Subject: Director's Minor Modification, DIR-2010-29, for a 300 square foot rear yard
patio room addition located at 10659 Hale Place.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within f ourteen calendar days.
BACKGROUND
The applicants, Morteza and Shahrzad Rahnemoon, propose to obtain approval for a
300 square foot rear yard patio room addition on their existing duplex at 10659-10661
Hale Place. The existing addition appears to be at least 20 years old and pre-exists the
purchase of the property by the applicant about six years ago. The property is zoned R-
3, Multiple-Family Zoning, which requires discretionary planning approval for any
additions or modifications to the building exteriors.
DISCUSSION
As-built drawings and photographs of the one-story patio addition are attached
(Attachments 1& 2). Building data is as follows:

The proposed addition complies with the building setbacks and height limit of the R-3
zoning district. The Building Division has inspected the structure and determined that
it needs additional minor, interior, structural modification to meet City building codes.
Building Division is in contact with the applicant and will process a building permit for
the modification.
ACTION
The Director of Community Development deems the modification minor and approves
the patio addition with the following condition:
1. Buiding Permit
The applicant shall apply for a building permit and make needed structural
improvements to comply with City building codes.
This approval of the modification is effective May 10, 2011. The fourteen calendar day
appeal period will expire on May 24, 2011.
