SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2011-02:
This letter confirms the decision of the Director of Community Development, given on February 19,
2011, approving a tree removal permit to remove and replace one (1) 10" diameter Coast Live Oak tree;
three (3) 31.5", 26", and 31.5" diameter Shamel Ash trees; one (1) dead 9" Silk tree; and one (1) dead 9"
Deodar Cedar tree located in the common area of the Sunny View Retirement community at 22245
Cupertino Road, with the following conditions:
1. APPROVED PROTECT
The approval is based on two arborist reports prepared by Arbor Resources dated May 29, 2010
and August 23, 2010 respectively entitled, "Two Coast Live Oaks" and "An Evaluation of the
Proposed Removal of Five Trees from 22445 Cupertino Road;' except as may be amended by
conditions in this resolution.
2. TREE REPLACEMENTS
The applicant shall be required to plant three (3) 36-inch box Chinese Pistache trees; two (2) 36-
inch box size Deodar Cedar trees; and one (1) 36-inch box Coast Live Oak tree on the common
area of the property, in accordance with the City's Protected Trees Ordinance and the tree
replacement plan. The required replacement trees shall be planted within 30 days of the
effective approval date of this tree removal permit.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all of the
requirements of Section 66020, you will be legally barred from later challenging such exactions.

1.0 INTRODUCTION
I have been retained by the City of Cupertino Community Development Department to
review the proposed removal of five various trees located at 22445 Cupertino Road,
Cupertino (Sunny View Retirement Community). Specific tasks performed for my review
are as follows:
■ Visit the site on 8/18/10, and identify each tree's location and species.
■ Measure each tree's trunk diameter at 54 inches above grade or where appropriate
to best represent trunk size; diameters are rounded to the nearest half of an inch.
■ Estimate each tree's canopy spread.
■ Ascertain each tree's health and structural integrity.
■ Assign an overall condition rating (e.g. good, fair, poor or dead).
■ Assign numbers to each tree, and plot those on a copy of the plan emailed to me (a
� section of that map is provided in Exhibit B).
■ Evaluate whether the removal of any or all trees would conform to the City's
Municipal Code.
■ Identify the size and amount of trees required for installation to mitigate those that
are removed (pursuant to Table 3-1, Section 14.18.185 of the Code).
■ Obtain photographs of each tree; these can be viewed in Exhibit C.
■ Prepare a written report containing the aforementioned information.

2.0 TREE COUNT AND COMPOSITION
Five (5) trees of three various species were inventoried for this report. They are
sequentially numbered as 1 thru 5, and include one Deodar cedar (#1); three shamel ash
(#2, 4 and 5); and one silk tree (#3).
Specific data recorded for each tree can be viewed in Exhibit A (Tree Inventory Table).
Also, their locations are presented on the site map in Exhibit B, and photographs are
provided in Exhibit C.
Pursuant to Section 14.18.035(C) of the City Code, the five inventoried trees are defined as
"protected trees."
3.0 REVIEW OF PROPOSED REMOVALS
3.1 Observations
During my past site, I evaluated the existing site conditions and each tree's health and
structural integrity. A summary of my observations for each tree is as follows:
■ Trees #1 and 3 Dead.
■ Tree #2: Declining, in poor health, and beyond recovery.

" ■ Tree #4 : Has a less than ideal structure, and is in very close proximity to two storm �
drain inlets. No verifiable evidence of damage to the storm drain can be observed,
but the tree may contribute to or exploit any damage to the storm drain.
■ Tree #5: Has caused significant damage to an adjacent storm drain inlet, and is in
close proximity to the sewer line and existing building. Has a weak structure.

When considering the previous information, it is my professional opinion that removing
and replacing all five trees would seemingly conform to the City's Municipal Code.
3.2 Tree Replacements
Pursuant to Table A, Section 14.18.185 of the City Code, mitigation for removing the five
trees includes installing new trees on-site according to one of the following four options:
a. Eight trees of 24-inch box size
b. Two trees of 24-inch box size and three trees of 36-inch box size
c. Four trees of 24-inch box size and two trees of 36-inch box size
d. Six trees of 24-inch box size and one tree of 36-inch box size
Regarding the type of tree to install, I suggest one or more of the following are considered:
Deodar cedar (Cedrus deodara), coast redwood (Sequoia sempervirens), red oak (Quercus
rubra), red maple (Acer rubrum) and southern live oak (Quercus virginiana). For
replacing tree #3, alternative choices include swamp myrtle (Tristania laurina), Brisbane
box (Tristania confertus), Chinese pistache (Pistacia chinensis), river birch (Betula nigra)
and crape myrtle (Lagerstroemia indica).
Regarding the trees' locations, two can seemingly be installed in the planter area of tree #1,
and the remainder in the courtyard of where trees #2 thru 5 are located. Note that in the
courtyard, the trees should be placed at least 15 feet from existing pavement, buildings and
underground utilities. For both the planter and caurtyard, the new trees should also be
offset from the trunks of existing trees by five to ten feet. I am available to review any
proposed locations to determine feasibility.

All new trees should be installed, including necessary irrigation, by an experienced state-
licensed landscape contractor or a professional tree company, and performed to
professional industry standards. They shall be planted prior to final inspection, double-
staked with rubber tree ties with no cross-brace, and all forms of irrigation should be of a
bubbler-system placed on the soil surface and not in a sleeve

You have asked me to perform the following items regarding two trees located at the front
entrance of the above-referenced site:
[ 1 ] Evaluate their condition.
[2] Review whether their removal is warranted pursuant to Section 14.18.180 of the
Cupertino Municipal Code.
[3] If the removal of one or both does comply to the Code, then recommend
appropriate replacements as mitigation.
I visited the site on May 25, 2010, and this report presents my observations, photographs

Tree #1: coast live oak
This tree is the smaller of the two, and has a trunk diameter of 10 inches (measured 54
inches above grade), an approximate height of 20 feet, and an estimated canopy spread of
20 feet across. It shows symptoms of being in poor and declining health, symptoms that
include a very sparse canopy and branch dieback. Around the entire circumference of the
trunk's lower five feet, there is a rather extensive amount of discoloration indicative of
infection by a harmful root-rotting organism (likely Phytophthora cinnamomi). This
infection may likely attribute to the tree's weakened condition, and given the extent of
decline and infection, it appears beyond recovery.
Tree #2: coast live oak
This tree is the larger of the two, and has a trunk diameter of 19.9 inches (measured at 54
inches above grade), is nearly 30 feet tall, and has 40-foot wide canopy spread across. In
contrast to tree #1, it appears healthy as leaf color and canopy density seems normal.
There is a small discolored area of bark at the base of the trunk's west side, a symptom of
either a bacterial infection, or possibly a minor infection by root rot. There is also some
twig dieback at the top center of the canopy, symptoms which appear to be attributed to
chewing by tussock moths and/or possibly root rot. Note that each of these observations

appears insignificant, and any concern should be further explored, possibly treated and/or
monitored by a qualified arborist. �-: - -

CONCLUSIONS
Based on my observations, it is my opinion that tree #1's declining condition appears
irreversible, and its removal would seemingly conform to Section 14.18.180(1) of the City
Municipal Code. However, tree #2 appears vigorous and healthy, and its removal would
not conform to the Code.
Pursuant to Table A of the Code, mitigation for the removal of tree # 1 includes the
installation of one tree of 24-inch box size. As for an appropriate replacement, I suggest
one of the following is chosen: coast live oak (Quercus agrifolia), valley oak (Quercus
lobata), red oak (Quercus rubra), and deodar cedar (Cedrus deodara). If the replacement
is to be installed somewhere other that the planter island it currently occupies, I suggest the
"D-shaped" island immediately south (where a coast live oak was recently installed); if this
occurs, I recommend it is setback by approximately 10 to 15 feet from the other new oak,
and situated in the center of the island.
