Project Description: Architectural and Site Approval for a landscaping plan for an
approved planned residential development (southwest corner of Homestead Road and
Maxine Avenue).
RECOMMENDATION:
Staff recommends that the Design Review Committee approve file no. ASA-2006-20
based on the model resolution.
BACKGROUND:
This residential project received approval of a Use Permit (U-2005-13) and Architectural
and Site Approval (ASA-2005-09) by the Planning Commission on September 13, 2005.
The approvals had a condition that required a privacy landscape plan subject to DRC
approval. The condition states:
11 . . . The landscape plan shall provide privacy screening for residential lots abutting lots
no. I, 2 & 3 in accordance with the R-l ordinance and to the extent the landscaping does
not harm the protected oak trees. In addition, the plan shall provide a privacy
landscape screen between the school to the south and lots no. 3,4 & 5. Landscaping of
the school perimeter will be considered with the concurrence of the property owner./I
DISCUSSION:
The plan set (Sheet L3.1) shows a privacy landscape screen along the rear yards of Lots
#2,3,4 & 5. Lot #6 is surrounded by streets and has no privacy impacts. Views from
the Lot #1 residence are heavily screened by two onsite, mature coast live oak trees, so
additional landscaping is not necessary. Staff also does not favor planting any trees
within the canopies of the oaks. Lot #3 is only partially screened because the abutting
neighbor, who has a number of mature Monterey Pines on the property, has waived the
landscaping (Exhibit A). Staff has added as a condition of approval, minimum planting
heights as specified in the Rl ordinance.
For the privacy screening, the applicant has utilized shrub and tree species from the
City's recommended list of privacy screen plantings: 15 gallon Pittosporum eugenioides
and Pittosporum tenuifolium and 24/1 box Melaleuca linarifolia (Flaxleaf Paperbark). The
property owner of the school to the south has submitted a form supporting the
proposed plan (Exhibit B).

WHEREAS, the City Council has directed the Design Review Committee to review the design
of a privacy landscape plan for an approved residential planned development;
WHEREAS, the City Council has directed that the Rl zoning ordinance privacy standards
and procedures be used to guide the review and the existing mature oaks be protected on the
property;
WHEREAS, the Design Review Committee has reviewed the landscape plan;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the Design Review Committee approves the architectural and site
approval, file no. ASA-2006-20, subject to the conditions, which are enumerated in this
Resolution.
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2006-20
set forth in the Minutes of the Design Review Committee meeting of, October 5, 2006, and are
incorporated by reference as though fully set forth herein.

Approval is based on the plan set titled: "Peninsula Communities Homestead Road Site",

2. PRIV ACY TREE & SHRUB PLANTING HEIGHTS
Rear yard privacy trees shall have a minimum planting height of 8 feet and the privacy
shrubs shall have a minimum planting height of 6 feet.
3. PROPERTY COVENANT FOR PRIV ACY PLANTINGS
Prior to building occupancy, applicant shall record a convenant on the affected lots,
notifying future property owners of the privacy landscaping status of those certain trees
and shrubs and the responsibilities for maintaining that particular landscaping.

PROJECT DESCRIPTION: Sign exception request for an additional ground sign and
additional square footage for a directional sign for Apple Computer to be installed at an
existing industrial property located on the south side of Mariani Avenue, east of De
Anza Blvd.
RECOMMENDATION:
Staff recommends approval of EXC-2006-10, based on the mo?el resolution.
BACKGROUND:
The applicant, Pete Ross, on behalf of Apple Computer, is requesting a sign exception to
allow a second ground sign on the subject property. The existing ground sign
advertises Dade Behring, the other tenant within the existing industrial building on the
subject property that occupies the front half of the building. The existing Dade Behring
ground sign is located interior to the site within a planter area near the frontage of the
building. Apple Computer is occupying the rear half of the building.
DISCUSSION:
The proposed ground sign for Apple will be 6.75 feet tall and approximately 25 square
feet. The design of the sign is typical of other Apple signs in that it features a blue
Apple logo on a white background and will include the address on the lower portion of
the sign. It is proposed to be located within the landscaped parkway along Mariani
Avenue in front of the subject property and will be set back 11 feet from the face of curb
to ensure that the sign is well outside of the public right-of-way. The public right-of-
way terminates 10 feet in from the face of curb along Mariani Avenue.
The proposed directional sign is to be located within a landscaped island within the
middle of the driveway on the rear half of the site closer to the portion of the building
occupied by Apple. The directional sign will be 4.55 feet high and 4.55 square feet. The
sign is only approximately half a square foot larger in sign area than permitted by the
sign ordinance. The applicant is requesting the minor additional sign area allowance to
allow for a sign at 4 1/i feet in height. This will provide sufficient visibility of the
directional sign.
According to the City's Sign Ordinance (17.24.100), each site may have one ground sign
with a minimum frontage of 100 feet and minimum combined front yard setback and
frontage of 150 feet. The subject property has an approximately 350-foot street frontage
and is permitted only one ground sign per the sign ordinance. Sites with over 500 feet

of frontage may have a second ground sign. Additionally, Section 17.16.010 (Exempt
Signs) allows directional signs as exempt signs when they are less than four square feet.
The proposed directional sign slightly exceeds this allowance.
Staff has reviewed the proposal for the additional ground sign and additional
directional sign area and is supportive of the request for a sign exception for the
following reasons:
1. Apple and Dade Behring are both major tenants in the existing industrial
building. There are no other tenants in this building.
2. The existing building has no wall signage; therefore, the ground signs are the
only means of advertising for the businesses on the subject property.
3. Because the Dade Behring ground sign is located internally on the site and the
Apple signage is proposed along the street frontage, staff does not believe that
the additional ground sign will create any aesthetic visual cluttering on the site.
4. The design and location of the Apple ground sign is in keeping with other Apple
signs found along Mariani Avenue.
5. The additional half foot of sign area for the directional sign is minor in nature
and is needed to provide sufficient visibility of the sign and to provide adequate
direction to the rear half of the building that is occupied by Apple.
Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
A. Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and Intent of Sign
Ordinance
Staff believes the intent of the sign ordinance is being achieved with the additional
Apple ground sign to "identify and enhance businesses while maintaining the aesthetic
appearance of the City" and to "maintain the identification and individual character of
each business" as stated in Section 17.04.020. The additional ground sign does not
provide for visual cluttering on the site because there are no wall signs on the building
and the existing ground sign is located interior to the site. Additionally, the applicant is
trying to achieve consistency of signage for Apple along Mariani Avenue by adding a
ground sign in front of this subject property. Each of Apple's separate locations has a
ground sign along Mariani Avenue.
B. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safeh}, or welfare
The additional ground sign and directional sign area will not be detrimental to the
public health, safety, or welfare. The signage will help to ensure adequate identification
and provide direction for Apple employees and visitors to this building.

C. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage requires the least modification to accomplish the purpose of the
signage to adequately identify and provide direction to Apple employees and visitors.
The exception requested is consistent with the intent and spirit of the sign ordinance.
Staff therefore recommends approval of the sign exception per the model resolution.
