De Anza Blvd with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by Neil Woolner (Certified Arborist WC- 2329A), dated September 14, 2011, consisting of 4 pages and entitled: Arborist Letter for One (1) � Dead Alder Tree at 10500 De Anza Blvd., except as may be amended by conditions in this resolution. 2. TREE REPLACEMENT The applicant shall plant two (2) 24-inch box trees of a similar species on the property in accordance with the City's Protected Tree Ordinance. The required replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit for the dead tree in accordance with Section 14.18.140B (Exemptions) of the Protected Trees Ordinance. One (1) protected (16 inches DBH or greater) tree was identified as dead. See Figure 1 for the relative location of the tree on the De Anza 3 property. The tree has been removed. The tree described below was dead, severely leaning towards the vehicular parking area, and presented a hazard risk to the surrounding community. The dead alder was located in a planting area adjacent to a vehicle parking lot on the southwestern end of the De Anza 3 building. See Figure 2 for an image of the subject tree. Because of the trees condition, we determined that the tree was a failure hazard. Damage to persons or property was likely to occur in the event of failure. Because of the high volume of pedestrian/vehicular traffic and proximity to nearby structures, failure of the tree was of major concern. For the aforementioned reasons we removed the tree and we request the City of Cupertino to approve of the removal and grant a permit for the tree's removal. Per the City of Cupertino's Protected Tree Ordinance, two (2) 24 inch box trees are required to be replanted if the trunk size of the tree is over 12 inches in diameter. For the removal, we request to replant two (2) 24 inch box trees of an alder species located in the same growing location, spaced to provide adequate growing room for maturity.
