Reso 5040 1-M-99 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 5040 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A MODIFICATION TO AN EXISTING PLANNED RESIDENTIAL DEVELOPMENT TO REMOVE AND REPLACE THREE TREES AT PARK VILLA CIRCLE SECTION I: PROJECT DESCRIPTION Application No.: 1-M-99 Applicant: Samuel Isaac Property Owner: Westmont Park Villa Homeowners Association Location: 8084, 8129, 8130 Park Villa Circle SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application to modify the landscaping of a planned single-family residential cluster development as described in this Resolution; and WHEREAS, the Planning Commission finds that the changes are beneficial in that it will limit damage to private improvements and promote safety while maintaining the landscaped appearance of this residential development. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits,testimony and other evidence submitted in this matter, the landscape modifications described above are hereby approved subject to the conditions which are enumerated in this Resolution; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 1-M-99, as set forth in the Minutes of the Planning Commission Meeting of May 24, 199, and are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. l. APPROVED EXHIBITS Approval is based on Exhibit A titled Westmont Park Villas Tree Location Map and E�iibit B except as may be amended by the conditions in this resolution. i Resolution 5040 1-M-99 May 24, 1999 Page 2 2. TREE REPLACEMENT The mature trees approved for removal shall be replaced by two new 24"box Flowering Cherry trees and one 36"box Hackberry tree.
