OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING A SIGN EXCEPTION TO ALLOW A GROUND SIGN FOR
A MULTI-TENANT SHOPPING CENTER: AN INCREASE IN SIGN
AREA UP TO 64 SQUARE FEET, A SIGN HEIGHT OF 11 FEET 5 INCHES,
7 TENANT NAMES, AND A LOCATION WITHIN A SIDEWALK SITE
TRIANGLE AT 22350 HOMESTEAD ROAD
SECTION I: PROTECT DESCRIPTION

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an
application for a Sign Exception, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes are beneficial and
compatible with the surrounding area and makes the following findings for a sign
exception as described above;
A. That the Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and
Intent of Sign Ordinance
The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."
The property is unusual for a commercial lot, in that it has a narrow street frontage in
relation to the length of the building, which sides on the lot. Existing commercial
tenants would not have sufficient sign area under sign ordinance allowances.
Additional sign height is also warranted. Because of the narrowness of the lot, the
; property owner does not control all of the land surrounding the sign and cannot
i/ maintain the surrounding landscape to prevent it from obscuring the signage
information.
B. The granting of the exception will not result in a condition which is materially
detrimental to the public health, safety, or welfare

The Sign Exception will not be detrimental to the public health, safety, or welfare, even
though it is located in the sidewalk site triangle. The sidewalk is wide enough so that
Homestead traffic views are not obscured by the sign.
C. Least Modification and Minimum Variance to Accomplish Purpose
The exception requests provide the minimuin variances to allow for an effective and
visible sign for this multi-tenant shopping center.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2006-06, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
EXC-2006-06 as set forth in the Minutes of the Design Review Committee Meeting of
January 18, 2007, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the sign exhibits titled: "Homestead Shopping Center Tenant
Improvement, 22350-22382 Homestead Road, Cupertino, CA 95014" consisting of
one page, and exhibits titled: "Homestead Crossing" consisting of 4 pages that are
unlabeled, except as may be amended by conditions contained in this resolution.
2. GROUND SIGN AREA
The proposed sign area shall be up to 64 square feet and shall incorporate the
shopping center name in the sign area. Tenant names shall be at least 6 inches in
height.
3. GROUND SIGN HEIGHT
The maximum height of the ground sign shall be 11 feet, 5 inches.
4. GROUND SIGN SETBACK
The sign shall be set back at least 3 feet from the inside edge of the sidewalk.
5. NUMBER OF TENANT NAMES ALLOWED ON GROUND SIGN
This approval grants seven (7) tenant names on the ground sign.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OT��ER EXACTIONS
The Conditions of Project Approval set forth herein may inclucie certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written

notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

Design Review Committee of the City of Cupertino, State of California, by the following
roll call vote:
