Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant is requesting approval to conduct site modifications to a parking lot and landscaped planters associated with the proposed repair of the parking lot and a tree removal application (TR-2011-27� to remove trees that have caused damage to the parking lot. The following is a list of the site improvements requested: • Repair broken and raised curbs and asphalt • Repair damaged asphalt patches, and conduct slurry seal and parking lot striping (to the same layout as existing) • Remove existing problem trees with root problems or health problems • Plant new parking lot trees to create a cohesive design and remove future problem conditions (replacement trees to be minimum 36" box trees in accordance with tree removal application TR-2011-2� • Add new irrigation system for the new planting to meet current City Landscape Ordinance requirements • Phase tree removals to lessen the visual impact • Maintain the existing parking lot layout (no parking spaces will be removed in conjunction with this application) G: \ Planning\ PDREPORT\ DIRreports\ 2011 \ DIR-2011-17. doc DIR-2011-17 20605 Valley Green Dr Page 2 • Add larger tree wells to ensure the success and health of the new trees to be planted • Conform to the City Arborist's report dated March 15, 2011 for the proposed tree removal and in accordance with TR-2011-27 • Conform to the City's Landscape Ordinance requirements ACTION The Director of Community Development deems the modification minor and approves the site improvements to the parking lot and landscaping planters subject to the attached plan set (Attachment 1), the applicant's justification statement (Attachment 2) and the following conditions of approval: 1. No trees shall be removed on the subject property until the tree removal permit, TR-2011-27, is effective. 2. Prior to building permit issuance, please omit Note #1 under "Plant Notes" on the Planting Plan (Sheet L3.0). All quantities of trees and planting shall be accurately accounted for on landscape plan sets. 3. Prior to building permit issuance, please omit the concrete pavers near tree number 308 and substitute with mulch on Sheet L1.0 per the arborist report. 4. Prior to building permit issuance, please make a note on the site plan (Sheet L1.0) that structural soil mix will be used in conjunction with concrete pavers to ensure tree longevity as noted in the arborist report. The alternative would be to relocate the pavers at least 10'away from tree trunks. 5. A landscape installation audit shall be conducted by a certified landscape professional after the landscaping and irrigation system have been installed. The findings of the assessment shall be consolidated into a Landscape Installation Report, and shall include at the minimum, the following: a. Inspection to confirm landscaping and irrigation system are installed as specified in the landscape and irrigation system plan b. System tune-up c. System test with distribution uniformity d. Reported overspray or run off e. Preparation of irrigation schedule 6. Landscape Maintenance Agreement: a. Prior to final inspections and final occupancy, the owner(s) of the property shall enter into a formal written Landscape Maintenance Agreement with the City. The City shall record this agreement, against the property or properties involved, with the County of Santa Clara Recorder's Office and it shall be binding on all subsequent owners of land served by the proposed landscape. The landscape maintenance agreement requires that the installed landscape not be modified and that maintenance activities not alter the level of water efficiency of the landscape from its original design, unless approved by the City prior to the commencement of the proposed modification or maintenance activity This approval of the modification is effective September 2, 2011. The fourteen calendar day appeal period will expire on September 16, 2011. As part of the parking lot repairs, Apple would like to upgrade the parking lot landscape areas. This landscape upgrade would need to be done before the parking lot work because some trees are lifting curbs and asphalt, soine are in poor condition and some are not good choices for a parking lot conditiou. The existing parking lots have conditions where existing trees are lifting and breaking the existing curbs and asphalt. We are concerned that if repairs are made now and the root problem not corrected; that the damage will occur again. The existing site had inany locations where the asphalt is a tripping hazard due to the lifting by tree roots. There are also mauy locations where the curbs have been �uslied so high that dainage to cars is possible. Proposed Landscape Design Modifications The parking lot repairs and laudscape work is intended to do the following: 1. Repair broken and raised curbs and broken and raised asphalt 2. Repair dainage asphalt patches, slurry seal and restripe to same layout 3. Remove existing proUlem trees with root probleins or health �roblems 4. Plant new parking lot trees to create a cohesive design and remove future problem conditions (New trees will be a minimum of 36" box size). 5.
