This letter confirms the decision of the Director of Community Development, given on February 10,
2012, approving a tree removal permit to allow the removal and replacement of ten trees, including six
(6) Redwood trees (with trunk diameters ran�ing from 21 inches to 32 inches), three (3) Tulip trees
(with trunk diameters ran7ing from 15 inches to 17 inches) and one 8-inch diameter Birch tree. The
addresses for the tree removal applications are: 11638 Birch Spring Court (TR-2011-62), 11637 Cedar
Spring Court (TR-2011-58), 11656 Cedar Spring Court (TR-2011-5�, 11636 Cedar Sprin� Court (TR-
2011-56), 11633 Bridge Park Court (TR-2011-59), 11632 Bridge Park Court (TR-2011-60), 11652 Brid�e
Park Court (TR-2011-61), 11627 Cedar Spring Court (TR-2011-55), 11596 Cedar Spring Court (TR-2011-
53) and 11606 Cedar Sprulg Court(TR-2011-54) �vith the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by David Babby (Certified Master Arborist
WE-4001B), dated June 6, 2011, consisting of 24 pages and entitled: Tree Removal Report, A�2
Arborist Review of 16 Trees Proposed for Removal fi•om tlie Seve�i Springs HOA, Cuperti�zo, Califor�7ia,
and the tree removal and tree replacement plans submitted by the applicants, except as may be
amended by conditions in this resolution.
2. TREE REPLACEMENT
The applicants shall plant replacement trees on the properties in accordance with the Tree
Replacement Plan submitted by the applicants and the City's Protected Tree Ordinance. The
required replacement trees shall be planted within 60 days of the effective approval date of this
tree removal permit.
3. PROTECTED TREE COVENANT
The applicants shall be required to record covenants recording the replacement trees as protected
trees �vithin 30 days of planting the replacement trees in accordance with the City's Protected
Trees Ordinance. Failure to do so may result in code enforcement and/or administrative citations.
4. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has bewn. If
you fail to file a protesf tvithin this 90-day period complying with all of the requirements of
Section 66020,you will be legally barred from later challengin�such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision
can be made within 14 calendar days from the date of the mailing of this decision. If this
happens,you s�vill be notified of a public hearing,which will be scheduled before the Planning
Commission and the trees cannot be removed until a final decision on the appeal has been
made. If no appeal is made svithin the appeal period, the tree(s) may be removed after Friday,
February 24,2012.

1.0 INTRODUCTION
I have been retained by the City of Cupertino Community Development Department to
review the proposed removal of 16 trees from various locations within the Seven Springs
HOA; Cupertulo. Specific tasks performed are as follo��s:
■ Review the following documents (not dated) provided with the removal
application: a spreadsheet identifying the general locations of 16 trees, and a map
showing the general locations of 15 trees.
■ Visit the site on May 27, 2011, and identify each tree proposed for removal.
■ Measure each tree's trunk diameter at 54 inches above grade or where appropriate
to best represent trunk size; diameters are rounded to the nearest inch.
■ Estimate each tree's canopy spread.
■ Ascertain each tree's health and structural integrity, and assign an overall condition
rating (e.g. good, fair; poor or dead).
■ Rate each tree's suitability for preservation (e.g. high, moderate, or low).
■ Identify whether any of the trees are regarded as "protected trees" and "specimen
trees" per City Code.
■ Obtained photographs of each tree; these can be viewed in Exhibit C.
■ Assign nuinbers to each tree in the order encountered during my site visit.
■ Show the assigned tree numbers on a copy of the site map provided for rny review;
see Exhibit B.
■ Identify numbers found engraved on round, aluminum tags affixed to 15 of the
trees' trunks (all but the large valley oak).
■ Present findings as to whether the proposed removals conform to City Code.
■ Consider the species, size and amount of trees required for installation to mitigate
trees to be removed.
■ Prepare a written report containing the aforementioned information, and email it as
a PDF document. �

Sixteen (16) trees of six various species are proposed for removal, and are sequentially
numbered as 1 thru 16. The table below identifies their names, assigned numbers, counts
and percentages.

Snecific information regarding each tree is presented within the table in Exhibit A. The
trees' approximate locations can be viewed on the site map in Exhibit B, and
uhoto�raphs of each tree are presented in Exhibit C.
Based on the site, it is assumed that all trees presented herein were planted or retained as
part of a previously approved and plaiuied developinent. As such, the trees can be
considered regulated and defined as "protected trees" pursuant to Section 14.18.035(C) of
the City Code.
Tree #12, a redwood located at 11637 Cedar Spring Court, is identified on the table
reviewed but not the map; its approximate location is plotted on the map in Exhibit B.

Tree #1 can be described as a massive and ancient valley oak with a 63-inch trunk
diameter, an estimated 110-foot canopy spread, and a roughly estiinated age of 350 plus
years. It is defined as a "specimen tree" pursuant to Appendix B of Ordinance No. 07-
2003. Additionally, due its species, size and age, it seenungly meets the intent and purpose
of Section 14.18.040 of the City Code to potentially qualify as a"heritage tree."
3.0 SUITABILITY FOR TREE PRESERVATION
Each tree has been assigned a "high," "moderate" or "low�' suitability for preservation
rating as a method to cumulatively measure t]Zeir health, structural ultegrity, anticipated life
span, location, size and specie type. Descriptions of these ratings are presented below.
High: Applies to trees #3, 5, 7 and 11 (four in total).
These trees have seemingly stable structures, appear in overall good health, and present a
high potential of contributing long-tenn to the site.
Moderate: Applies to trees #1, 2, 8, 9, 10 and 12 (six in total).
These trees contribute to the site but seemingly at insignificant levels. Their longevity and
contribution is less than those of high suitability, and more frequent care is needed during
their remaining life span.
Low: Applies to trees #4, 6, 13, 14, 15 and 16 (six in total).
These trees are the least suitable for retention due to being predisposed to decline andlor
structural defects that are expected to worsen regardless of tree care measures employed.

4.0 FINDINGS AND OBSERVATIONS
Pursuant to Section 14.18.18 of the City Code (RevieN� and Deter»zination of Application),
one of the following three findings must be established for issuing a tree removal permit:
1. That the tree or trees are irreversibly diseased, are in danger of falling, can cause
potential damage to existing or proposed essential sti-uctures, or interferes with
private on-site utility services and caiulot be controlled or remedied through
reasonable relocation or modification of the structure or utility services.
2. That the location of the trees restricts the economic enj oyment of the property by
severely limiting the use of property in a manner not typically experienced by owners
of sirnilarly zoned and situated properiy, and that the applicant has demonstrated to
the satisfaction of the approval authority that there are no reasonable alternatives to
preserve the tree(s).
3. That the protected tree(s) are a detriment to the subject property and cannot be
adequately supported according to good urban forestry practices due to the
overpla.nting or overcrowding of trees on the subject property.
Based on my review of findings and observations, I offer the following conclusions:
a. Trees #2, 4, 6, 13, 14, 15 and 16 (seven in total) adhere to criteria provided in
finding number one.
b. Trees #1, 3, 5, 7, 8, 11 and 12 (seven in total) do not ineet the findings, and
initigation appears reasonable.
c. Trees #9 and 10 (tvvo in total) also do not seemingly meet the findings, but
further review of whether repair of damaged entry walkways is reasonable could
possibly be considered.

A more detailed description and explanation of how fuldings apply to each tree follow in
this section.
4.1 Tree #1 (valley oak in the park along Silver Spring Court)
This massive oak does not seem to clearly meet any of the three findings, particularly when
considering the following: its size, historic age, healthy appearance, potential future
longevity for many years, and location a��ay from any inunediate or constantly used
targets.
The tree does show signs of having potentially partially uprooted, an event likely occuning
from excessive weight distribution on the side of the lean. This event appears to have
happened nuinerous years ago, and the tree (as trees can do) may be adapting to the shift of
weight by larger a�d more expansive root growth on the side opposite the lean.
Consequently, it potentially has andlor can in the upcoming years become stabilized.
Based on my evaluation and existing conditions beneath the tree, any irninediately concei-n
can likely be reasonably mitigated, such as employing a strategic and selective removal of
large limbs from the canopy's south side (this likely wanants a perniit), and iilstalling a
fence to restrict access within striking distance of the tree. All pruning shall be performed
under the direct supervision of an ISA (International Society of Arboriculture) certified
arborist, in accordance with the most recent ANSI A300 standards, and by a California
state-licensed tree service contractor (D-49 classification).
4.2 Tree #2 (Aleppo pine at 11548 Copper Spring Court)
Finding number one does seem to apply due to the tree's structure and location in striking
distance of the adjacent home. The tree is comprised of two leaders that currently form a

fairly weak attachznent that will continue to present a greater risk of failure during the
tree's remaining lifespan.
4.3 Trees#3. 5, 7. 8. 11 and 12 (coast redwoods at various locations)
These six redwoods do not seetn to clearly meet any of the three findings. Any evident
damage at this time appears confined to surrounding hardscape, and can likely be repaired
by shaving down andlor patching raised edges. I observed no damage to nearby structures,
and am tulaware of any damage to utilities (and if there is datnage, whether it could not be
mitigated).
Coast redwoods have relatively fast growrth rates and large trunks, particularly at their
bases. As such, they are inore ideally planted away from hardscape and foundations to
avoid potential damage. For the six trees mentioned herein, they are not ideally located,
and there is the potential for future, more significant or realized datnage to surrounding
driveways andlor possibly (and to a much lesser degree) home foundations. However,
continued or ulcreased repair work would seemingly provide reasonable correction and not
warrant removal. Also, their location does not, in my experience, differ or severely limit
the use of property in a manner not typically experienced by owners of similar property.
4.4 Trees#9 and 10 (coast redwoods along Cedar Spring Court)
These two redwoods may, but not clearly, meet finding number two. They have roots
appearing to contribute to the lifting of nearby entry walkways. Particularly for tree #10,
they are raised rather significantly, and inore entailed repair work would be needed to
reestablish the walk to grade. Given the distances of the walk to the trees' trunks, root
pruning appears feasible without adversely impacting the trees. Additional work includes
super-reinforcing the new section of walkways, possible reconfiguration, and pouring and

foniung them on-grade without using base materials (and thus, reducing the amount of root
pruning needed).
4.5 Trees#4, 6 and 16 (white birch and two italian alders, respectively}
These trees strongly conform to finding number one. Trees #4 and 16 are dead, and tree #6
is declining and has partially uprooted in the direction of the adjacent residence at 11709
Olive Spring Court. They should be removed immediately.
4.6 Trees#13, 14 and 15 (tulip trees along Bridge Park Court)
These trees meet finding number one. Each has been excessively pruned to unprofessional
standards over the years, and consequently, their structure is prone to large limb and branch
failure during the course of their remaining lifespan. Regarding the reported sap problein,
tulip trees, in general, become severely infested with aphids, and controls to reduce the
aphid population (and thus the amount of sap) include a minunutn aru�ual treatinent
prescribed and employed by a qualified professional.
5.0 TREE REPLACEMENTS
Applying Table A, Section 14.18.185 of the City Code, a total of either eleven trees of 24-
inch box size or nine trees of 24-inch box size and one tree of 36-inch box size would be
installed to mitigate removal of trees #2, 4, 6, 13, 14, 15 and 16.
The specific species and location of each new tree can be evaluated upon request. As a
general rule, I suggest new trees are installed in the same general location of those being
removed to maintain overall consistency with the landscape planting plan approved for the
existing development. Guidelines for helping deternune an appropriate species and

locations include a tree's grow-th rate, size at maturity, growrth habit, suitability for a
parking lot envirorunent, anticipated life span, susceptibility to insects and diseases, root
invasiveness, and proximity to hardscape and buildings.
For trees installed within lawn or planter areas along Cedar Spring Court, a tree species
more appropriate for planting near hardscape could ser��e to substitute installing any
additional coast redwoods (as a means to extend the life expectancy of surrounding
hardscape before repair is needed).
All new trees should be installed, including necessary irrigation, by an experienced state-
licensed landscape contractor or a professional tree company, and perforined to
professional industry standards. They should be double-staked (no cross-brace) with
rubber tree ties or equivalent, and the support stakes cut below the first main lateral branch;
where this is not feasible for a low-branching tree, the stakes should be established in a
manner that avoids damaging the trunlc and branches. All in-igation should be in the form
of a bubbler-type system placed on the surface of the root ball (versus against the trunk or
in a sleeve).
