SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - TR-2011-17:
This letter confirms the decision of the Director of Community Development, given on june 21,
2011, approving a tree removal permit to allow the removal and replacement of four (4) Ash
trees at an existing office park to facilitate parking lot accessibility upgrades, located at 1 Infinite
Loop. This removal is approved with the following conditions:
1. APPROVED PROJECT
This approval is based on a report prepared by Dave Muffly (Master Certified Arborist
#WE-4279B), dated May 16, 2011, consisting of six pages and entitled: Arborist Report,
Infinite Loop Campus, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENT PLAN
The applicant shall plant the replacement tree in accordance with the City's Protected
Tree Ordinance and within 30 days of the effective approval date of this tree removal
permit. The replacement tree shall be four (4) 36-inch box size Valley Oak Trees. The
location of the proposed tree shall be in accordance with the Arborist Report and Tree
replacement plan.
3. PROTECTED TREE COVENANT
The applicant shall be required to record a covenant recording the replacement tree as a
protected tree within 30 days of planting the replacement tree in accordance with the
City's Protected Trees Ordinance. Failure to do so may result in code enforcement
and/ or administrative citations.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of
the amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.140 of the Protected Trees Ordinance. Please note, however, that an appeal of
this decision can be made within 14 calendar days from the date of the mailing of this
decision. If this happens, you will be notified of a public hearing, which will be scheduled
before the Planning Commission and the trees cannot be removed until a final decision on
the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be
removed after Tuesday, July 5, 2011.

Infinite Loop Campus
Introduction
At the Apple Computer Main Campus, Infinite Loop 1, Cupertino, CA, there are
several locations where Apple is required by the City of Cupertino to perForm
American Disabilities Act (ADA) upgrades to entrances around the campus.
Existing Trees will be impacted to meet these ADA requirements at two locations.
Additionally, Apple will be expanding the two existing bus/shuttle pullouts closest
to the main campus entrance, for safety and environmental reasons as described
below. Two trees, one at each location, will need to be removed to allow for the
construction of these expanded pullouts.
Location 1
In this location, a"switchback" ramp is to be installed. To achieve the
"switchback", one 'Autumn Purple' Ash tree (Fraxinus americana) Ash 1(Tag
Number 568 in Figure 1), will necessarily be removed. On the other side of the
current stairway grows Ash 2(no tag affixed). It is judged by Apple's Board-
Certified Master Arborist that Ash 2 can be retained, even though there will need
to be some soil/root removal. In this case, the roots of Ash 2 are growing into a
large planter area which is on the side away from the cutting, and this area will
not be impacted. It is expected that construction will damage or remove less than
one-third of the root system, therefore industry standards are such that the tree is
to be retained. The Apple Arborist will be on site during the stage of construction
that impacts Ash 2. (Refer to detailed tree measurements on Figure 1).

Location 3
At this location in front of the main campus, the existing bus/shuttle stops must
be widened to accommodate the size of the vehicles stopping to pick up
pedestrians in these areas. Currently the buses and shuttles stop in the roadway
and block traffic, providing an unsafe condition for vehicles and pedestrians. The
widened pull-outs will allow the vehicles to maneuver out of the roadway for
loading procedures. These widened pull-outs will require the removal of two
`Autumn Purple' Ash trees (fraxinus americana), Ash 4& 5(Tag Numbers 569 &
570). (Refer to detailed tree measurements on Figure 1).

Replanting
In line with City of Cupertino requirements, we propose to replant the removals
with 4 36-inch box native Valley Oak (Quercus /obata) placed in strategic parking
lot locations to maximize parking lot shading. Valley Oak is noted for its drought
tolerance, and as such is a very effective choice for the large planting areas
where we propose to replant (shown in Figures 2& 3). We are choosing the
native oak which is deciduous (drops it's leaves in the winter), to allow for
excellent shading during the hot months, and to allow light through in the winter.
Valley Oak is also among our most beautiful winter silhouette trees. We have
already located excellent-quality 36-inch box Valley Oaks from Valley Crest Tree
Nursery (as shown in Photo 2).
