SUBJECT AND ISSUE
Adopt Resolution No.06- I L.( (" , authorizing the City Manager to negotiate and execute
Amendment No.1 to the Agreement with HNTB Corporation, not to exceed $100,000 for
continued architectural design, civil design, project management, and construction
management services related to Stevens Creek Corridor Park and extending the term of the
agreement from October of 2006 to December 31, 2006, and providing an amount not to
exceed $50,000 for additional services which may be approved as necessary by the
Director of Public Works for a total contract amount of$550,000.
BACKGROUND
On April 4, 2006, the City Council approved an initial Agreement with HNTB Corporation
in the amount not to exceed $400,000 for design, project management and construction
management services for the Stevens Creek Corridor Park project.
It was noted at that time that the initial agreement with HNTB would be the first of at least
two parts. An amendment for additional fees was to be brought back to Council when
more specific information regarding additional grant funding availability, project priorities,
and work flow was better understood by the entire consultant and City project management
team.
ANALYSIS
This proposed amendment is to complete the design development, detailed project scope, a
complete and updated funding summary of the project budget, and current construction
cost estimates for consideration by the Council for the final scope determination of this
phase of the project. These products will represent the 50% completion point for the final
Plans, Specifications and Estimates (PS&E) for the project. It is staff s intention to present
a complete discussion of the various components of the project with current estimates of
constructed costs of the project at the regularly scheduled meeting on October 17, 2006.
In support of that objective, HNTB will provide architectural design and value engineering
for buildings contemplated in the master plan, including the environmental classroom, a
maintenance building, restroom renovation, and some minor upgrades to the existing 4-H
facilities, along with the creek restoration work.

Following Council consideration of recommendations for the final scope of the first phase
of the project now planned for October 17, 2006, an additional amendment will be
proposed by staff for Council consideration to complete the balance of the work to
assemble the necessary construction documents to enable the City to bid work on the creek
restoration in the spring of 2007. This work will require a variety of permits which are now
being sought by staff and the consultants. This early work, once accomplished, is to
provide an appropriate time period for the new creek banks to become stable with new
growth before the creek is diverted into them late in the spring of2008.
As has been noted before, this particular project is very complex with various types of
work spread over a large area of the park. This Amendment will continue this aspect of the
work, including civil and architectural design, value engineering, cost estimating,
alternative use analyses, construction scheduling, permit application, material reuse
analyses, project management, and construction management. HNTB, in conjunction with
the primary members of the existing master plan team, and several additional sub
consultants, will provide all of these services through additional and yet to be determined
phases of design and construction.
FISCAL IMP ACT
Adoption of this resolution will result in the encumbrance of $150,000 from the Stevens
Creek Corridor Park fund account 427-9112, which is provided in the adopted FY 2006-
2007 Capital Improvement Program.
STAFF RECOMMENDATION

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO

NOW, THEREFORE, LET IT BE RESOLVED, that the City Council of the City
of Cupertino hereby authorizes the City Manager to negotiate and execute Amendment
No.1 to the Agreement with HNTB Corporation for continued architectural design, civil
design, project management, and construction management services related to Stevens
Creek Corridor Park.
