Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant is requesting a modification of a previously approved Use Permit (2-U-72) to convert approximately 280 square feet of existing attic space to closet space and the associated minor exterior modifications to an existing single-family townhome at the Northpoint HOA. In accordance with the Zoning Ordinance, any minor changes to a previously approved Use Permit must be approved with a Director's Minor Modification. The converted attic space is not considered a habitable bedroom space per the Zoning Ordinance (Chapter 19.08) given the fact that the ceiling height is limited to 6-feet, 1-inches. A condition has been included as part of this approval requiring the owner to record a covenant restricting the use of the area to an attic closet space only. The project also proposes the addition of four (4) skylights, two (2) sun tunnels, and one exterior fixed window in the converted attic space. Staff supports the proposed modifications because they conform to the previously approved Use Permit (see Attachment 1) and that the modifications are contained within the existing footprint of the residence. In addition, the Northpoint Homeowners Association approved the proposed modifications on August 17, 2011 (see Attachment 2). ACTION The Director of Community Development deems the modification minor and approves the addition with the following conditions of approval: DIR-2011-27 20277 Northbrook Square Page 2 1. APPROVED EXHIBITS Approval is based on exhibits titled: "Suman Sundaresh, 20277 Northbrook Sq, Cupertino, CA 95014;' prepared by Richard Haro Drafting and Planning, Inc., dated July 5, 2011 and consisting of six (6) sheets labeled 1, 2, 3, 4, D1, and SD1; except as may be amended by the conditions contained in this resolution. 2. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 3. ATTIC CONVERSION COVENANT The owner shall record a covenant that states that the converted attic shall not be used as a bedroom, and that no plumbing facilities shall be added to the area. The precise language will be subject to approval by the Director of Community Development. Proof of recordation must be submitted to the Community Development Department prior to final occupancy of the residence. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective September 9, 2011. The fourteen calendar day appeal period will expire on September 23, 2010. The parking of recreational vehicles such as boats, trailers, etc. shall be prohibited throughout the entire development unless said parking is within a fenced and landscaped area. Vehicular curb parking along the private street shall be . prohibited except in designated areas. Appropriate "No Parking" , signs shall be installed by the applicant. 23 The owner of the development wi11 be required to participate in the initiation of a City ordinance to make the private street subject to the Vehicle Code, under the provisions of Section 21107.7 of said Code; provisions of said ordinance subject to approval of the enforcing agency. 24 Removal of any trees on the site shall be sub�ect to approval of the Architectural and Site Approval Committee. 25 Improve�ents of the common areas shall be completed by the developer and shall be subject to bonding and other procedures in the same manner as required for street improvements by the Subdivision Ordi- nance. The common areas shall be deeded to an association of the homeowners for whose benefit the common areas are set aside; deve- lopment rights, as defined in Section 16.13 of Ordinance No. 220(e), shall in this case be dedicated to the City. 26 The common areas shall contain no other buildings or structures than those accessory to recreational purpases. Any changes of this status shall be subject to the approval of the Planning Commission and the City Council. 27 Maintenance of the common areas shall be the responsibility of the homeowners association to which the common areas are deeded. In the event the private road, driveways, parking areas, walkways, landscaping or buildings are not maintained to applicable City standards, the City may, after notice and public hearing as set forth in Ordinance 002(a) Section 5.3, effect the necessary main- tenance, with the cost therefor to be a lien on the property in the same manner as set forth in the Weed Abatement Ordinance of the City of Cupertino. 28 To assure that the open space shall be available for the entire development, the development rights to the common areas shall be dedicated to the City of Cupertino in advance of the issuance of any building permits. - -3- �Resolution No. 928 17-Z-71 --------------------------------------------------------------------------- .
