Subject: Director's Temporary Use Permit, TUP-2012-01, for the operation of a sales
trailer and a construction trailer in the existing Sears parking lot located at
10101 N. Wolfe Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of a temporary use permit, authorizing the use of a site in any
zoning district for a temporary use. The Director reports the decision to
the City Council & Planning Commission in time to allow an appeal of the
decision within fourteen calendar days of approval.

At this time, the applicant is requesting the installation and temporary operation of two
modular structures, a construction trailer and a sales trailer to be located in the parking
lot as they complete construction.
DISCUSSION
The construction trailer is located along the N. Wolfe Road frontage in a fenced off area
in the parking lot. This is a standard construction trailer for purposes of construction
management.
The sales trailer is proposed to be located along the Stevens Creek Boulevard frontage
of the parking lot, close to the intersection of Stevens Creek Boulevard and N. Wolfe
Road. The 24 foot by 60 foot structure and the surrounding parking lot is being
modified by the applicant to provide the structure a more finished look.
The modifications include:
1. Cloth awning above the entrance to the structure
2. Deck and porch at the front entrance
3. White picket fencing around the sales area
4. Trees in 24" boxes painted to match the fence
5. Temporary striping for parking stalls and vehicular path of travel
The Director of Community Development approves the temporary use permit with the
following conditions of approval:
1. REMOVAL OF TEMPORARY STRUCTURES AND IMPROVEMENTS
The applicant shall remove all temporary structures and associated
improvements within 15 days of expiration of this temporary use permit.
2. BOND FOR PARKING LOT IMPROVEMENTS
A bond for the $110,000 shall be provided prior to issuance of building permits
for the temporary sales trailer and construction trailer. This bond shall be held by
the City of Cupertino until the parking lot improvements are completed in the
previously unimproved pad area in the Sears parking lot.
This temporary use permit shall expire on July 10, 2012. The fourteen calendar day
appeal period will expire on January 24, 2012.
