SUBJECT: TREE REMOVAL PERMIT ACTION LETTER-Application TR-2011-78:
This letter confirms the decision of the Director of Community Development, given on January 9, 2012,
approving a Retroactive Tree Removal Permit for the removal of a hazardous Monterey Pine tree and a Tree
Removal Permit to remove two additional Monterey Pine trees located in the common area of the Glenbrook
Apartments,located at 10275 Parkwood Drive with the following conditions:
1. APPROVED PROTECT
The approval is based on the arborist's report prepared by Michael Bench, entitled, "Inspection of
Monterey Pine Trees at The Glenbrook Apartments," except as may be amended by conditions in this
resolution.
2. TREE REPLACEMENTS
The applicant will be required to plant three (3) Betula jacquemontii trees on the property in accordance
with the Protected Tree Ordinance and the approved replacement plan. The replacements shall be
planted within 30 days of the expiration date of the appeal period.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication requirements,
reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these
Conditions constitute written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval
period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to
Governxnent Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally barred from later challenging
such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of
the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14
calendar days from the date of the mailing of this decision. If this happens,you will be notified of a public
hearing,which will be scheduled before the Planning Commission. If no appeal is made within the appeal
period,the trees may be removed beginning Tuesday,January 24,2012.

Inspection of Monterey Pine Trees at
The Glenbrook Apartments

Assignment
I was asked by Mr. George Schroeder, Planner for the City of Cupertino, to evaluate the request
to remove 2 Monterey pine trees and to review the condition of the Monterey pine trees in
general at this apartment complex.
Observations and Recommendations
On November 29, 2011 I met the maintenance supervisor Mr. Victor Prosak at the site to review
the request to remove the two Monterey pine (Pinus radiata) specimens.
Mr. Prosak showed me that the Putting Green is in the process of renodation. Several large roots
of the two Monterey pine trees had grown into the Putting Green and had created a very rough
surface. These two Monterey pine trees are located adjacent to Building 10, Apartments 3 and 5.
The excavation to renovate the Putting Green will severe the roots of these two Monterey pine
trees possibly making them unstable. This is not an absolute certainty but appears to be a
reasonable possibility. Also, the severing of the large roots will likely cause these two trees to
decline sharpely. As a result of the potential risks to the residents, the adjacent building, and to
the trees themselves, it is a reasonable request to remove these two trees.
Mr. Prosak requested that replacement trees for the two Monterey Pines be located on the west
side of Building # 11. I recommend that the replacement species be the London plane
`Columbia' (Platanus acerifolia `Columbia'). Because the area selected for the replacements is a
turf area, the Southern white oak(Quercus virginiana) would also be an appropriate species for a
turf area.
It was gratifying to converse with Mr. Prosak, who I observed to be quite knowledgable about
trees and how they grow. He was concerned about one Monterey pine tree, which was leaning at
approximately 45 degree angle and located adjacent to Building# 17. It was clear that this
Monterey pine had moved recently and was in the process of up-rooting. I considered this tree an
immediate Hazard and recommended its immediate removal. In this case, I suggest the
replacement be one of the species previously suggested or a 36 inch box Deodar cedar(Cedrus
deodara).
Many of the Monterey pine (Pinus radiata) specimens on site are declining. I saw several near
Buildings # 12 and# 13 that are in Fair to Poor condition. Mr. Prosak stated that the majority of
the landscape trees were planted approximately 40 years ago. It appears that many of these
Monterey pine trees have reached the limits of growth in the small spaces where they have
existed, especially for their root systems. For this reason, many of these Monterey pine trees are
declining slowly.
In my opinion, it is reasonable for management of the Apartment complex to establish a
replacement schedule for the Monterey pine trees, which are in decline. Mr. Prosak is
sufficiently knowledgable about recognizing those specimens which are in sufficient decline to
warrant their replacement. It would be reasonable remove and replace 5-6 Monterey pine trees
every 6 months or similar replacement schedule. I recommend that the replacement schedule be
limited to the declining Monterey pine (P. radiata) species.
