RECOMMENDATION
Approve Architectural and Site Approval Modification, M-2011-02, based on the model
resolution.
BACKGROUND
Original Hotel Project
In 2008, the applicant, Shashi Corporation, applied for a use permit, architectural and site
approval and tree removal permits to redevelop an existing gasoline station/carwash into a 138-
room luxury hotel with a restaurant, bar, lounge and conference rooms. The project was
reviewed by the Planning Commission and approved by the City Council at its January 20, 2009
hearing (Attachments 1& 3). On August 3, 2010, the City Council approved a request to extend
the permit approvals to January 20, 2012.
H�att Place
The applicant has now secured private financing for the hotel and has selected Hyatt Hotels as
its operator to open its first Silicon Valley Hyatt Place in Cupertino. The applicant proposes to
make minor site and architectural enhancements to the approved hotel. According to the
applicant, Hyatt has already internally approved the revised architectural and site plans
(Attachment 4).

Amenity Area Changes
The hotel amenity areas: restaurant, bar/lounge, conference rooms have been reduced in size
and/or function in accordance with the previously approved modification, M-2010-07. While
the proposed first floor building footprint remains essential the same in terms of square footage,
the applicant has increased the size of the administrative offices, relocated 12 hotel rooms, the
fitness room and the laundry facilities to the ground floor and reduce the size of the amenity
areas. A swimming pool , that was deleted in the approved hotel plans because it was located
on the eliminated parking level, has been relocated to the ground level.
Staff has also visited a Hyatt Place in Fremont, California. The furnishings are upscale, but the
food and drink service are limited. Hyatt Place offers a continental breakfast buffet and a
display case of ready-to-eat sandwiches, salads, bakery items, juices and soft drinks. Hot
entrees, lunch and dinner may be ordered from a limited menu via a touch screen kiosk. Beer
and wine service is offered from a small bar area.

Building Design Changes
The hotel proposal has dropped a story along with some of the architectural detailing of that
original proposal. The hotel base was anchored by wide, two-story high granite-cladded
columns separated by large, grilled, square windows and topped with a cornice line. The
building base is still represented, but is not as visually strong as the original design. The
building corner at the street intersection has an angular design versus the previous rounded
corner. The porte cochere is now angled and expanded making it a more visually dominating
element than the previous one.
Internally the rooms have been reorganized so most room windows have street views. This
makes the north side of the building more interesting and the west side less so. The building
materials are all the same from the original approval, just used in slightly different proportions.
The trash enclosure is smaller, but located in the same area as the approved project. The
enclosure needs to be screened with shrubs or climbing vines because of its proximity and
visibility to Alves Drive. A condition has been added to the model resolution.
The porte cochere columns are rather bland and will be the first thing hotel customers will see
when they drive up to the hotel. Staff is recommending that their appearance be upgraded and
approved at the building permit stage. A condition has been added to the model resolution.
Signage
Signage details have not been presented and shall not be part of this proposal. A condition has
been added that requires future review and approval of the sign program for the hotel.
Landscaping
A conceptual landscaping plan has been submitted indicating similar quality and quantity
plants as the previous approval. A condition has been added that a more detailed landscaping
plan will be reviewed and approved at the building permit stage and will demonstrate
compliance with the Water Efficiency Landscape Ordinance. A condition has also been added
to require the planting of 48" box trees along the west side of the De Anza Boulevard, consistent
with the previous Council direction.
Environmental Reviezv
The project is a minor architectural modification of an approved hotel project which received
environmental review under file no. EA-2008-08. A negative declaration was adopted for that
previous approval and is being reused for this project.

APPROVING A MODIFICATION TO PREVIOUSLY APPROVED
ARCHITECTURAL AND SITE APPROVAL (ASA-2008-07) TO ALLOW FOR
MINOR ARCHITECTURAL AND SITE CHANGES
SECTION I: PROTECT DESCRIPTION

SECTION II: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Design Review Committee has held one or more public hearings on this
matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1. The proposal, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2. The proposal is consistent with the purposes of the Architectural and Site Review Ordinance, the
General Plan, any specific plan, zoning ordinances, use permit and other entitlements which
regulate the property.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the Modification of the Architectural and Site Approval applications is hereby approved subject to
the conditions which are enumerated in this Resolution beginning on page 2 thereof; and
That the sub conclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application M-2011-02 set forth in the Minutes of
the Design Review Committee meeting of March 31, 2011, and are incorporated by reference as though
fully set forth herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on a plan set titled: Hyatt Place Cupertino dated 3/14/11 and 3/17/11 and
consisting of 20 sheets labeled C1, C2, A1 - A14, L1, L2, CP1 and CP2, except as may be amended by
conditions in this resolution.

2. DESIGN CHANGES
The applicant shall improve the appearance of the trash enclosure wall facing Alves Drive and the
porte cochere columns with the use of landscaping, materials and design. Final design shall be
approved by the Director of Community Development at the building permit stage.
3. LANDSCAPING CHANGES
The proposed 36" box trees along De Anza Boulevard shall be replaced with 48" box trees.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.

Landscape Concept
The tandscape design concept for the Shashi Hotel in Cupertino is to provide
an enjoyable and aestheUc space for the guests and to be cohesive with the
surrounding area. Landscape will be used to highlight focal features, guide
guests through the hotel experience, and conceal functional and utilitarian
components of the hotel. Much of the landscape is over the garage strudure
below. Recessing the building into grade, the use of raised planters,,and
landscape are used to blur the limit of the garage and visually tie this site to the
streetscape. The hotel and landscape have been designed to be visually open
to pedestrian traffic and the surrounding neighborfiood. Landscape is also
used to buffer the hotel from the adjacent properties.

Irrigation
The entire site will be irrigated using a fully automatic
system. The irrigation system will be a combination of
pop-up spray and sub-surtace drip irrigation within the
raised planters and along the perimeter. The system will
include in-line valves, quick couplers, and gate valves, as
well as backflow preveMion to meet all local and UBC
codes and the Water Efficient Landscape Ordinance.
Automatic controller will be a'Smart' controller. Anti-drain
valves shall be installed in all areas where necessary to
prevent low-head drainage.
Plant material has been selected that performs well in the special conditions of
