Subject: Director's Minor Modification, DIR-2011-05, to allow for a minor site
modification to an existing apartment complex (The Markham) to facilitate a
maintenance shed at 20800 Homestead Road.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION
The applicant, Michael Ducote of Prometheus, is requesting approval to construct a 608
square foot maintenance shed to be located on the southeast corner of The Markham
Apartment complex within an existing parking space and corner landscape area. This
area is at a corner of the rear parking lot and is adjacent to Interstate 280 to the south
and a mini-storage facility to the east. The maintenance shed will provide storage area
for maintenance equipment and parking for carts that are used by The Markham staff
for maintenance and security purposes.
The shed will have vertical board and batten siding with composition shingle roofing
and light gray color to match the apartment buildings. No trees are proposed to be
removed in conjunction with this application. However, the placement of this shed will
displace one required parking space in the complex. This parking space will be replaced
by two existing and uncovered parking spaces (See highlighted area in the Carport Site
Plan) between two carports in the middle of the apartment complex that were proposed
to be converted to a landscape median and planted with one tree. In lieu of converting
these spaces to a landscape median, the applicant is requesting approval of a minor site
modification to retain these parking spaces and to plant a tree in the 4-foot wide
landscape planter area behind these parking spaces. Therefore, the project would not
result in the loss of required parking, but a net gain of one parking space. Additionally,
this will allow a tree to still serve the purpose of shading these parking spaces.
Additionally, planting of a tree in this area will be consistent with the approved

landscape plan for the project, which requires 24-inch box Bay Laurel trees to be planted
in the landscape strip behind these parking spaces and the carports. Therefore, staff
recommends adding a condition that the applicant be required to plant a 24-inch box
Bay Laurel tree behind the two uncovered parking spaces to be retained in accordance
with the Carport Site Plan.
ACTION
The Director of Community Development deems this application to install a
maintenance shed and retain two uncovered parking stalls at The Markham Apartment
complex as minor and approves this application subject to the following condition of
approval:
1. The applicant shall retain the two uncovered parking stalls between carports as
shown in the Carport Site Plan and plant one 24-inch box Bay Laurel tree in the
landscape planter area behind these parking spaces. The tree shall be planted
within 60 days of the effective date of this approval.
This approval is granted on March 1, 2011. Please note that an appeal of this decision
can be made within 14 calendar days from the approval date. The fourteen calendar
day appeal period expires after March 15, 2011. If an appeal is filed, a public hearing
will be scheduled before the Planning Commission. If no appeal is filed, the Director's
Minor Modification becomes effective on March 16, 2011.
