SUBJECT AND ISSUE
Adopt a Resolution providing for a discretionary fund to be administered by the City
Manager to provide a funding source for projects that the Mayor may wish to propose
from time to time during the Mayor's term of office.
BACKGROUND
On May 10, 2007, the City Council considered establishing a discretionary fund set aside
for a project or projects of the Mayor's choice that could be proposed at any time during
the Mayor's term of office.
The Council further suggested that any such fund to be part of the operating budget of the
City Manager's Office and specifically the City Manager's discretionary fund. Staff is
proposing that this fund be designated as the Mayor's initiative budget. The Council also
suggested that any proposal for expenditures from the Mayor's discretionary fund be
determined jointly by the City Manager and the Mayor. In addition, the Council noted that
City Manager should present the proposal to the City Council whenever he deems it
appropriate.
A further provision considered by the Council was that Council be advised by an item on
the Council Agenda prior to the date of the Mayor's State of the City Address, of any new
project or initiative that the Mayor may wish to propose during the State of the City
Address.
FISCAL IMPACT
The fiscal impact of this proposal would be some undetermined staff costs associated
with each proposal combined with the amount that the Council approves with the FY 07-
08 operating budget. During the Council discussion, the amount of $10,000 was
suggested to be included in the City Manager's discretionary fund to serve as the Mayor's
initiative budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
PROVIDING FOR A DISCRETIONARY FUND TO BE ADMINISTERED BY
THE CITY MANAGER TO PROVIDE A FUNDING SOURCE FOR PROJECTS
THAT THE MAYOR MAY WISH TO PROPOSE FROM TIME TO TIME
DURING THE MAYOR'S TERM OF OFFICE
WHEREAS, The City Council wishes to provide a small source of funds for
projects that may be proposed at the discretion of the Mayor during the Mayor's term of
office; and,
WHEREAS, The City Council wishes to establish a Mayor's initiative budget that
will be included as part of the City Manager's Office budget in the City Manager's
discretionary account; and,
WHEREAS, The City Council wishes to determine, as part of the budget process,
the amount of funding for the duration of the Mayoral term;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino that Mayor's initiative budget is established in an amount to be determined by
the City Council as part of the City Manager's discretionary fund to be used for projects
that the Mayor deems appropriate during the Mayor's term of office; and,
BE IT FURTHER RESOLVED that the decision to spend money on a Mayor's
project will be jointly determined by the Mayor and the City Manager, except that the
City Manager may, at his or her sole discretion escalate the spending decision to the City
Council'ifhe or she determines that to be necessary or appropriate; and,
BE IT FURTHER RESOLVED that the City Council will be advised by an item
on the Council Agenda prior to the date of the Mayor's State of the City Address, of any
new project or initiative that the Mayor may wish to propose during the State of the City
Address.
