Subject: Director's Temporary Use Permit, TUP-2011-02, to allow the installation of a
temporary restroom facility in conjunction with tenant improvements in an existing
office building located at 10475 Bandley Drive.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Devcon Construction, is requesting approval of a temporary use permit to install
a temporary restroom facility in the rear parking lot of an existing office building site located at
10475 Bandley Drive to accommodate tenant improvements in the office building. This site has
been undergoing phased tenant improvements to accommodate both the tenant improvements
and continued office use of the building by employees of the tenant, Apple.
The applicant has submitted a plan (See Enclosure) indicating the location of the temporary
restroom facility in the rear parking lot in close proximity to the rear building entrance and with
setbacks of 57.5 feet from the rear (west) property line and 36 feet from the side (north) property
line that are adjacent to residential neighborhoods. The temporary restroom facility will
displace approximately 14 parking spaces,and is essentially a trailer approximately 34 feet wide
and 12 feet deep. The 14 parking spaces are not needed at this time since the office building is
not operating at full capacity. Apple also intends to place a small temporary coffee kiosk next to
the restroom trailer.
A letter (See Enclosure) has been submitted by the applicant indicating that the temporary
restroom facility is needed for a total of three months including the set up and take down time.
The parking spaces will be restored once the temporary restroom facility is removed.
ACTION
The Director of Cornmunity Development approves the temporary use permit with the
following conditions of approval:

1. APPROVED EXHIBITS
Approval is based on the exhibit entitled "Temporary Restrooms for 10475 Bandley Drive,
Page A1.10" prepared by Studio S Architecture dated December 3, 2011, except as may be
amended by the conditions contained in this resolution.
2. DURATION OF TEMPORARY RESTROOM FACILITY
The temporary restroom facility shall be permitted on site in conjunction with the approved
plan for a maximum of three (3) months or 90 days from the date of building permit
issuance of the temporary restroom facility.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective January 19, 2012. The fourteen calendar day
appeal period will expire on February 2,2012.

The temporary restrooms and ramp will be in use a total of three months including a set up time of 1-day and a
take down time of 1-day. A total of 14 parking spaces wili be temporarily out of use during the time the restrooms
are in use. The parking spaces will be restored after the removal of the restrooms.
The attached Plan shows the distance the temporary restroom trailer will be located from the adjacent property
lines.
