comparison to recent signs approved at Cupertino Square, the California Pizza Kitchen signs are 4 feet 10 inches in height.
