SUBJECT: PLANNING COMMISSION ACTION LETTER - TR-2003-01
This letter confirms the decision of the Planning Commission, given at the meeting on
March 10,2003, approving the removal of 31 trees and replacements in a planned
residential development located at the Commons of Cupertino, according to Planning
Commission Resolution No. 6175.
Please note that an appeal of this decision can be made within 14 calendar days. If this
happens, you will be notified of a public hearing that will be scheduled before the City
Council.

RESOLUTION NO. 6175
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING
THE REMOV AL OF 31 TREES AND REPLACEMENTS IN A PLANNED
RESIDENTIAL DEVELOPMENTT LOCATED AT THE COMMONS OF CUPERTINO
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application
for tree removal, as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Commission has held
one or more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said
application; and has satisfied the following requirements:
1.) The proposed action, at the proposed location, will not be detrimental or
injurious to property or improvements in the vicinity, and will not be
detrimental to public health, safety, general welfare, or convenience;
2.) The proposed use will be located and conducted in a manner in accord with the
Cupertino Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, application TR-2003-01 is hereby approved as revised and
subject to the conditions which are enumerated in this Resolution beginning on Page 2
thereof; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning
Application TR-2003-0t as set forth in the Minutes of the Planning Commission
Meeting of March 10, 2003 are incorporated by reference though fully set forth herein.

Replacement Tree Plan, except as may be amended by the Conditions contained in
this Resolution.
2.) TREES APPROVED FOR REMOVAL

3.) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020( d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.

Statement Of Purpose
The purpose of the tree inventory and analysis is to record all of the trees
particular criteria which can be interpreted and used to plan and bupget tree
Procedures And Benefits
All of the trees on the property were affixed with numbered aluminum disks, and plotted on a map
provided by Ms. Heyler. Maps are included with this report. The following information was
recorded in chart fonn: Tree name, tree number, diameter at four and one half feet above ground
line, location, health, structure, prune type, prune cycle, priority, and remarks. Refer to
"Explanation of Column Headings" in this report. From this information tree care can be planned
within the parameters of the existing budget. An analysis of the pruning cycles and priorities will
determine if the tree care budget needs to be changed.
Explanation Of Maps
The original copy of the map provided by Ms. Heyler has gone through some changes in order that
all of the tree numbers are clearly seen on the map. Tree locations are approximate and are for use
as a guide. To aid in the understanding of the treescape, and to plan for tree care, there are three
different maps:
1. A blank copy of the map to be used as a master.
2. A map of the recommended removals by priority.
3. A map of the recommended pruning by priority.
Explanation Of Tables
Two tables are provided that summarize all the trees by pruning cycle, pruning type, removal, and
priority. Priority refers to which trees should be pruned or removed first and is not dependent on
the calendar or time of yeaL
General Impressions
The property has a maturing landscape. There are 21 species of trees on the property. The three
most prominent species are the white birch (Betula pendula), Canary Island pine (Pinus
canariensis), and coast redwood (Sequoia sempervirens) trees. Many of the coast redwood trees
and Canary Island pine trees were planted in inappropriate locations (see tree #290-#295, and
#318, and #319 for examples) which was the fault of the landscape architect who drew the original
landscape plan.
Most of the trees are in average or better health while about half of the trees have average or better
structure.
61 percent of the trees are located within four feet of hardscape.
12 percent of the trees on the property have been identified for removal. This is not unusual for the
treescape of a homeowner's association.
The most controversial issue that the Board of Directors will face is dealing with the removal of
trees on the property. There are three criteria that were considered for tree removal: Structure,
health, and location. Trees that are in poor health, or have weak branch attachments were
considered for removal. Most often, the health was related to a restricted area,

Specific Impressions Of Some Significant Trees "
Past pruning practices will determine the management of several/trees on the
notably the Canary Island pine trees and the eucalyptus trees.
Many of the Canary Island pine trees were over thinned (see the ~emarks column of the inventory)
which damaged the structure of these trees. This species of pine ,tree usually needs very little
pruning and certainly not the excessive intemalbranch removal thathascreatedlion'6.tailsoutof
the lateral branches of many trees. This type of pruning will encourage foliar growth at the branch
tips which will lead to heavy endweight and possibly breakage.
The eucalyptus trees have continually been topped over the years. This was once considered an
acceptable form of pruning but research studies have found that topping will damage the health and
structure of trees. Most of the eucalyptus trees have been identified for pruning but these trees
should be considered short term (10 years or less) trees.
The white birch trees are growing in a wide range of habitats. The worst habitat are the various
islands in the roadways. The best habitat is the birch grove that is adjacent to the clubhouse.
Several of these trees, aU of which are small and insignificant, are recommended for removal for
three reasons: First, to favor the larger and dominant trees. Second, to begin a reforestation
program which will perpetuate the grove. Third, to eliminate trees that are suppressed and have
poor structure.
Holly oak (Quercus ilex) trees represent another example of poor selection by the landscape
architect. I have seen these trees reach over 40 feet tall with an equal foliar spread. Therefore, the
holly oak trees on the property will need to be pruned on a regular basis in order to keep them from
out growing their restricted locations. These trees are susceptible to aphids and greenhouse thrips.
Both of these insects can be controlled with subsurface injections of Merit insecticide during the
Winter.
There are two species of plum trees on the property: The Blireiana plum (Prunus blireiana) and
the Krauter vesuvias plum (Prunus cerasifera 'Krauter vesuvias') trees. The Blireiana plum trees
are susceptible to plum curl aphid and crown gall Plum curl aphids attack the young, elongating
leaves and cause the leaves to disfigure. Insecticidal sprays can be done when the aphids are on
the young leaves (usually in February-March), or with subsurface injections of Merit insecticide in
the Fall. Literature says that crown galls can be physically removed but this will create open
wounds on the stems. The Krauter vesuvias plum trees tend to be pest free but occasionally they
can produce small fruit.
Tree P:nming
The International Society of Arboriculture (ISA) Tree-Pruning Guidelines should be considered the
tree pruning specifications when tree pruning is put out to bid. Using these specifications, and
having tree pruners that are familiar with these specifications, should result in more uniform work
performed instead of some trees being remarkably thinner than others and some trees being
reduced while others are not.
Pruning, whether it is done by a tree service or landscape maintenance company, should be done
under the supervision of an ISA Certified Arborist.

Replacement Species
The list of replacement species is provided as an alternative to the existing tree species. If
uniformity and continuity is desired then replacing with the same species as removed might be
considered but not always recommended.
Tree Planting Guidelines
I have included a detailed procedure for planting trees which should allow for the maximization of
tree health.
Fertilization Of Trees
Theoretically, any tree on the property that is in fair condition is a candidate for fertilization. The
goal would be to improve the condition to average/very good/excellent. Realistically, the condition
of the trees is a function of the soil conditions (compact and shallow), the root development
(restricted and root bound), and the maturity of each tree. Soil conditions can be improved to some
extent with a procedure called subsurface hydraulic soil injection. This procedure includes
injecting a water/fertilizer mix with 300-400 pounds per square inch of pressure, on two foot
centers, in an area from the stem to beyond the drip line of the tree being fertilized.
Fertilization is appropriate for establishing young trees and improving the soil environment for the
trees that are growing in acceptable locations. It would not be recommended for trees in poor
locations.
A tree fertilization fact sheet is included in this report. The basic fonnula should be used as a
guide. Generally, a 3-1-1, 3-2-2, or2-1-1 formula is acceptable. The primary thing to consider
on the fact sheet is the method of application.
The Next Step In Maintaining The Treescape
1. Acquire bids from three tree care companies for all of the pruning and removal that is
suggested in this report. Segregate the trees by priority. This will help determine the tree care
budget for all three priorities and for the entire treescape.
2. The high priority removals should probably be done as soon as possible.
3. Replacement trees or shrubs can be planted after the trees next Spring.
4 Crown thinning, and reduction is recommended during the Summer, Fall, and Winter months
for trees that are in fair or better health. Trees with fair to poor structure may be pruned at
anytime of year if it is necessary to prevent breakage.

EXPLANA nON OF COLUMN HEADINGS
The first time a tree appears in the inventory it is identified by genus and species
followed by the common name on the line below. After which it is listed by
common name only.
Each tree is given a number. Numbers (on aluminum disks) appear on the trees
themselves and have been put on a map of the property.
This is the diameter of the tree measured in inches at a height of four and one half
feet above ground line. Exception to this are identified. An example: 3.5 @ 3'
means the diameter of the tree is three and one half inches measured three feet
above ground line. It is necessary to measure in this manner when the primary
crotch of a tree is below four and one half feet above ground line.
"Lac" means location. The location of the base of the tree in relationship to the
hardscape. A value of 1 indicates that the tree is less than four feet from
hardscape, 2 means 4-6 feet from hardscape, 3 means 6-8 feet from hardscape, 4
means 8-10 feet from hardscape, and 5 means greater than 10 feet from hardscape.
This is a rating based on the overall health of the tree. It is relative to the condition
of the leaves (color, size, and amount), the sized of wounds and wound closure,
and root condition. Fair condition-try treatments to improve. Poor condition-not
treatable.
This is a rating based on the distribution of branches, angle of branch attachments,
location of wounds, and root structure. Fair structure-can be improved with
pruning. Poor structure-decay, weak branch attachments, root bound.
"C T", and "C R" are abbreviations for crown thinning, and crown reduction,
Refer to the ISA Pruning Guidelines for more details. "Rem" means removal.
"D p" and "D D" are abbreviations for directional pruning and remove deadwood.
Directional pruning is necessary in order that vehicles can go under or within the
drip line of a tree.
The recommended frequency of pruning. A "3" indicates pruning every three
years.
Priority is based on location and structure.
Gives further information regarding the particular tree.

Acacia cognata . River
Height 20-30 feet tall, with eq ual spread. Narrow, drooping bright green
foliage to 4" long. Flowers are paired pale yellow puffs in the Spring.
Graceful weeping tree.
Acer rub rum 'Armstrong' or 'October Glory' - Scarlet Maple,
Red Maple
October Glory is tall, round headed with late fall color. Armstrong is
tall with narrow upright growth. Leaves 2-4" long.
Betula nigra - River Birch
Pyramidal form. Older bark flakes and curls in cinnamon brown to
blackish sheets. Yellow foliage in the Fall
CercidiphyUum japonicum - Katsura Tree
Eventually to 40' tall. Light and dainty foliage turns brilliant red or

APPLICATION FOR TREE REMOVAL
The original plans for Cupertino Village Greens (renamed in 1978 Commons of
CupertIno) were drawn by Donald Boos & Associates, Landscape Architects and dated
October 12, 1977.
The following trees identified by our certified arborist for removal were not in the
original landscape plan:
# 214 Krauter Vesuvius Plum
# 244 White Birch
# 249 White Birch
# 257 White Birch
# 302 White Birch
# 303 White Birch (Fell in the storm of 12/14/02
These trees are listed by number in our master Tree Inventory and Analysis. City of
Cupertino approval is not required for removal of the above trees.
Please note that an original tree, #309, Coast Redwood fell in the storm of 12/14/02. It
had been identified for removal.
