SUBJECT: RETROACTIVE TREE REMOVAL PERMIT ACTION LETTER- Application TR-2012-09:
This letter confirms the decision of the Director of Community Development, given on March 5, 2012,
approving a retroactive tree removal permit to remove and replace a dead Monterey Pine tree at an
existing office building (De Anza Professional Center), located at 10680 S De Anza Boulevard with the
following conditions:
1. APPROVED PROTECT
The approval is based on the arborist review by Tim Fitzgerald (Certified Arborist #WC-4439),
consisting of one page, dated January 20, 2012, except as may be amended by conditions in this
resolution.
2. TREE REPLACEMENTS
The applicant shall plant two (2) 24-inch box Coast Redwood trees as shown on the tree replacement
plan.The replacement trees shall be planted within 30 days of this approval.
3. NOTICE OF FEES, DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions,pursuant to Government Code Section 66020(a),has begun. If you fail to file a protest
within this 90-day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit for the dead tree in accordance
with Section 14.18.120B (Exemptions) of the Protected Trees Ordinance.

Report on a Dead Pine Tree at De Anza Professional

The following is a report on one (1) Monterey Pine that was removed at De Anza Professional
Center. The report is based on information received from the company that removed the tree.
The Monterey pine that was removed had been dead for over a year do to Pine Pitch Canker and
secondary infestation of Turpentine and Ips beetles. The pine also had a severe lean with a target
area that endangered both structures and the public. Do to this fact it was deemed necessary to
remove immediately. The owners are requesting a retroactive permit for the removal of this tree.
Replacement trees will be two 24" box Sequoia sempervirens.
