Re: Amendment of an approved 3-lot Tentative Parcel Map at 21989 Lindy Lane
At its November 15, 2011 meeting, the Cupertino City Council approved the recommendation from
the Planning Commission.
Conditions for M-2011-06 are as follows:
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT
DEPARTMENT ,
1. APPROVED EXHIBITS
The approval is based on an Exhibit titled "Tentative Map/Lands of Dr. X. Sun/21989
Lindy Lane, Cupertino," by Westfall Engineers, Inc., dated October 2005, and consisting of
one sheet labeled 1 of 1, except as may be amended by the conditions contained in this
resolution.
2. MODIFICATION OF TM-2005-OS DEVELOPMENT CONDITIONS
The following conditions of approval are hereby deleted in their entirety from the City
Council Action Letter dated December 8, 2005 for file no. TM-2005-05:
Condition No. 2 titled: "DEED RESTRICTION ON LOT #1 BUILDING FLOOR AREA";
Condition No. 8 titled: "DEVELOPMENT STANDARDS";
And additional City Council condition: "The property owner agrees to a home no larger than
3000 square feet."
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Govemment Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

4. REMOVAL OF RECORDED RESTRICTNE COVENANTS AND AMENDMENT OF
FINAL PARCEL MAP
In reference to M-2011-06 Condition No. 2 referenced above, the applicant shall process an
amended Final Parcel Map with the Public Works Department. The applicant shall also
submit covenants, for review and approval by the City Attorney, that rescind the previously
recorded covenants related to Condition No. 2 above. The covenants shall be recorded with
the amended Final Parcel Map.
Please review the conditions carefully. If you have any questions regarding the conditions of
approval, Please contact t�e Department of Community Development at 408-777-3308 for
clarification. Failure to incorporate conditions into your plan set will result in delays at the
plan checking stage. If development conditions require tree preservations, do not clear the
site until required tree protection devices are installed.

RECOMMENDING APPROVAL OF A MODIFICATION TO A PREVIOUSLY-APPROVED TENTATIVE
PARCEL MAP (TM-2011-06) TO MAKE IT MORE CONSISTENT WITH THE R1 ZONING
STANDARDS AT 21989 LINDY LANE

SECTION II: FINDINGS FOR MODIFICATION
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
Modification of a Tentative Map as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Planning Commission has held one or more public hearings on this
matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and Cupertino Zoning Ordinance and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Modification of the Tentative Parcel Map approval is hereby recommended for
approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof;
and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application No. M-2011-06, as set forth in the
Minutes of the Planning Commission Meeting of October 11, 2011, and are incorporated by reference
though fully set forth herein.
