APPROVED PROTECT The approval is based on the City Arborist's report prepared by David Babby, of Arbor Resources, entitled "An Arborist Review of the Proposed Five Tree Removals at 10440 Bubb Road, Cupertino, Califomia," dated August 25, 2011 and the arborist report prepared by David Muffly of Apple, dated May 5, 2011 for the removal of three (3) European Birch trees and two (2) Evergreen Pear trees, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENT The applicant shall be required to plant seven (7) 36-inch Uox size London Plane trees as the required replacement trees in the landscape planter area located on the adjacent office complex property at 10460 Bubb Road, as shown on the tree replacement plan in the arborist report submitted by David Muffly of Apple, dated May 5, 2011. The required replacement trees shall be planted within 60 days of the effective approval date of this tree removal. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled be€ore the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. T�ieir proposed desig requires the removal of five existing trees, and I have been retained by tlie Cupertino Community Developinent Department to review their proposal and perform the following specific ta.sks: ■ Revie��v the applicant's report, dated May 5, 2011. ■ Perform a site visit on August 17, 2011. ■ Identify each tree proposed for removal. ■ Determine each tree's trunk diameter at 54 inches above grade or where appropriate to best represent trunk size; diameters are rounded to the nearest inch. ■ Estimate eacli tree's canopy spread. ■ Ascertain each tree's health and structural integrity, and assign an overall condition rating (e.g. good, fair or poor). ■ Rate each tree's suitability for preservation rating (e.g. high, moderate, or low). ■ Specify whetlier any of the trees are regarded as "protected trees" and "specimen trees" per City Code. ■ Assign numbers similar to what is shown in the applicant's report. ■ Show the nuinbers on an aerial photograph presented in Exl�ibit B(derived from Google Earth). ■ Obtain photographs of each tree; these can be viewed in Exhibit C. ■ Present findings as to whether the proposed removals conform to City Code. ■ Review the species, size, ainount and location of trees proposed for installation. ■ Prepare a written report containing the aforementioned information. 10400 Bubb Road, Cuperti��o Page 1 of 4 Cit} of Cu�erti��o Commu��ity Development De�a�•tment .� David L. Babby, Registered Consulti��g Arborist� August 25, 2011 2.0 OBSERVATIDNS AND FINDINGS The trees inventoried for this report, and discussed in the applicant's report, include tliree European white birch and four evergreen pears. For identification purposes, the birch are assigned #B1 thru B3, and the pears #P1 thru P5 (except for P5, these correlate to what is shown on the applicant's report, but abbreviates the tree name; e.g. "Birch 1" is "B 1" in this report). Trees #B1 thru B3 are situated at the northwest corner of the building, #P1 thru P4 are at tlie building's front entrance, and #P5 (not shown in tlie applicant's report) is situated in a finger island near the southwest corner of the buildin�. Note that tree #PS is not identified in the applicant's report, and I include it due to its adjacent proximity to the proposed ADA improvements. Based on the site, it is assumed that all trees presented herein were planted or retained as part of a previously approved and planned development. As such, they can be considered regulated and defined as "protected trees" pursuant to Section 14.18.035(C) of the City Code. None of the trees are defuled as "specimen trees" per Appendix B of Ordinance No. 07- 2003. Each of tlie ulventoried trees can be regarded as relatively small and insignificant ornamental trees, and I assign each a low or moderate suitability for preservation. Of the eight inventoried trees, the following five are proposed for removal: #B1, B2, B3, P1 and P2. Based on their species, small size, and/or condition, and find their removal conforms to Section 14.18.180 of the Town Code. 3.0 TREE REPLACEMENTS Applying Section 14.18.185 of the City Code, installing a minimum ainount and size of five trees of 24-inch box size on the subject site is necessary to mitigate the removal of trees #B1, B2, B3, Pl and P2. The applicant's report proposes the installation of seven trees of 36-inch box size. As such, their proposal conforms and exceeds provisions set forth within Section 14.18.185 of the Code. The species proposed for installation is a Columbia London planetree within large planter islands, currently vacant of trees, on the adjacent western property of 10460 Bubb Road. In my opinion, the species is an appropriate selection given the site and existing trees being removed. Regarding their proposed location, the islands appear to be optimal planting areas within the immediate vicinity of the removals. However, Section 14.18.185 of the City Code provisions for the trees to be planted on the subject property, and as such, installing them on the adjacent property, although ideal, may conflict with City Code. 10400 Bubb Road, Cuperti��o Page 3 of 4 Cit�� of Cupertino Commu��it�� Development Departme»t Dm�id L. Babby, Registered Co�zsulting Arborist August ZS, Z011 I do identify a few seemingly viable locations for trees to be installed ��vithin a planter along McClellan Road, near the northeast coruer of the property; see page C-4 of Exhibit C for these locations. All new trees should be installed, including necessary irrigation, by an experienced state- licensed landscape contractor and/or a professiotlal tree company, and perfornled to professional industry standards. They should be double-staked (no cross-brace) with rubber tree ties or equivalent, and the support stakes cut below the first main lateral branch; where this is not feasible for a low-brancliing tree, the stakes should be established in a manner that avoids damaging the trunk and branches. First are the three European White Birches (Betula pendula) located at the left front of the building (viewed when facing building). These trees are in fair to poor condition. They are also no longer professionally acceptable to plant in such dry and difficult locations. I recommend removal of these trees. The second set of trees impacted is a set of four Evergreen Pears (Pyrus kawakamii) at the front of the building. Two of the four pears need to be removed to make room for sidewalk ADA required improvements. The tree is in fair condition. It is a low value species, and removal is recommended. Birch 2 has a dbh of 11 inches and is in fair condition. Again, removal is recommended. Finally, Birch 3 has a dbh of 5 inches, is in fair condition, and is recommended for removal. Moving to the front of the building, there are parking lot changes planned, in addition to the proposed sidewalk. The island in which the Evergreen Pears are planted will also be enlarged. The primary tree issue in this area is that the two Evergreen Pears nearest the building will need to be removed to make room for the proposed sidewalk. On Figures 4& 5, these two pears are called out as Pear 1 and Pear 2. Pear 3 and Pear 4 are to be retained. Pear 1 has a dbh of 9 inches, and Pear 2 a dbh of 11 inches. Both are in fair to good condition. This species has no legal protection, and is considered a relatively low value species. I recommend removal of Pear 1 and Pear 2. Pear 3 has a dbh of 7 inches, and Pear 4 a dbh of 7 inches. Both are in fair to good condition. I recommend these trees be retained, and given full protection during construction, in addition to construction design measures purposely chosen to minimize impacts on the two pears to be retained. The new curbs surrounding these two trees will be an extruded type that glues directly on top of the pavement layer. The shape of 'Columbia' is nearly ideal from both an arborists and designers perspective - it generally grows with a continuous central leader, which is great for strength, and also gives the tree a very uniform, pyramidal shape when young. 'Columbia' has become the cultivar of choice for the Bay Area, containing a great deal of the genetics of the Eurasian Sycamore native to the Mediterranean, matching our own climate. Interestingly, 'Columbia' performs much better than native California sycamore in the Bay Area. 'Columbia' also performs better than two other cultivars which have been tried locally in recent decades, 'Bloodgood' and 'Yarwood', which are proving to be disease and structure disasters. Wood chip mulch: Apple arborist shall determine locations and depth of natural wood chip material to be applied over open soil root zone around retained Pears. 2. Supplemental Irrigation: Apple arborist shall determine volume, timing, and method of water delivery, if any, necessary to prevent desiccation to the root zone. 3. Tree fencing & Signage: A chain link tree protection zone (TPZ) shall be established around each retained Pear at the edge of the current soil area. Chain link shall be minimum of 5 feet high, mounted on 2 inch diameter iron tube posts 8 feet long, driven 24 inches into the ground. Maximum spacing of posts shall be 6 feet on center (O.C.). Affix Tree Protection Fence signage on the chain link. These signs must be waterproofed, minimum 8X11 size, and affixed two sides of the fenced TPZ area.approximately once every 15-linear feet of TPZ fenced distance. The sign must state: "Warning: tree protection zone. This fence shall not be removed and is subject to penalty." 4. Excavation: Excavation will be minimized to the greatest extent possible within the potential root zone of the retained Pears. 5. Verification of tree protection: The Apple arborist shall verify all tree protection measures prior to demolition.
