CC Resolution No. 06-167 RESOLUTION NO. 06-167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO MAKING DETERMINATIONS AND ORDERING THE ANNEXATION OF EIGHT ISLANDS COLLECTIVELY DESIGNATED "CUPERTINO POCKETS 06-01," AND INDIVIDUALLY IDENTIFIED AS: "CUPERTINO POCKET #3 - MCCLELLAN ROAD," "CUPERTINO .POCKET #4 - STEVENS CANYON ROAD," CUPERTINO POCKET #5 - RAINBOW DRIVE," "CUPERTINO POCKET #6 - S. STELLING ROAD," "CUPERTINO POCKET #7 - RAINBOW DRIVE," "CUPERTINO POCKET #9 - UPLAND WAY," "CUPERTINO POCKET #10 - UPLAND WAY," AND "CUPERTINO POCKET #11 - SEVEN SPRINGS PARKWAY," CONSISTING OF THE ANNEXATION OF ABOUT 17.38 ACRES OF TERRITORY GENERALLY BOUNDED BY STEVENS CREEK BOULEVARD, STELLING ROAD, SOUTHERLY CITY LIMITS AND STEVENS CANYON ROAD WHEREAS, on September 5, 2006, the City Council adopted Resolution No. 06- 153, initiating proceedings for annexation of eight islands of unincorporated land collectively designated "Cupertino Pockets 06-01 ", and individually identified as: "Cupertino Pocket #3 - McClellan Road", "Cupertino Pocket #4 - Stevens Canyon Road", "Cupertino Pocket #5 - Rainbow Drive", Cupertino Pocket #6 - S. Stelling Road", "Cupertino Pocket #7 - Rainbow Drive", "Cupertino Pocket #9 - Upland Way", "Cupertino Pocket #10 - Upland Way", and "Cupertino Pocket #11 - Seven Springs Parkway. " WHEREAS, Section 56757 of the California Government Code states that the Local Agency Formation Commission shall not have any authority to review an annexation to any City in Santa Clara County of unincorporated territory which is within the urban service area of the city of the annexation if initiated by resolution of the legislative body, and therefore the City Council of the City of Cupertino is now the conducting authority for said annexation; and WHEREAS, said territory is inhabited and all owners of land included in the proposal have not consented to this annexation; and WHEREAS, in accordance with Section 56157 of the California Government Code, the City of Cupertino has provided mailed notice of the initiating hearing on the annexation to all property owners of record and registered voters within 300 feet of the exterior boundary of the affected territory, affected agencies and other interested parties; and WHEREAS, in accordance with Section 57025 of the California Government Code, the City of Cupertino has provided mailed notice of the protest hearing on the annexation to all affected property owners and registered voters, affected agencies and other interested parties, along with notification of eligibility of the affected property Resolution No. 06-167 October 3,2006 Page 2 ----------------------------------------------------------- ----------------------------------------------------------- owners and registered voters to protest this City-initiated proceeding and instructions on how to prepare a valid, written protest; and WHEREAS, the City of Cupertino opened and conducted a public hearing on the annexation in accordance with Section 57050 of the California Government Code, to accept protests and withdrawals of protests, objections or evidence which is made, presented, or filed; and WHEREAS, the City of Cupertino, subsequently closed the public hearing on October 3, 2006, and intends to determine the value of the written protests in order to take the appropriate action on the annexation; and WHEREAS, the City Clerk has determined that the valid protests received from affected property owners of record and affected registered voters had insufficient value in accordance with State law, to require an election on the annexation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino as follows: 1. That it is the conducting authority pursuant to Section 56757 of the California Government Code for the annexation of eight islands of territory collectively designated "Cupertino Pockets 06-01 ", more particularly described in Exhibits "A-I, A-2, B-2, A-3, A-4, A-5, A-6, A-7, B-7, & A-8"; 2. That the following findings are made by the City Council of the City of Cupertino: a. That said territory is inhabited and comprises approximately 17.38 acres. b. That the annexation is consistent with the orderly annexation of territory within the City's urban service area and is consistent with the City policy of annexing when providing City services. c. The City Council has completed an initial study and has found that the annexation of said territory has no significant impact on the environment, and approves the granting of a Negative Declaration. d. The City Council has pre-zoned the subject territory that constitutes the entirety of the subject annexation to pre-ML-RC on May 1, 1967, pre- RHS-21 on May 6, 1996, Pre-RHS or Pre-RI-6 on September 8, 1981, Pre-RHS-40 on June 19, 1995 or May 6, 1996; or pre-zoned the territory to pre-RI-6 on September 8,1981. e. That the territory is within the city urban service area as adopted by the Local Agency Formation Commission (LAFCO). That the County Surveyor has determined the boundaries of the proposed annexation to be definite and certain, and in compliance with the LAFCO's road annexation policies. The County has waived its certification fees that are normally imposed on the city/conducting authority. g. That the proposed annexation does not create islands or areas in which it would be difficult to provide municipal services. h. That the proposed annexation does not split lines of assessment or ownership as determined by the Santa Clara County Assessor's Office. 1. That the proposed annexation is consistent with the City's General Plan. J. That the territory to be annexed is contiguous to existing City limits under provisions of the Government Code. k. That the City has complied with all conditions imposed by LAFCO for inclusion of the territory in the City's urban service area. 1. That 5 valid protests to the annexation proceeding were received by the Clerk of the City of Cupertino, and the value of those protests submitted prior to the close of the public hearing constituted 16.2% of the 37 registered voters residing in the affected territory; and 20.0% of the 30 property owners who own 29.97% of the $7,549,861 total assessed land valuation and that the last equalized County assessment roll and Registrar of Voters list of registered voters within the unincorporated area were used to make these determinations. BE IT FURTHER RESOLVED: A) City of Cupertino taxes and fees will be extended to this territory, which includes: 1) The Utility Users' Tax of 2.4% of the natural gas, electricity, local and long distance telephone charges; 2) The Storm Drainage Service Fee on an annual basis is $12.00 per single-family or duplex residential parcel; $144.00 per acre of apartment, commercial, or industrial land, and $36.00 per acre of vacant land; 3) The Cupertino Business License Fee applicable to businesses in the City and currently $105.00 per year for most home-based businesses. Resolution No. 06-167 October 3,2006 Page 4 ----------------------------------------------------------- ----------------------------------------------------------- NOW, THEREFORE, be it resolved that the City Council of the City of Cupertino hereby approves and orders the annexation of these eight unincorporated islands, collectively designated "Cupertino Pockets 06-01," and individually identified as: "Cupertino Pocket #3 - McClellan Road", "Cupertino Pocket #4 - Stevens Canyon Road", "Cupertino Pocket #5 - Rainbow Drive", Cupertino Pocket #6 - S. Stelling Road", "Cupertino Pocket #7 - Rainbow Drive", "Cupertino Pocket #9 - Upland Way", "Cupertino Pocket #10 - Upland Way", and "Cupertino Pocket #11 - Seven Springs Parkway," without an election, and that annexation consists of the annexation of about 17.38 acres of territory to the City of Cupertino, generally bounded by Stevens Creek Boulevard, Stelling Road, the southerly City limits and Stevens Canyon Road.
