Cupertino, CA 95014 SUBJECT: TREE REMOVAL PERMIT ACTION LETTER (DEAD TREE) - Application TR-2011-35: This letter confirms the decision of the Director.of Community Development, given on August 12, 2011, approving a tree removal permit to remove one (1) dead Deodar Cedar tree in the front yard of property located at 22030 Regnart Road with the following conditions: 1. APPROVED PROTECT The approval is based on recommendations by arborist Barrie Coate on August 3, 2011 to remove and replace the dead Deodar Cedar tree. 2. TREE REPLACEMENT The applicant shall plant one (1) 36-inch box Valley Oak (Quercus Lobata) or Black Oak (Quercus Kelloggu) tree as a front yard tree in the same location as the dead Deodar Cedar to be removed. The replacement tree shall be planted within 90 days of this approval. 3. PROTECTED TREE COVENANT The applicant shall be required to record a covenant recording the replacement tree as a protected tree within 30 days of planting the replacement tree, in accordance with the City's Protected Trees Ordinance. Failure to do so may result in code enforcement and/or administrative citations. 4. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 1 Staff has made the findings necessary to grant the tree removal permit for the dead tree in accordance with Section 14.18.140B (Exemptions) of the Protected Trees Ordinance. Sincerely, Aparn ola P1aruling Division (408) 777-3319 aparnaa@cupertino. org 2 Tree Removal Permit Plan - Revised on August 11, 2011 Applicants: May and Paul Koski 22030 Regnart Road Cupertino, CA 95014 408-255-4509 On Wednesday August 3, 2011 Horticulturalist Barrie Coate came to our home, looked at the location of the dead Deodar Cedar, and recommended that we plant either a Valley Oak (Quercus lobata) or a Black Oak (Quercus kelloggii) at the present location of the Deodar Cedar. These species should not damage our foundation, water lines, or septic system. Both species are deciduous, and will provide shade in the spring and summer months. Our proposal is as follows: 1. Remove the dead Deodar cedar in our front yard that is right next to our house as soon as possible. It is a definite fire hazard. We also run the risk of having branches or the tree itself falling on the house and doing significant damage at this point. 2. In the present location of the dead Deodar Cedar, plant either a Valley Oak (Quercus lobata) or a Black Oak (Quercus kelloggii), based on availability. Size of the new tree will be a 36" box tree. Mr. Coate will help us obtain a healthy tree to plant. This fulfills the Cupertino `protected tree' ordinance. 3. Mr. Coate recommended that the tree be planted in November, which is when the tree is entering a dormant stage, but the soil temperature is high enough to encourage growth of new roots. We are planning to plant the new tree within the city of Cupertino's deadline, to fully comply with the city ordinance, unless the city allows us to wait until November.
