Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective June 7, 2007. The fourteen-calendar day appeal will expire on June 25,
2007.

PROJECT DESCRIPTION:
Sign Exception for two additional wall signs, with two on one wall face, and an
exception to exceed the allowed height of 48" .
RECOMMENDATION:
Staff recommends:
1. Approval of the exception EXC-2007-07 for the increased wall sign height and
one wall sign on the Stevens Creek Boulevard building frontage, and
2. Denial of the exception for the second wall sign that facing Stelling Road per
the model resolution.
BACKGROUND:
Staff already approved signage for Whole Foods Market that is consistent with the City
sign ordinance. This includes a wall sign facing Stelling Road, and two ground signs-
one located on Stevens Creek Boulevard, the other on Stelling Road.
Whole Foods is requesting additional signage. The applicant, Alan Ford of Ford Signs,
representing Whole Foods Market, requests a sign exception to exceed the maximum
number of wall signs allowed and exceed the maximum sign height.

Number of Wall Signs
Whole Foods is a large grocery store (over 65,000 square feet) on a large site (4.2 acres)
located at the crossroads of two major streets: Stevens Creek Boulevard and Stelling
Road. Staff feels a second wall sign on the Stevens Creek Blvd. frontage would not be
excessive even with the two ground signs. The second wall sign on Stelling Road (the
southerly sign), however, is redundant and excessive given its proximity to other
signage on the property.
If the applicant is interested in highlighting this second entrance to the store, staff
would support illuminated private art piece that could be approved as a Director's
Minor Modification, not a Sign Exception.
Sign Height
Staff supports of the sign height exception to allow the "leaf top" motif over the "0" in
"WHOLE." The letter height of the approved Stelling Road fronting sign and the
proposed Stevens Creek Blvd. fronting sign are already within the heights allowed by
Cupertino Code. Allowing the extra height for just the "leaf top" motif would be a
small variance from the maximum allowance. Precedence has already been set by the
" Mervyn' s" wall sign where the letters are 48 inches tall, except for the extra height
contributed by the descending undercase "y" and the apostrophe mark.
Findings
DRC must adopt certain findings before approving a sign exception. These findings are
for staff recommendations of only two wall signs-one on the Stelling Road fa<;ade and
the other on the Stevens Creek Blvd. fa<;ade, and the extra sign height. Staff could not
make the exception findings for two wall signs facing Stelling Road.
The findings are listed below in italics type with staff comments following:
A. That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title.
The purpose of the sign ordinance is to identify and enhance businesses while
maintaining the aesthetic appearance of the City. The Whole Foods building has a
large footprint and is located on a prominent corner served by two major streets
with over 500 feet of frontage. A wall sign on Stevens Creek Blvd. will advertise this
business on the City's most prominent street. The sign will not clutter the building
given the size of the building and site and its separation from other site signage.
B. The granting of the exception will not result in a condition which is materially
detrimental to the public health, safety, or welfare
The wall signage will not negatively affect the public health, safety or welfare. The
signage will be primarily visible to commercial and other non-residential properties.
The mounting of the heavy letters on the walls must meet current building codes.

C. Least Modification and Minimum Variance to Accomplish Purpose
Maximum signage height will only be exceeded by the "leafy top" over the "0" in
WHOLE, which represents a minimum variance from the sign code. A wall sign for
Stevens Creek Boulevard should not be considered excessive given the size of the
building, size of the site and the spacing of the signage.

Resolution are based and contained in the public hearing record concerning Application
EXC-2007-07 as set forth in the Minutes of the Design Review Committee Meeting of
June 7, 2007, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the sign exhibits titled: "Whole Foods Market, Cupertino,
CA" consisting of 6 pages labeled: 1 through 6, and dated 08/10/05, except as may
be amended by conditions contained in this resolution.
2. EXCEPTION APPROVAL
Approval is hereby granted for a wall sign on the Stevens Creek Boulevard frontage
with a sign height of up to 55.5 inches (A wall sign facing Stelling Road has already
been administratively approved.), and a sign height of 65.75 inches for the Stelling
Road facing wall sign.
3. EXCEPTION DENIAL
The exception request for a second Stelling Road facing wall sign with a height of
96 inches (8 feet) is hereby denied.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements

Exception to the sign code re signage for their new store on Stevens Creek Blvd.
The first request is for the carrot top leaf on top of the "0" in the word "Whole". That element is part of Whole
Foods standard corporate image. It is on all their signage, advertising, identification, stationary etc. It was
eliminated on our submittal due to the 3'6" letter height limit. Counting the carrot top in that calculation would
have drastically reduced the overall size of the letters.
Our second request is for two additional sets of letters. One set will be installed on the front elevation over the
second entrance to help direct customers in the parking lot to the second entrance and one set will be installed on
the elevation facing Stevens Creek Blvd.
The size of the letters are important to Whole Foods... ... the building is very large with a big parking lot and
Whole foods would like the letters visible from across the parking lot. And aesthetically, using smaller letters
would look out of place on such a large building.
