PROJECT DESCRIPTION: Architectural and site approval for exterior signs on the
canopy, awnings and building for California Pizza Kitchen at Valleo Fashion Park.
RECOMMENDATION:
Staff recommends approval of the architectural and site approval permit for exterior
wall signs at the California Pizza Kitchen restaurant, based on the model resolution.
BACKGROUND:
In April of 2006, the City approved a use permit to construct a 6,000 square foot
restaurant for California Pizza Kitchen on the northwest corner of Stevens Creek
Boulevard and Wolfe Road within the Valleo Fashion Park shopping center.
Currently, the restaurant is under construction and is anticipated to be completed this
year. As a result, the applicant is requesting approval of the proposed exterior walls
signs for the restaurant.
In 1991, the City of Cupertino adopted a Development Agreement with Valleo Fashion
Park that included a sign program allowing tenants with exterior entrances one or more
exterior building mounted signs with formal approval of the ASAC (now named DRC)
before installation. The Development Agreement also allows Vallco to utilize the sign
ordinance in effect at the time of the Development Agreement. Therefore, the
proposed California Pizza Kitchen exterior wall signs are subject to these requirements.
DISCUSSION:
The California Pizza Kitchen restaurant will be located on a prominent corner within
the Valleo Fashion Park shopping center and, therefore, is requesting a number of
exterior wall signs to provide adequate visibility of the restaurant from both Stevens
Creek Boulevard and Wolfe Road, as well as from the north side of the building that
will be accessible and visible from the shopping center and the parking lot for the
restaurant.
The table below summarizes the proposed signs for the restaurant, the requirements for
each of the signs under the Development Agreement requirements and whether the
proposed sign complies with these requirements:

Staff Recommendation
Staff is generally supportive of the proposed signs for California Pizza Kitchen and
believes the three main wall signs on the north, south and east elevations are needed to
identify the restaurant along the main street corridors of Stevens Creek Boulevard and
Wolfe Road and from the north side of the building that provides visibility and access
from Vallco Fashion Park. However, because Sign A on the east elevation facing Wolfe
Road is larger than the permitted 92 square feet, staff recommends that this sign be
approved at 92 square feet. The applicant would need to apply for a sign exception to
increase this sign to 129 square feet.
Staff does not recommend approval of the six inch "California Pizza Kitchen" signs
(Sign H) on the canopy over the outdoor seating area facing the south elevation since
they are not needed for identification of the r-estaurant along Stevens Creek.
Additionally, the signage is small and does not lend itself to additional visibility along
Stevens Creek Boulevard. Further, the City has not approved this number of
canopy I awning signs on other restaurants in the City, including other restaurants in

the Valleo Fashion Park. Therefore, staff recormnends the deletion of these canopy signs
depicted as Sign H. .
Staff further recommends that one of the two "Take Out" signs along the north
elevation be eliminated as it appears redundant to have these two signs adjacent to each
other.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on a plan set prepared by Chandler Signs for California Pizza
Kitchen, consisting of 14 pages, except as may be amendec\ by conditions in thi~~
resolution.
2. REMOV AL OF CANOPY SIGNS AND ONE OF THE "TAKE OUT" SIGNS
a. The six-inch "California Pizza Kitchen" signs (Sign H) on the canopy over the
outdoor seating area along the south elevation facing Stevens Creek Boulevard
shall be removed and are not approved as part of this permit.
b. One of the "Take Out" signs shall be removed from the north elevation of the
building facing the rear parking lot and is not approved as part of this permit.
3. REDUCTION OF SIGN A (EAST ELEVATION)
The sign area of Sign A along the east elevation of the building facing Wolfe Road
shall be reduced to a maximum of 92 square feet.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements; and other exactions. Pursuant
to Government Code Section 66020( d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

PROJECT DESCRIPTION: Sign exception to exceed the allowed height for a wall sign.
RECOMMENDATION:
Staff recommends approval of EXC-2007 -01, based on the model resolution.
BACKGROUND:
The DRC reviewed this application on February 15, 2007 (Exhibit A). Staff pointed out
there were two ways to interpret the maximum sign height allowed based on the
setback from De Anza Blvd (48-inch high sign allowed) or the setback from the abutting
private street (24-inch high sign allowed). In any case a sign exception is needed for the
Symantec logo, which was proposed at 72 inches.
Staff noted that the proposed halo illumination, that is, the reflected back lighting of the
sign, was appropriate because the sign was partially visible to the residential
neighborhood and halo illumination was not considered bright lighting.
DISCUSSION:
DRC member Giefer felt the logo was too large and obtrusive at 72 inches (6 feet) and
wanted it reduced to 60 inches in height (5 feet). The applicants stated that it was
important for the company to keep a certain proportionality between the logo and the
company name in order to improve sign readability and maintain a consistent corporate
identification. DRC member Chien said the logo size as proposed was acceptable to
him and fitted well on the building wall. DRC member Giefer asked the applicants to
further consider a smaller logo. She felt the smaller size would not hurt sign readability
from the viewing distances proposed. The DRC voted 2-0 to continue the hearing to
March 1,2007.
Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
Literal Enforcement of the Sign Regulations are Inconsistent with Spirit "and Intent of Sign
Ordinance
The intent of the Sign Ordinance is to "provide architectural "and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."

To accomplish this the sign code recognizes that larger buildings and those with greater
setbacks need taller sign heights. The sign name height may be considered conforming
if the setback is measured from De Anza Boulevard, the primary property frontage.
The logo, even at 72 inches, is architecturally compatible with the existing building and
the taller sign height is proportional to the existing horizontal building bands.
A. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare
Because of the height of the building, the upper floor has some visibility to the
residential neighborhood to the west across S. De Anza Boulevard. Brightly illuminated
signage can have an intrusive effect on residences. The proposal for halo-illuminated
signage is far less intrusive and acceptable to staff.
B. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage will be consistent with the sign ordinance in terms of sign area
and coverage. The exception request is consistent with the intent and spirit of the sign

Staff recommends approval of EXC-2007-01, based on the model resolution.
BACKGROUND:
The applicant, Jonathan Hobbs of Square Peg Design, requests a sign exception to allow
a wall sign to exceed the maximum sign height for Symantec Corporation (Exhibit A).
This industrial building is surrounded by a mixture of uses, including a restaurant and
hotel to the north, multiple family residential to the east and commercial buildings to
the south and west (across De Anza Boulevard).
The sign, consisting of the company name and the corporate logo, is located on a semi-
circular wall oriented toward southbound S. De Anza Boulevard.
DISCUSSION:
Wall Sign Height
For this particular project, there are two ways to interpret the maximum sign height
allowed.

If the closest curb to the sign (58 feet away) is used, which is the curb next to the private
street, the maximum sign height is 24 inches. The sign is oriented toward De Anza
Boulevard. If the De Anza curb is used, which is 120+ feet away, the sign ordinance
allows a sign height of 48 inches because the building is larger than 20,000 square feet in
SIze.
Most of the sign name is 23 inches high; however, the use of lower case letters adds
additional height to the" t " (30 inches) and to the" y" (35 inches) in order to maintain

the proportionally of the characters. Thus, the sign name is conforming or non-
conforming to the ordinance, depending on how the setback is interpreted.
The 28+ square foot logo is considered part of the sign and at 72 inches (6 feet)
contributes toward the sign height requiring an exception. The sign is otherwise
conforming to the City's Sign Code, in tenns of area, coverage~ etc.
The applicant is requesting the sign exception because he feels:
The sign would visually fit well on the building fa<;ade,
It would provide optimal readability of lower case logotype letters by passing traffic.
It would maintain proportions of the internationally recognizable brand.
Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and Intent of Sign
Ordinance
The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."
To accomplish this the sign code recognizes that larger buildings and those with greater
setbacks need taller sign heights. The sign name height may be considered conforming
if the setback is measured from De Anza Boulevard, the primary property frontage.
The logo, even at 72 inches, is architecturally compatible with the existing building and
the taller sign height is proportional to the existing horizontal building bands.
A. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare
Because of the height of the building, the upper floor has some visibility to the
residential neighborhood to the west across S. De Anza Boulevard. Brightly illuminated
signage can have an intrusive effect on residences. The proposal for halo-illuminated
signage is far less intrusive and acceptable to staff.
B. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage will be consistent with the sign ordinance in terms of sign area
and coverage. The exception request is consistent with the intent and spirit of the sign
ordinance. The proportionality of the logo to the company name is consistent with
other company signage on this property and other properties tenanted by this
company.

Project Description
Proposed is an illuminated building identification logo and lettering for 10200 S. DeAnza
Blvd.
The signing consists of a sculptural, molded round l.ogo and lower case black letters.
The halo illumination technique is subtle, making the sign far "quieter" in nighttime
appearance than a face-illuminated sign of the same size. The rounded logo form will glow on the
yellow side while the black side remains in halo-illuminated silhouette.
Round logo is 72" high. Lower case letters are approximately 23" high, not including
ascender ("t") and descender ("y").
Signing will be located on a curved wall above the 4th level of the building, facing North
West toward the corner intersection of Stevens Creek Blvd. and S. DeAnza Blvd..
Justification for Exception
The proposed sign size has been optimized for the following purposes:
1. To visually fit well on the building favade.
2. To provide optimal readability oflower case logotype letters by passing traffic.
3. To maintain proportions of the internationally recognizable brand.
The Symantec logotype is a round logo with proportionally much smaller lowercase letters.
We feel that strict adherence to the Sign Ordinance would force the logo, and therefore the letters
down to a size that would be far less legible and disproportionate to the space on thebuilding
favade.
Symantec looks forward to presenting this building as their corporate "front door" and feels that
the proposed sign compliments the architecture of the building and the local community.
