APPROVED PROJECT This approval is based on the plans submitted by the applicant dated August 29, 2011, including the layout and tree removal plans (sheets L1.0 and L1.1), irrigation hydrozone plans (sheets L2.0 and L2.1), irrigation plans (sheets L2.2 and L2.3), planting plans (sheets L3.0 and L3.1), landscape construction details (sheets L4.0 and L4.1), and landscape specifications (sheet L5.0); the applicant's justification statement dated July 5, 2011; and arborist report entitled "A review of Tree Removals Proposed for Landscape and Parking Lot Renovations at the following three Apple, Inc. sites: 20605 Valley Green Drive, 20400 Mariani Avenue, and 10500 N. De Anza Boulevard" prepared by David L. Babby, City Arborist, of Arbor Resources on March 15, 2011, except as may be amended by conditions in this approval. 2. TREE REPLACEMENTS The applicant shall be required to plant forty-six (46) 36" inch box trees, consisting of 25 Coast Live Oak (standard form) trees, 16 Valley Oak (standard form) trees, three (3) New Zealand Christmas trees and two (2) Chinese Pistache trees on the subject property in accordance with the approved planting plans (sheets L3.0 and L3.1) and the City's Protected Trees Ordinance. The required replacement trees shall be planted within 60 days of the effective approval date of this tree removal permit. 3. DIRECTOR'S MINOR MODIFICATION No trees shall be removed in conjunction with this tree removal permit without the concurrent and effective approval of the Director's Minor Modification (DIR-2011-15) for the modification to the parking lot and landscape planters on the subject property. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest witivn this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff received comments and concerns from two members of the community. One comment and concern was raised by an adjacent residential property owner who asked if the applicant could mitigate problems associated with pine needle droppings of three Canary Island Pine trees located at southeast corner of the property. Although the pine trees are not part of the tree removal request, the applicant responded that they would prune the canopy of the trees to the fence in a healthy manner to mitigate the pine needle problems on the neighbor's property. The adjacent neighbor expressed satisfaction with this resolution. Another member of the community indicated that he wanted to object to the tree removals, unless it was determined that the trees have already caused visible physical damage. Staff communicated to this person that the City Arborist had reviewed these trees and had determined that all of the proposed trees to be removed have already caused visible physical, including extensive damage to the hardscape adjacent to curbs and parking lot area. Staff also conveyed that the City Arborist supported the removal of these trees since they have poor/week structures due to having been severely reduced in height, are highly prone to failure and cause further damage to the hardscape, are declining in health and are in overall poor condition. Therefore, staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be removed after Thursday, September 16, 2011 and if the associated Director's Minor Modification approval (DIR-2011-15) is effective. As part of the parking lot repairs, Apple would like to upgrade the parking lot landscape areas. This landscape upgrade would need to be done Uefore the parking lot work because some trees are lifting curbs and asphalt, soine are in poor condition and some are not good choices for a parking lot condition. The existing parking lots have conditions where existing trees are lifting aud breaking the existing curbs and asphalt. We are concerned that if repairs are made now and the root problem not corrected; that the damage will occur again. The existing site had inany locations where the asphalt is a tripping hazard due to the lifting by tree roots. There are also many locations where the curbs have been pushed so high that damage to cars is possible. Proposed Landscape Design Modifications The parking lot repairs aud landscape work is intended to do the following: 1. Repair broken and raised curbs and broken and raised asphalt 2. Repair damage asphalt patches, slurry seal and restripe to same layout 3. Remove existing �roblem trees with root problems or health problems 4. Plant new parking lot trees to create a cohesive design and remove future problem conditions (New trees will be a minimum of 36" box size). 5. Add a new irrigation system for the new planting that will ineet current landscape requireinents in the City 6. Phase the tree improvements to lesseu the visual impact. 7. No parking lot counts will change; this is only a parking maintenance phase. 8. Larger treewells, than exist, are being added to assure the success and faster grovvth of the new trees. Babby, Registered Consulting Arborist March 1 S, 2011 1.0 INTRODUCTION I have been retained by the City of Cupertino to review and prepare this report in connection with tree removals proposed for landscape and parking lot renovations at the following three Apple Inc. sites: ■ 20605 Valley Green Drive ■ 20400 Mariani Avenue ■ 10500 N. De Anza Boulevard Specific tasks performed for my review are as follows: ■ Review three sets of proposed plans, one per site, prepared by Reed Associates Landscape Architecture, dated 9/30/10. ■ Conduct site visits on 3/7/11 and 3/14/11 to observe and perform a cursory or detailed evaluation of each tree proposed for removal. ■ Observe the parking lot and ground conditions surrounding each tree. ■ Rate each tree's suitability for preservation (e.g. high, moderate or low). ■ When observed on the subject sites, identify additional trees that should be scheduled for removal due to having a weak and very poor structure. ■ Identify opportunities to improve existing trees immediately surrounding the proposed renovation areas. ■ Provide measures to mitigate the removal of trees. ■ Review the size and amount of trees proposed for installation to initigate those to be removed (pursuant to Table 3-1, Section 14.18.185 of the Code). ■ Offer comments or suggestions on new trees proposed for installation. ■ Utilize numbers (and trunk diameters) that are assigned to trees as shown on the project plans and on round metal tags affixed (by other) to inost all tree trunks. ■ Obtain photographs; they can be viewed in Exhibits A, B and C. ■ Prepare a written report containing the aforementioned information; this report has been submitted as a PDF document via email. 20605 Valley Green D�•ive, Z0400 Mariani Anenue, 10500 N. As such, the trees can be considered "protected trees" pursuant to Section 14.18.035(C) of the City Code. 2.1 20605 Valley Green Drive Twenty-one (21) trees of five various species are proposed for removal from this site (they represent 77-percent of the tota127 trees at the site). Babby, Registered Consulting Arborist Mm•ch 1 S, 2011 As illustrated in the table, the site is populated predominantly by eucalyptus trees situated along the north and west perimeters. Overall, they have declining canopies and poor structures, and many have caused substantial hardscape damage to the adjacent curbs and parking lot. 2.2 20400 Mariani Avenue Forty-five (45) trees of three various species are proposed for removal from this site (they represent 35-percent of the total 125 trees at the site). Four of them, coast live oaks, are considered native to the area, but resemble shrubs as they are very short (four to six feet tall) and inulti-trunk. All other trees can be regarded as omamentals and not native to the area. Photographs of each tree are provided in Exhibit B, and their locations and assigned numbers are presented on Sheets L1.0 and L1.1 for this site. As illustrated in the table, the proposed removals consist predominantly of eucalyptus trees, all of which have poor and weak structures due to having been severely reduced in 20605 Valley Green Drive, 20400 Alariani Avenue, 10500 N. Babby, Registered Consulting Arborist� March 1 S, 1011 height (or "topped"), and the current and future ensuing growth is highly prone to failure throughout the trees' remaining lifespan. They are also causing extensive and substantial hardscape damage to the adjacent curbs and parking lot. The hackberrys, next most frequently occurring tree, are declining and in overall poor condition. The four oaks can be considered small shrubs, and barely or not qualifying as a tree yet. An additional eucalyptus, tree #425 (22-inch trunk diameter), should also be scheduled for removal (Sheet L1.0 indicates its retention). It has been "topped" and is prone to large limb or branch failure; a photo is presented in Exhibit B. Immediately surrounding the project area along Mariani Avenue, I observed three coast redwoods that show symptoms of significant decline and stress due to what appear to be from insufficient watering of the root zones; they include #308, 310 and 311. To help improve their condition, I recommend irrigation (such as bubblers) is installed, but setback about eight feet from the neighboring two coast live oaks (#307 and 309). Additional recommendations regarding this are presented in Section 4.2 of this report. 2.3 10500 N. De Anza Boulevard One-bundred sixty-two (162) trees of eight various species are proposed for removal from this site (they represent 44-percent of the total 367 trees at the site). As illustrated in the table, the proposed removals consist predominantly by carob and Raywood ash trees. The carobs have caused extensive damage to the surrounding planters and parking lot, and many have serious structural defects and are declining (in numerous instances, they are either dead or nearly dead). Babby, Registered Consultirag Arborist March 1 S, 2011 I observed the following additional nine trees that immediately surround the proposed project area and should be scheduled for removal due to the high to severe risk they present to persons and property below (photographs are provided in Exhibit C): a. Tree #453: This is an Italian alder (18-inch tnu�lc diameter) situated at the building's southwest corner. It leans (less but near 45-degrees) significantly away from the building throughout most of its entire length (in an effort to capture sunlight), then grows vertically for a short section at the top. It also has a pronounced, large root mass that has surfaced opposite the lean, likely in response to support the tree's significant lean, but also potentially from the tree having partially uprooted in the past. I also observed indication of the tree being infested with alder borer, an insect that can weaken the tree and promote its decline and demise. b. Tree #577: This is another eucalyptus (19-inch trunk diameter) that has been "topped" along with those at the Mariani site. Consequently, it is prone to large limb or branch failure. c. Tree #578: This is another Italian alder (11-inch trunk diameter) with a substantial but somewhat less lean than #453. However its entire length or plane leans (away from the parking lot), and there are large root mass that has surfaced opposite the lean, seemingly due to the tree having partially uprooted in the past. d. Trees #602, 607, 609 and 610: These are coast redwoods of varying sizes that are dead or nearly dead (their respective trunk diameters are 12, 1 l, 16 and 5 inches). e. Tree #604: This is a small Raywood ash (eight-inch trunk diameter) with dieback and is growing beneath and into the dominant, healthier tree #605. f. Tree #630: This is another small ash (tlu trunk diameter) with over half of its canopy dead. 20605 Valley Green Drrve, 20400 Marim7i Avenue, 10500 N. Babby, Registered Consulting A� Marcl� 1 S, 2011 3.0 SUITABILITY FOR TREE PRESERVATION Each tree has been assigned a"high," "moderate" or "low" suitability for preservation rating as a method for cumulatively measuring and considering their physiological health, structural integrity, location, size and species. A description of these ratings followed by the assigned tree numbers, per site, is as follows: Hi�h: They have a high potential of providing long-term contribution the site, appear in good health, and contain seemingly stable structures. ■ This rating is assigned to no trees at any of the three sites. Moderate: They contribute to the site but not at seemingly significant levels. Their longevity and contribution is less than those of high suitability, and more frequent care is needed during their remaining life span. ■ 20605 Valley Green Drive (eight trees): #306, 308-310, 312 and 315-317. ■ 20400 Mariani Avenue (seven trees): #313, 314, 316, 327, 352, 354 and 355. ■ 10500 N. De Anza Boulevard (45 trees): #331, 332, 334, 335, 346, 351, 354, 360, 362, 380, 389, 390, 392, 393, 455, 457, 459, 464, 467, 473, 475, 501-505, 512-515, 537, 539, 540, 545, 549-552, 555, 560, 563, 568, 570, 572 and 575. Low: These trees are predisposed to irreparable health problems and/or structural defects that are expected to worsen regardless of ineasures employed. ■ 20605 Valley Green Drive (13 trees): #305, 307, 311, 313, 314, 318 and 320-326. ■ 20400 Mariani Avenue (38 trees): #312, 315, 317-326, 328-330, 334-351, 353 and 356-359. . ■ 10500 N. Babby, Registered Consulti�sg Ar�borist� Marcla 1 S, 2011 4.0 REVIEW OF PROPOSED REMOVALS 4.1 20605 Valley Green Drive The design proposes removing 21 trees and installing 37 new trees of 36-inch box size. Based on the overall low quality of the existing tree landscape, and current and imminent future damage of hardscape, it is my opinion that removal of 19 trees and proposed installation amounts and sizes will provide a much improved and superior tree landscape, and is a reasonable and prudent management approach that conforms to Section 14.18.180 of the Town Code. It is also my opinion that mitigation should include incorporating the following recommendations into the design: a. Trees #308 and 309 should be retained versus removed. Although these trees are not in ideal condition and have been overpruned in the past, they are established, appear viable and stable, and there appears to be no substantial benefit by their removal (they would be removed for the purpose of installing a new tree in their location). In doing so, two less 36-inch box replacements would be installed, and the concrete pavers proposed at the tree's location would be omitted and substituted with mulch. b. The proposed concrete pavers along the west boundary could inhibit lateral root growth within the continuous planter strip. If installed, I suggest an engineered structural soil inix named CU-Structural Soil, is used for the base material (within ten feet from the trunk) to allow compaction while enabling root growth and extending the tree's life expectancy and that of surrounding hardscape. Another option is for the pavers to be established at least ten feet from the trees' trunlcs. c. Babby, Registered Co�zsulti�zg A�•borist R March 1 S, 2011 4.2 20400 Mariani Avenue The current design proposes removing 45 trees and installing 46 new trees of 36-inch box size. I recommend tree #425 is added to the removal count, thus making the total 46 removals. Based on what I would consider a very poor and potentially unsafe tree landscape, combined with the significant current and imminent future damage of hardscape surrounding the trees, it is my opinion that removal of the 46 trees will enable a much safer, improved and superior tree landscape. It is also my opinion that removal coinbined with the proposed replacement amounts and sizes and is a reasonable and prudent management approach, conforms to Section 14.18.180 of the Town Code, and should incorporate the following recommendations into the design: a. Extend irrigation layout to include redwoods #308, 310 and 311. I suggest bubblers are utilized and setback by about eight feet from the neighboring two coast live oaks (#307 and 309), the lines routed in a radial direction to the trees' trunlcs and terminate five or more feet away, the trenches are relatively shallow and manually dug where beneath the trees' canopies, and water is supplied every two weeks at rates and amounts that provide deep-soaking 24 to 36 inches deep. b. The proposed A��butus `Marina' should be a standard form versus multi-trunk (as with any proposed trees). c. A 36-inch box tree to replace #425 should also be added to the planting design. 4.3 10500 N. De Anza Boulevard The current design proposes removing 162 trees and installing 116 new trees of 36-inch box size. It is also my opinion that the proposed removals combined with the amount and size of replacements is a reasonable and prudent management approach, conforms to Section 14.18.180 of the Town Code, and should incorporate the following recommendations into the design: a. The planter containing the meter in the front parking lot (east side near the building) should contain landscaping and new trees (contains trees #391-394). b. Trees to replace the nine additional trees I recommend for removal should be added to the planting design (24-inch box size would seemingly be appropriate). c. There appears to be adequate space to install coast live oaks within the three larger planter islands aligning the rear, southern perimeter (but inside) of the parking lot. I suggest that they be considered, and drought-tolerant landscaping beneath their canopies is considered. d. The proposed Arbutus `Marina' should be a standard form versus multi-trunk (as with any proposed trees). 5.0 TREE REPLACEMENTS Based on the proposed root ball sizes and amouut of new trees, I recommend they are selected and tagged at the nursery by an ISA certified arborist and/or landscape architect prior to being shipped to the site. Those installed should have relatively symmetrical structures mostly free of obvious defects, wounds and girdling roots.
