CC Resolution No. 98-082RESOLUTION NO. 98-082 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO RESCINDING RESOLUTION NO. 8824, ADOPTING A DISADVANTAGED BUSINESS ENTERPRISES PROGRAM, AND ESTABLISHING AN ANNUAL DBE GOAL WHEREAS, the United States Department of Transportation requires the use of Disadvantage~ Business Enterprises (DBEs) in all aspects of Federal-aid contracting to the maximum extent feasible in Title 49, Part 23, of the Code of Federal Regulations; and WHEREAS, the City of Cupertino, which is a recipient of Federal-aid funds, agrees to ensure DB.~ firms have the maximum opportunity to participate in the performance of contracts and subcontracts; NOW, THEREFORE, BE IT RESOLVED: 1. That the City hereby rescinds Resolution No. 8824. 2. That the City hereby adopts the Disadvantaged Business Enterprises Program. 3. That the City has established an annual DBE goal of 10% with this Program for th period from October 1, 1997, to September 30, 1998. BACKGROUND In order to obtain federally funded grants, local agencies must have a Disadvantaged Business Enterprises (DBE) program. A DBE policy requires that a certain percentage of the contractor's workforce be made up of minorities. The City currently has a DBE policy, but Proposition 209 no longer permits this practice in this state. Therefore, the current policy must be rescinded. However, in order to qualify for federal funds, a ne~ DBE program must be established consistent with the federal requirements. Federal requirements set the minimum goal of 10%. The De Anza Boulevard and Stevens Creek Boulevard Arterial Management Project has federal funds, and this is needed in order to obtain said funds. STAFF RECOMMENDATION Staff recommends that the City Council rescind Resolution No. 8824, which established a Disadvantaged Business Enterprises Program, and adopt Resolution No. 98-082, adopting a new Disadvantaged Business Enterprises Program and establishing an annual DBE goal.
