SUBJECT: TREE REMOVAL PERMIT ACTION LETTER — Application TR-2011-44:
This letter confirms the decision of the Director of Community Development, given on November 17,
2011, approving a tree removal permit to remove one (1) 70.5 inch circumference Valley Oak tree in the
rear yard patio of property located at 10116 Lamplighter Square with the following conditions:
l. APPROVED PROTECT
The approval is based on the justification statement and arborist report with site plan prepared by
Joel Smith, ISA Certified ArUorist WE-8889A on July 12, 2011, except as may be amended by
conditions in this approval.
2. TREE REPLACEMENTS
The applicant shall be required to plant one (1) 36-inch box Shumard Oak tree on the De Anza
Oaks Home Owners Association property in accordance with the tree replacement plan dated
November 9, 2011 (See attached tree replacement plan) submitted by the applicant and the City's
Protected Trees Ordinance, and with the approval of the De Anza Oaks Home Owners
Association (See attached letter from the De Anza Oaks Home Owners Association). The
required replacement tree shall be planted within 60 days of the effective approval date of this
tree removal permit.
3. PROTECTED TREE COVENANT
The applicant shall be required to record a covenant recording the replacement tree as a protected
tree within 3U days of planting the replacement tree in accordance with the City's Protected Trees
Ordinance. Failure to do so may result in code enforcement and/or administrative citations.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of
Section 66020, you �vill be legally Uarred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance �vith Section
14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can
be made within 14 calendar days from the date of the mailing of this decision. If this happens, you
will be notified of a public hearing, which will be scheduled before the Planning Commission and
the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made
within the appeal period, the tree(s) may be removed after Thursday, December 1, 2011. �

Regarding 10116 Lamplighter Square — Tree Removal Justification Statement
Tree: Quercus lobata (Valley Oak)
Size: 70.5 inch circumference at 4.5 feet above grade. Approximately 50 feet tall with a
40 foot spread.
The Valley Oak (Quercus lobata) in the back yard of 10116 Lamplighter Square has
outgrown the space provided for it and is conflicting with the surrounding structures.
The root flare is at the edge of the concrete patio which is about 9 feet from the house.
There is only about 3 feet between the patio and the back fence. The tree has lifted the
concrete patio, lifted part of the fence, and is beginning to lift the floor in the kitchen.
Due to the patio lifting, water no drain towards the house and is causing water damage
inside the home.
Due to the current and potential future damage to the structures, pennission is requested
for the removal of this tree.

The De Anza Oaks Board of Directors has been ir�formed of the necessity
of removing a mature Valley Oak (Quercus Lobata) from the private
property at 10116 Lamplighter Square, Cupertino, California, a property
within the De Anza Daks communiry.
Understanding that the homeowner's property is not large enough to plant
a qualifying replacement, as required by City Code, the De Anza Oaks
Board of Directors approves the planting of a qualifying replacement tree
in De Anza Oaks Common Property, adjacent to the home at 22968
Cricket Hill.
The De Anza Oaks community is happy to cooperate in this matter in the
interest of building mutual respect and cooperation in future endeavors.
