APPROVED PROTECT The approval is based on the arborist report prepared by West Valley Arborists on October 28, 2010 and the arborist peer review by Michael L. Bench on November 16, 2010, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant shall be required to plant two (2) 24-inch box Coast Live Oak (Quercus agrifolia) trees on the property in accordance with the City's Protected Tree Ordinance. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Govemment Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree rerr[oval permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. The tree is in decline and would unlikely recover. It has suffered a major co-dominant leader failure in the recent past. Dr. Ed Gilman, University of Florida, asserts that trees, which have suffered this type of failure in the past, have a much higher risk of failure in the future. The leader facing the pool appears weakest because of its near horizontal structure. It does not appear that cabling would be effective in this case. The patio, the stucco wrought iron fence, and the pool appear to be at the greatest risk should a failure occur. However, the house is within striking distance. It does not appear that the risk is eminent or immediate, but this type of failure is unpredictable. For this reason, I recommend to accept the "immediate" removal request as a precaution. Michael L. As viewed, this mature oak is in decline with approximately 60% of its normal foliage in the upper crown. The leaves aze of fairly normal color and size but the distribution is sparse, the lower connecting point of its three co-dominant trunks is imbedded and sunken cankers resonate hollow when tapped upon. The raised and distutbed bark also contains a major infestation of the bark pest Ramosia Resplendens, especially in the decayed and canker present areas. The circumference of these co-dominant trunks are 63", 64" & 72" and the one leaning and embedded trunk has been cabled for added strength. The current sta.te of decay and structural faults, however, render this old oak a tree with a significant and immediate failure potential serious enough to wanant the application for a removal permit. Also, as health declines the brittle nature of the heartwood will increase making removal more hazardous and expensive. Please feel free to contact our office if you have any questions or concerns.
