Subject: Director's Minor Modification to re-start a previously approved ozone
injection and soil vapor extraction treatment system (DIR-2005-11; DIR-2004-
21) at an existing gasoline station located at 19550 Stevens Creek Boulevard.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant Western Dealer Holding Co. proposes to install an ozone injection and
soil vapor extraction treatment system at an existing gas station. The system is
designed to oxidize and remove soil and ground water contaminants/volatile organic
compounds from leaky underground storage tanks. This is to satisfy the requirements
of the Santa Clara Valley Water District (SCVWD). The project site is located at the
southwest corner of Stevens Creek Blvd. and Miller Ave. The treatment system is
temporary and will be there for about two years. Upon completion of the remediation
process, SCVWD shall certify that the site is cleaned and the equipment removed
permanently.
ACTION:
The Director approves the application, File No. DIR-2011-13, with the following
conditions:
1) The Director of Community Development deems the modification minor and
approves the proposed ozone injection and soil vapor extraction treatment
system based on the attached plan set titled: "Ozone Microtrench Layout Map,
76 Station (Former BP) No.11220,19550 Stevens Creek Blvd., Cupertino, CA"
consisting of 2 sheets dated June 06, 2011 unless as amended by the conditions of
approval of this project.
2) This approval of the modification is effective July 11, 2011. The 14-calendar day
appeal period will expire on July 26, 2011.
3) The proposed ozone injection and soil vapor extraction treatment system shall be
removed by October 15, 2013. If additional time is required, a new director's
minor modification shall be obtained from the Planning Department.
