OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING A SIGN EXCEPTION TO ALLOW TWO EXTRA WALL
SIGNS, ONE FOR THE STEVENS CREEK BOULEVARD FRONTAGE
AND THE SECOND FOR THE STELLING ROAD FRONTAGE. AND TO
EXCEED THE MAXIMUM SIGN HEIGHT OF 48 INCHES FOR THE
WALL SIGNS FRONTING ON STELLING ROAD AND STEVENS CREEK
BOULEVARD FOR AN APPROVED GROCERY STORF AT 20955

SECTION I: PROTECT DESCRIPTION

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an
application for a Sign Exception, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the three requests, i.e., the one for
a wall sign on Stevens Creek Boulevard and an extra wall sign on the Stelling Road
facing frontage, and the increased sign height for the wall signs are beneficial and
compatible with the surrounding area;
1. That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title, in that the extra wall signs on
the Stevens Creek Boulevard and Stelling Road frontages will advertise this
major business from the City's most prominent street without cluttering the
building fa�ade, given the size of the building and site;
2. That the granting of the exception will not result in a condition which is
materially detrimental to the public health, safety, or welfare, since the signage
will be primarily visible from nonresidential areas and the mounting of the sign
will meet building codes.
3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose. Maximum signage height will only be exceeded b�� the "leafy top" over

the "O" in WHOLE, which represents a minimum variance from the sign code.
A wall sign for Stevens Creek Boulevard should not be considered excessive
given the size of the building and size of the site. The addition of an extra wall
sign facing Stelling Road will be mitigated by limiting the wall sign height to no
more than 6 feet and deleting the ground sign on Stelling Road
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2007-07, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
EXC-2007-07 as set forth in the Minutes of the Design Review Committee Meeting of
June 7, 2007, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the sign exhibits titled: "Whole Foods Market, Cupertino,
CA" consisting of 6 pages labeled: 1 through 6, and dated 08/10/05, except as may
be amended by conditions contained in this resolution.
2. EXCEPTION APPROVAL
Approval is hereby granted for:
a) a wall sign on the Stevens Creek Boulevard frontage with a sign height of
up to 55.5 inches,
b) a second wall sign facing Stelling Road with a maximum sign height of 72
inches (6 feet), and
c) a sign height exception for the leaf top motif on the single line wall sign
facing Stelling Road with a maximum sign height of 65.75 inches.
3. SIGN DELETION
The staff-approved ground sign facing Stelling Road is hereby voided with this sign
exception approval.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER
EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions
constitute written notice of a statement of the amount of such fees, and a
description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may
protest these fees, dedications, reservations, and other exactions, pursuant to
Resolution No.256 EXG2007-07 June 7,2007

Government Code Section 66020(a), has begun. If you fail to file a protest
within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
