PROJECT DESCRIPTION: Sign exception to allow a second wall (logo) sign that is
seven feet tall with a border tube for an approved entertainment center.
RECOMMENDATION:
Staff recommends approval of EXC-2006-08, based on the model resolution.
BACKGROUND:
The applicant, Jim Hutchinson, representing Chuck E. Cheese Entertainment Inc. (CEC),
requests a sign exception to allow a second, illuminated wall (logo) sign with a border
tube on the same side of the building and that sign would be seven feet tall. The City
sign code provides for:
1) only one wall sign per business, except under certain circumstances that are
not met by the applicant;
2) if a second wall sign is allowed, that there be only one wall sign on each side
of a building; and
3) a maximum wall sign height of 36 inches.
DISCUSSION:
Second Wall Sign on Same Side of Building
Staff is treating the logo sign and border tube as a second sign because it is visually
separated from the pan-channel letter sign, and it is physically located on a different
part of the building (parapet wall) versus the pan-channel letter sign, which is located
on the building fascia band.
A sign exception is being requested for the second sign because the applicant cannot
meet the criteria for a second wall sign and still effectively communicate with its
customers. Those criteria are:
a) Business is adjacent to more than one street (Portal Ave. & Stevens Creek Blvd.)
and does not have a ground sign; or
b) The sign is directed toward the interior of the project and not visible from the
public right-of-way.
CEC is a major tenant for this shopping center and expects to have a presence on the
existing ground sign as this portion of the shopping center is setback 200 feet from the
street, which limits its public visibility.

Staff also feels it is appropriate to locate the second sign on the same side of the
building (Stevens Creek Blvd. frontage) as any wall signage on the Portal Avenue
frontage has the potential to be view from the residential neighborhood.
Height of Second Wall Sign
CEC is proposing a maximum logo sign height of seven feet where three feet is allowed.
According to a letter received from CEC (Exhibit A), the taller logo sign is directed to
advertise to its primary guests, children under six years of age that cannot read. CEC
also notes the extra sign height is needed because the building is setback far from the
street (200 feet) which limits its visibility.
CEC is limited to a sign area of 115 square feet. Its proposed combined sign area is
105.5 square feet.
Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
A. Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and Intent of Sign
Ordinance
The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."
Due to the large building setback, an additional taller logo sign is necessary to
effectively communicate with children that do not read and cannot see smaller signs
because of their short stature and limited visibility in the rear seat of motor vehicles.
In addition, the building has been redesigned so that a taller sign is more proportional
to the mass and height of the building.
B. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare
The additional signage and taller sign height will not be detrimental to the public
health, safety, or welfare. Instead, younger patrons will have an easier time locating the
business in the shopping center.
C. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage shall be consistent with the sign ordinance in terms of sign area.
The exception requests are consistent with the intent and spirit of the sign ordinance.

2. That the granting of the exception will not result in a condition which is
materially detrimental to the public health, safety, or welfare, instead young
children will have an easier time locating the business; and
3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose. The sign area is under the maximum allowed by the sign code. The
proposed sign height will provide adequate visibility for younger patrons.

NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2006-08, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
EXC-2006-08 as set forth in the Minutes of the Design Review Committee Meeting of
September 21, 2006, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the sign exhibits titled: "Chuck E. Cheese #786" consisting of
3 pages labeled SITE/SUMMARY, AO.O and B-1, except as may be amended by
conditions contained in this resolution.
2. SIGN AREA
The proposed sign area shall be consistent with the City Sign Ordinance.
3. SECOND SIGN APPROVAL
Approval is hereby granted for a second wall (logo) sign of seven feet in height.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

Dear Community Development Department:
CEC Entertainment, Inc. dba Chuck E. Cheese's respectfully asks for an exception of the
Sign Code. Strict application of the provisions of the code would result in a hardship to
this applicant.
There are special circumstances applicable to a Chuck E. Cheese's. The primary guests
are children under six (6) years of age that cannot read; however, they immediately
recognize the Chuck E. Cheese's logo. CEC Focus Group Studies indicate very young
children recognize the logo.
Portal Plaza Shopping Center is set back from the street. Chuck E. Cheese's is an end
cap position and hard to see from Stevens Creek Boulevard.
The granting of this exception will have a positive affect on the center as Chuck E.
Cheese's is a major tenant and will promote business from families and their children.

Project Description: Architectural and site review of a revised 3-level parking garage
design for an approved 60,000 square foot, 3-story office building at 10495 North De
Anza Boulevard.
RECOMMENDATION:
Staff recommends approval of file no. ASA-2006-16 per the model resolution.
BACKGROUND:
On August 15, 2006, the City Council approved a use permit and ASA for a 3-story,
60,000 square foot office building with parking structure to be located at 10495 N. De
Anza Blvd. In its conditions of approval, the City Council directed the applicant to seek
ASA approval through the DRC for the final design of the parking structure as its mass
and location had negative visual impacts on the adjacent office building (Mariani
Business Center) toward the rear. The Council provided design direction for the garage
using the Commission-recommended parking structure as a reference point (Exhibit A).
The DRC may include the following items in its considerations:
1) Use a smaller footprint parking garage, such as the one recommended for
approval by the Planning Commission;
2) Setting back the garage as far as possible from the rear property line nearest the
Mariani Business Center (MBC);
3) Landscaping around the parking structure to soften the view of the structure
from the Mariani Business Center;
4) Flipping the garage, so the less massive ramp is closer to the Mariani Business
Center; and
5) Lower garage height by depressing garage 1/z level below grade (Council did not
favor under grounding the parking).
DISCUSSION:
The key consideration is creating as wide a separation between the Mariani Business
Center (labeled "OFFICE" on the plan set) and the parking structure. The adjacent
property owner was concerned about the garage mass looming over her building and
the openness of her view from her ground level office.
The project architect has accomplished this by contracting the garage footprint on the
north side and notching the parking structure near MBC. While the parking structure is
predominantly set back 10 feet from the property line, it increases to 30+ feet near MBC.
The quantity of parking provided, 214 spaces, meets the City parking requirement of
211 parking spaces.

Staff did not agree with the design concept of placing the less massive garage ramp near
MBC because of the frequency of vehicular noise, glare and exhaust that would impinge
upon the MBC occupants. The internalized ramping system is a much better solution
for MBC. The ramps are set even further back from MBC and are buffered by the
intervening driveway aisles, parking and landscaping.
The project architect also created a split level design to present a shorter structure
(23'6") toward MBC and the taller structure (28'6") facing the new, approved office
building.
The landscaping design is not well-developed yet, so staff requests that DRC direct staff
to work with the applicant during the building permit phase to improve the amount of
landscaping. The proposed landscape margins are only five feet wide, which could
accommodate tall plants like bamboo or Italian Cypress, which is needed to soften the
appearance of the building.

Project Description: Marketplace Shopping Center palm tree replacement plan.
BACKGROUND:
The City Arborist met with staff at the project site and confirmed that the existing
planter strip immediately east of Building B will be able to facilitate the replacement
palms provided that the following measures are implemented.
. A section of the three foot wide gutter overhang were cut out back to the
.facia board to leave room for the trunk to develop; and
. A piece of the sidewalk adjacent to the desired palm planting site of 2 feet
wide and 3 feet long were cut out of the concrete sidewalk to leave room
for the root system to develop. Cut outs have already been made in the
sidewalk north of the overhang area which can serve as examples of what
these cut outs should look like.
. To prevent the trunk of the palm tree moving in the wind and being
abraded by the 6 x 8 building rafters, a retainer ring of rubber can be tied
around the trunk of the tree at roof height, and a rubber tree tie extend to
each of the adjacent rafters to prevent the trunk from abrading the
building.
RECOMMENDATION:
Staff recommends that the Committee approve the landscaping plan with the City
Arborist's recommendations.

Project Description: Architectural and site review of revised elevations and landscape
plans for the new Public Storage mini-storage facility to be constructed at 20565 Valley
Green Drive.
RECOMMENDATION:
Staff recommends that the Design Review Committee approve. the revisions to ASA-
2006-05 based on the model resolution with the following conditions:
1. Provide additional trees within the landscape area on the Cal Trans
Interstate 280 right-of-way adjacent to the northern property line of the
project site as permitted by Cal Trans. The applicant shall work with Cal
Trans to secure approval for planting of these trees along the project site on
Cal Trans property.
2. Benches shall be provided along the pedestrian pathway. The location and
design of benches shall be reviewed and approved by the Director of
Community Development prior to issuance of building permits.
3. Landscape planter areas shall be installed in front of the trellis elements that
are placed against the buildings and shall be planted with clinging vines
that shall be trained to grow onto the trellis elements.
4. An alternative species of tree than the Red Maple tree shall be proposed
along the pedestrian pathway that shall provide adequate canopy coverage
year around and is an evergreen type of tree that can be planted next to the
existing eucalyptus trees. The species of tree to be planted shall be
reviewed and approved by the Director of Community Development.
5. An alternative species of tree than the Red Maple tree shall be proposed
along the rear and west side yards of the property that is an evergreen type
of tree and provides screening along the west and north perimeter of the
property year around. The species of tree to be planted shall be reviewed
and approved by the Director of Community Development.
6. Staff recommends that Public Storage provide lighting details to be
reviewed and approved by the Director of Community Development.
BACKGROUND:
This project received approval of a Use Permit (U-2006-03) and Architectural and Site
Approval (ASA-2006-05) by the City Council on July 18, 2006, with conditions requiring
that revised architectural design and landscape plans be reviewed and approved by the
Design Review Committee prior to issuance of building permits.

4. LANDSCAPING
A. Landscape planter areas shall be installed in front of the trellis elements that are
placed against the buildings and shall be planted with clinging vines that shall be
trained to grow onto the trellis elements.
B. An alternative species of tree than the Red Maple tree shall be proposed along the
pedestrian pathway that shall provide adequate canopy coverage year around and
is an evergreen type of tree that can be planted next to the existing eucalyptus
trees. The species of tree to be planted shall be reviewed and approved by the
Director of Community Development.
C. An alternative species of tree than the Red Maple tree shall be proposed along the
rear and west side yard of the property that is an evergreen type of tree and
provides screening around the west and north perimeter of the .property year
around. The species of tree to be planted shall be reviewed and approved by the

5. LIGHTING

Approval is granted to construct two new three-story buildings consisting of 74,511 square

3. PARKING
The applicant shall provide a minimum of 80 parking spaces on site, in accordance with
the parking study prepared on March 20,2006 by TJKM Transportation Consultants.
4. LANDSCAPE PLAN
The applicant shall submit detailed landscape and irrigation plans to be reviewed and
approved by the Design Review Committee (DRC) that:
a. Provide additional trees within the landscape area on the Cal Trans Interstate 280

of the site to mitigate the privacy impacts of the project from the adjacent
residential neighborhoods. .
c. Provide landscaping along the masonry wall separating the project site from
adjacent residential uses. Landscaping shall consist of a combination of trees,
shrubs and/or climbing vines that will enhance the privacy screening for the
adjacent residential uses.
5. TREE PROTECTION
As pali of the demolition or building permit drawings, a tree protection plan shall be
prepared by a celiified arborist for the trees to be retained. In addition, the following
measures shall be added to the protection plan:
>- For trees to be retained, chain link fencing and other root protection shall be
installed around the dripline of the tree prior to any project site work.
>- No parking or vehicle traffic shall be allowed under root zones, unless using
buffers approved by the Project Arborist.
>- No trenching within the critical root zone area is allowed. If trenching is needed in
the vicinity of trees to be retained, the City's consulting arborist shall be consulted
before any trenching or root cutting beneath the dripline of the tree.
>- Wood chip mulch shall be evenly spread inside the tree projection fence to a four-
inch depth.
>- Tree protection conditions shall be posted on the tree protection barriers.
>- Retained trees shall be watered to maintain them in good health.
>- A covenant on the property shall be recorded that identifies all the protected trees,
prior to final occupancy.
The tree protection measures shall be inspected and approved by the celiified arborist prior
to issuance of building permits. The City's consulting arborist shall inspect the trees to be
retained and shall provide reviews before building pennit stage, during construction and
before final occupancy of the garage. A report ascertaining the good health of the trees
mentioned above shall be provided prior to issuance of final occupancy.
6. TREE PROTECTION BOND
All trees that are not required to be removed shall be covered by a tree protection bond. A
tree protection bond in the amount of $50,000 shall be provided prior to issuance of
demolition or building pemlits.
7. LANDSCAPE REVIEW
The applicant shall submit a comprehensive landscaping plan, including water
consel-vation and pesticide reduction measures, in conformance with Chapter 14.15,
Xeriscape Landscaping and the pesticide control measures referenced in Chapter 9.18,
Stormwater Pollution Prevention and Wartershed protection, of the City Municipal Code.

8. BICYCLE P ARKlNG
The applicant shall provide bicycle parking and bike racks for the proposed project. The
number of bicycle parking spaces and location of bike racks shall be detennined by the
Director of Community Development.
9. UNUSED BUILDING MATERIALS
In lieu of disposing of unused building materials for the construction of the project, the
applicant shall be required to recycle the unused building materials.
10. BUILDING MATERIAL RECYCLING
The existing building and site matelials shall be recycled to the maximum extent possible
'subject to the review by the Building Official. Proof of recycling shall be submitted to the
City for review prior to final occupancy.
11. DEMOLITION REQUIREMENT
All existing structures on the site shall be removed prior to or conculTently with project
construction. The developer shall assume the responsibility to obtain all required
demolition pem1its in accordance with City Ordinances. The applicant shall agree to site
inspection by the Historical Society if requested.
12. MASONRY WALL
A six-foot masomy wall shall be provided on the project's mutual boundary with
residentially zoned or used property. Said wall shall be at least six feet in height as
measured from highest. adjoining grade; greater height may be required if the project
creates noise impacts that will require an acoustical consultant repOli.
13. SCREENING
All mechanical and other equipment on the building or on the site shall be screened so
they are not visible from public street areas or adjoining developments. Screening
materials/colors shall match building features and materials. The height of the screening
shall be taller than the height of the mechanical equipment that it is designed to screen.
The location of equipment and necessary screening shall be reviewed and approved by the
Director of Community Development prior to issuance of building pennits.
14. TRASH AND DELIVERY ACTIVITIES
A detailed refuge and truck delivery plan must be prepared by the applicant. The plan
shall specify locations of trash facilities, refuge pick up schedules and truck delivery
schedules and routes. All trash facilities must be screened and enclosed to the satisfaction
of Public Works Depatiment. The final plan shall be submitted to the City for review and
approval prior to issuance of building penuits.
