Exhibit CC 01-04-2011 No. 12 Planned Development Ordinance Amendments C C l -y —(l 4t Planned Development Ordinance Amendments MCA - 2010 -06 April 2010, City Council adopted: • Housing Element 2007 -2014 and • Associated Municipal Code Amendments Staff identified additional changes to the following code sections for consistency with the approved Housing Element: • Chapter 19.48 (Planned Development Zones) • Chapter 19.72 (Private Recreation Zones) • Chapter 19.124 (Planned Development Permits, Conditional Use Permits and Variances) • Chapter 20.04 (Specific Plans) Amendment: Categories The proposed changes to the Ordinance can be classified into three categories: • Consistency / conformance with: • Housing Element and • Other chapters of Municipal Code • Improving general readability • Eliminating redundancies/ discrepancies Planning Commission unanimously recommended approval of the amendments on November 9, 2010. 1 Chapter 19.48 Planned Development (P) Zones • Ordinance language changed to clarify that developments in (P) Zones may be approved with the issuance of a Planned Development Permit as oppose to a Conditional Use Permit • Processing details moved to Chapter 19.124 (Planned Development Permits, Conditional Use Permits and Variances) • No changes to current application requirements or processes Chapter 19.124 Planned Development Permits, Conditional Use Permits and Variances This section as been re- arranged to enhance readability and clarify requirements for each permit type. Findings section updated to be consistent with State Law 2 Chapter 19.72 & 20.04 Private Recreation Zones and Specific Plans Chapter 19.72: • Changes procedural reference to Chapter 19.124 instead of Chapter 19.48 Chapter 20.04: • Reference to Planned Development Zones corrected Recommendation Planning Commission recommends that the City Council approve the recommended amendments. 3
