Subject: Director's Minor Modification, DIR-2011-20, to allow an 863 square foot addition to a
previously approved building at the Homestead Square at 20620, 20580 & 20680
Homestead Road.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Plannulg Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
Project Description
On May 4, 2010, the City Council approved a use permit and architectural and site approval to
allow the demolition of 95,666 square feet of existing commercial space and the construction of
146,458 square feet of new commercial space consisting of four new commercial satellite
buildings and three new major tenant spaces in an existing shopping center.
The project was approved as a phased development with the construction of the largest satellite
building (17,340 square feet) for Rite Aid in Phase 1. The applicant's building permit submittal
shows a slightly larger building of 18,203 square feet. The 863 square foot increase is due to Rite
Aid's desire to have a mezzanine level. The increase is entirely internal with no change to the
building footprint. The space is exclusively for use as a storage and mechanical/electrical room
(see Attachment 1). This space is not expected to generate additional parking demand and,
therefore, additional parking is not required.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: A New Retail Building for: Rite Aid (Store No. 5967),
„
00000 Homestead Road, Cupertino, CA" prepared by Arc Tech Inc. consisting of three
sheets labeled A1.03, A2.11 and A3.01, except as may be amended by the conditions
contained in this resolution.
2. DEVELOPMENT APPROVAL
Approval is granted to add 863 square feet to the Rite Aid pad building for a total building
area of 18,203 square feet.

3. PARKING
Additional parking space is not required as long as the additional approved square footage
in the mezzanine is used for storage and other mechanical areas. If the applicant desires to
use this area for any other use, additional parking in accord with the requirements of the
approved Use Permit and/or the Parking Ordinance.
4. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective July 15, 2011. The fourteen calendar day appeal period will
expire on July 29, 2011.

Rite Aid's corporate operating standards the mezzanine a�ea is used for storage of www.arctecinc.com
merchandise until it is transferred to the Sales Area. Wi#hin the mezzanine is an efectrical
room containing the roof access ladder, electrical panels, telephone boards, lighting
contrallers, etc.
