CC Resolution No. 98-295RESOLUTION NO. 98-295 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING GENERAL PLAN POLICIES 2-33, REGARDING NEIGHBORHOOD GATEWAYS, AND 6- 17 REGARDING PRIVATE RESIDENTIAL ENTRY GATES WHEREAS, the City Council of Cupertino initiated a General Plan amendment to modify policies related to electronic security gates; WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the City Council has held at least one public hearing on the matter; WHEREAS, Application 2-GPA-98 requests to amend the land use and public health and safety elements of the General Plan; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino that after careful consideration of facts, exhibits, testimony and other evidence submitted in this matter, the application for General Plan amendment 2-GPA-98 as described below is approved; and that the subconclusions upon which the findings and conditions specified in this resolution are based on and contained in the public hearing record and are incorporated by reference as though fully set forth herein. General Plan Policy 2-33 is hereby amended to read as follows: Define neighborhood entries through architecture, landscaping, or landforms appropriate to the formal or rural character of the neighborhood. If electronic security gates are proposed for multiple family attached developments, a fence exception application is required, and approval shall be based on meeting at least one of the following criteria, and the fence exception findings: · Is a mixed-use development, where the parking for different uses needs to be separate. · Includes a below-grade parking structure where the gates are required to secure the below- grade parking. · Requires gates to obtain federal or state funding. · Is designed for a special population needing greater security, such as seniors. Delete the following and replace with new text: Policy 6-17: Private Residential Entry Gates Discourage the use of private residential entry gates which act as a barrier to emergency service personnel. (New text, follows "Road Access" page 6-17.) ACCESS TO RESIDENTIAL DEVELOPMENTS Fire and other emergency personnel may be impeded if there are electronic security gates on residential developments. Therefore, if electronic security gates are proposed for multiple family attached developments, require a fence exception application and base approval on conformity with the General Plan (See Policy 2-33).
