Subject: Director's Minor Modification, DIR-2011-37, to a previously approved two-story
permit(R-2011-08) to increase the total height from 25 feet,5 inches to 26 feet,2 inches
at 18825 Tuggle Avenue.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant is requesting a modification of a previously approved Residential Design Review
Permit (R-2011-08) at 18825 Tuggle Avenue to increase the overall height of the house by seven
inches as measured from natural grade. In September 2011, the Director of Community
Development approved a Director's Minor Modification (DIR-2011-31) to reduce the first floor
front setback to 24.5 feet and the second floor front setback to 34 feet.
The height increase is within the 28 foot height limit prescribed by the Single-Family Residential
(R1) Ordinance and does not significantly alter the originally approved house design.
ACTION
The Director of Community Development deems the modifications minor and approves the
proposed changes subject to the attached plan set. All other conditions of Residential Design
Review approval R-2011-08 and Director's Minor Modification approval DIR-2011-37 shall
remain in effect.
This approval of the modification is effective December 14, 2011. Please note that an appeal of
this decision can be made within 14 calendar days. If this happens, a public hearing will be
scheduled before the Planning Commission. The fourteen calendar day appeal period will
expire on January 4,2011.
