This removal is approved with the following conditions: 1. APPROVED PROTECT This approval is based on a report prepared by consulting arborist, David Babby (licensed contractor #796763), dated May 9, 2011, consisting of eighteen pages, entitled: An Arborist Review of the Proposed Five Tree Removals at 10700 N. Tantau Avenue Cupertino, California, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENT PLAN The applicant shall plant the replacement tree in accordance with the City's Protected Tree Ordinance and within 30 days of the effective approval date of this tree removal permit. The replacement tree shall be seven (� 36-inch box size Valley Oak Trees and one (1) 24-inch box size Coast Live Oak Tree. The location of the proposed tree shall be in accordance with the Arborist Report and Tree replacement plan. 3. PROTECTED TREE COVENANT The applicant shall be required to record a covenant recording the replacement tree as a protected tree within 30 days of planting the replacement tree in accordance with the City's Protected Trees Ordinance. Failure to do so may result in code enforcement and/ or administrative citations. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff received a comment from a City of Santa Clara resident regarding the proposed project. The community member expressed concerns over the loss of privacy that would result from the tree removals, particularly the removal of Tree #5. The applicant has relocated one of the replacement trees where Tree #5 will be removed to mitigate any potential privacy impacts. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.140 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be removed after Tuesday, July 5, 2011. Babby, Registered Consulting Arborist May 9, 2011 1.0 INTRODUCTION I have been retained by the City of Cupertino Community Development Department to review the proposed removal of five Monterey pines (Pinus radiata) from the property at 10700 N. Tantau Avenue, Cupertino. Specific tasks performed are as follows: ■ Review the applicant's report, dated Apri121, 2011. ■ Perform a site visit on May 4, 2011. ■ Identify each tree proposed for removal. ■ Measure each tree's trunk diameter at 54 inches above grade or where appropriate to best represent trunk size; diameters are rounded to the nearest inch. ■ Estimate each tree's canopy spread. ■ Ascertain each tree's health and structural integrity, and assign an overall condition rating (e.g. good, fair, poor or dead). ■ Determine each tree's suitability for preservation (e.g. high, moderate, or low). ■ Specify whether any of the trees are regarded as "protected trees" and "specimen trees" per City Code. ■ Utilize numbers provided in the applicant's report. ■ Show the numbers on an aerial photograph presented in Exhibit B(derived from Google Earth). ■ Obtain photographs of each tree; these can be viewed in Exhibit C. ■ Present findings as to whether the proposed removals conform to the City Code. ■ Review the species, size and amount of trees proposed for installation. ■ Prepare a written report containing the aforementioned information. 10700 N. Babby, Registered Consulting Arborist May 9, 2011 2.0 OBSERVATIONS AND FINDINGS The five Monterey pines are sequentially numbered 1 thru 5, and suecific information regarding each tree is presented within the table in Exhibit A. The trees' approximate locations can be viewed on the aerial photo in Exhibit B, and photographs of each tree are presented in Exhibit C. Based on the site, it is assumed that all trees presented herein were planted or retained as part of a previously approved and planned development. As such, the trees can be considered regulated and defined as "protected trees" pursuant to Section 14.18.035(C) of the City Code. None of the trees are defined as "specimen trees" per Appendix B of Ordinance No. 07- 2003. Each tree proposed for removal has a significant health and/or structural defect that is beyond recovery, and can be expected to worsen regardless of tree care measures employed. In most instances, the trees present an immediate threat to public safety and property below. Based on the above information, I have assigned a"low" suitability for preservation rating to each tree, an�find the removal of each conforms to Section 14.18.180 of the Town Code. 10700 N. Babby, Registered Consulting Arborist May 9, 2011 3.0 TREE REPLACEMENTS Applying Table A, Section 14.18.185 of the City Code, one of the following three combinations would be installed to mitigate removal of the five subject Monterey pines: a. Nine trees of 24-inch box size. b. Seven trees of 24-inch box size and one tree of 36-inch box size. c. Five trees of 24-inch box size and two trees of 36-inch box size. The appGcant's report identifies the installation of 10 trees of 24-inch box size. As such, their proposal conforms and exceeds provisions set forth within Section 14.18.185 of the Code. The species selected and location installed should consider a tree's growth rate, size at maturity, growth habit, suitability for a parking lot environment, anticipated life span, susceptibility to insects and diseases, root invasiveness, and proximity to hardscape and buildings. Once determined, I am available to review and provide comments. Based on the amount of new trees, I recommend they are selected and tagged at the nursery by an ISA certified arborist prior to being shipped to the site. Those installed should have relatively symmetrical structures mostly free of obvious defects, wounds and girdling roots. Additionally, the arborist should be retained to examine and root prune, as �� needed, once the boxes are removed and before lowering into the planting hole. All new trees should be installed, including necessary irrigation, by an experienced state- licensed landscape contractor or a professional tree company, and performed to professional industry standards. Babby, Registered Consulting Arborist May 9, 2011 rubber tree ties or equivalent, and the support stakes cut below the first main lateral branch; where this is not feasible for a low-branching tree, the stakes should be established in a manner that avoids damaging the trunk and branches. Typically, the type of anchor root seen would be found on the side opposite the lean (to serve as a support mechanism); however, for this tree, it is found on the opposite side, and consequently, the risk of the entire tree uprooting is significant. The tree is outgrowing planter, and has significantly buckled the adjacent curb. Has some dieback, but at this time, appears in viable health. Monterey pine 3 (Pinus radiata ) 26 40 50% 25% Poor Low Comments: Has outgrown planter. Major anchor roots abut existing walkway, and the adjacent curb has cracked due to the tree's trunk and root expansion. Has a sparse and declining canopy. Monterey pine 4 (Pinus radiata ) 14 30 50% 0% Poor Low Comments: Tree shows signs of having partially uprooted sometime ago. It has a significant lean of nearly 45-degreea over the parking, and opposite the lean at the trunk's base, the major anchor roots are surfaced with space � between the ground and root bottom. Presents an immediate threat to persons and property below. Monterey pine 5 (Pinus radiata ) 22 - 0% 0% Dead Low Comments: Tree is dead and absent of any foliage. Main trunk divides into two leaders a few feet above grade, the largest being approximately 16 inches measured at 54 inches high (the 16 inches is utilized for replacement purposes). Site: 10700 N.
