SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - TR-2011-05:
This letter confirms the decision of the Director of Community Development, given on Apri11,
2011, approving a tree removal permit to remove two (2) Monterey Pine trees and one (1) dead
Monterey Pine tree in the parking areas of an existing office complex located at 10700 Tantau
Avenue. This removal is approved with the following conditions:
1. APPROVED PROJECT
This approval is based on Exhibit 1: Arborwell Professional Tree Management arborist
report, consisting of five pages dated February 18, 2011 regarding the removal of three
(3) Monterey Pine trees, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant shall be required to plant six (6) 24inch box size trees in accordance with
the City's Protected Trees Ordinance. The required replacement trees shall be planted
within 60 days of the effective approval date of this tree removal permit.
3. REVISED TREE REPLACEMENT PLAN
The applicant shall submit a revised tree replacement plan prior to the tree removals.
Replacement trees shall be six (6) 24-inch box size Coast Live Oak trees instead of the six
(6) 24-inch box size Monterey Pines as described on page 1 of Exhibit 1. Revisions shall
be made on page 1 and page 2 of Exhibit 1 to reflect these changes. The location of the
proposed tree replacements will remain.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of
the amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Staff received comments from two City of Santa Clara residents regarding the proposed project.
One expressed concerns over the loss of privacy that would result from the tree removals,
particularly since the building on the subject site is two-stories. The community member has
suggested providing window treatments or including other necessary screening measures on
the building to mitigate potential impacts. Staff has determined that the concerned neighbor is
not directly adjacent to any of the trees being removed and also noted that the tree replacements
will be planted in the general vicinity of the removed trees.
Another community member expressed concerns that the number of trees to be removed was
too few. The community member also commented that Monterey Pines create excess debris due
to falling needles and thus, would prefer alternative replacements. The applicant is willing to
substitute the six (6) proposed Monterey Pines with six (6) Coast Live Oak trees. A condition
has been added to require the revised tree replacement plan be submitted prior to tree removal.
Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.140 of the Protected Trees Ordinance. Please note, however, that an appeal of
this decision can be made within 14 calendar days from the date of this decision. If this
happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission and the trees cannot be removed until a final decision on the appeal
has been made. If no appeal is made within the appeal period, the trees may be removed
after Friday, Apri115, 2011.

Re: Tree Removals at 10700 Tantau Avenue, Cupertino, CA -Three (3) Monterey Pines
To whom it may concern,
We are asking permission to remove three (3) Pinus radiata, Monterey Pines,
located at 10700 Tantau Avenue, Cupertino, CA. Pine #1 is 22" diameter at 4.5 feet above
grade and approximately 70' in height with a 40' canopy spread. Pine #2 is 23" diameter
at 4.5 feet above grade and approximately 60' in height with a 25' canopy spread. Pine
#3 is 27" in diameter at 4.5' above grade and approximately 45' in height with a 35'
canopy spread. Please see Figure 1 for relative locations of the trees to the
building/parking area. The three (3) pines have a high potential for failure, as explained
below.
Pine #1 is root restricted, growing in a small planting island on the southern side
of the building. There is a high probability that the root system is not well distributed
based on its limited growing space. The tree has a severe lean and, based on its rest�icted
growing location, has a high potential for whole tree failure (see Figure 2).
Pine #2, located in the planting area north east of the building, is 100% dead and
needs to be removed. The tree has a high potential for limb failure and/or whole tree
failure (see Figure 3).
Pine #3 has a severe lean and displays a high degree up root-lifting with soil
movement and mounding at the base of the tree. Again, based on these conditions the
tree has a high potential for whole tree failure (see Figure 4).
Our concern with the trees is that they are located in close proximity to targets
(parked vehicles, vehicular traffic, and pedestrian traffic) and, in the event of failure, may
cause loss of life or property.
The owners have requested to remove the said trees and have them replaced with
two (2) 24" box Pinus radiata, Monterey Pine, per each removal. Please see Figure 1 for
the location of the trees, their positions relative to the building/parking area, and
