Subject: Director's Minor Modification, DIR-2011-25, to allow minor site improvements
associated with a new picnic area located at an existing shopping plaza at 10680
South De Anza Boulevard.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Edmund Kwan, is proposing to install a five (5) foot high wrought iron fence
around a 978 square foot area to create a rest area for students of a specialized school at the
project address. No tree or parking space removals are proposed.
The proposed rest area consists of two picnic tables located on an existing bark ground cover
area and partially on two oversized parking stalls (29 feet, 1.5 inc.hes by 9.16 feet). The parking
spaces will be reduced in length to standard size (18 feet) and the excess area will be
incorporated into the existing landscaping features. New wheel stops and curb will also be
installed to buffer the parking area.
The proposed rest area will not be visible from the street since it is located behind existing
commercial pad buildings along De Anza Boulevard. The State Community Care Licensing
Division reviewed and supports the project.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Future Star Learning, 10680 S. De Anza Blvd.,
Cupertino, CA 95014;' prepared by Anderson Architects Inc. dated July 18, 2011 and
consisting of three (3) sheets labeled A3.0, A2.0, and A1.0 except as may be amended by the
conditions contained in this resolution.
2. BUILDING PERMIT
The applicant shall obtain a City building permit and install panic hardware and ADA
accessibility upgrades as deemed appropriate by the County Fire Department and Building

Division.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
o� any submitted data may invalidate an approval by the Community Development
Department.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective August 16, 2011. The fourteen calendar day appeal period
will expire on August 30, 2011. Please be aware that if this permit is not used within two years,
it shall expire on August 16, 2013.
