CC Resolution No. 11-137 Abandoned Vehicle Abatement Service Authority for Another 10-Year Term Beginning May 1, 2012 RESOLUTION NO. 11 -137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING CONTINUED PARTICIPATION IN THE SANTA CLARA COUNTY ABANDONED VEHICLE ABATEMENT SERVICE AUTHORITY FOR ANOTHER 10 -YEAR TERM BEGINNING MAY 1, 2012 WHEREAS, the California Vehicle Code authorizes the establishment of a service authority for the abatement of abandoned vehicles in Santa Clara County and the imposition of a one dollar ($1.00) vehicle registration fee, if the Board of Supervisors, by a two - thirds vote, and a majority of the cities having a majority of the incorporated population within the County have adopted resolutions providing for the establishment of the authority and the imposition of the fee; and WHEREAS, the City Council finds that abandoned, inoperable, wrecked, dismantled vehicles or parts thereof pose a health and safety hazard and are found to be public nuisances; and, WHEREAS, on November 4, 1991, the Cupertino City Council adopted Resolution No. 8531 approving the establishment of and participation in the Santa Clara County Abandoned Vehicle Abatement Service Authority (AVASA) and authorized the City Manager to execute the agreement; and WHEREAS, the City of Cupertino desires to continue participation in the Abandoned Vehicle Abatement Program and share in the monies in said Abandoned Vehicle Trust Fund. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino as follows: 1. That the City of Cupertino shall continue to participate in the Abandoned Vehicle Abatement Program from May 1, 2012 to April 30, 2022; and 2. That the City Manager is hereby authorized to execute the contract with the Department of the California Highway Patrol for participation in said Abandoned Vehicle Abatement Program.
