RECOMMENDATION
Staff recommends approval of the Architectural & Site Approval with modifications per
the attached model resolution.
BACKGROUND
The applicant, Jon Ennis, representing the Fallenleaf Apartments, is requesting approval
from the Design Review Committee for the above referenced project. Currently, the
interior catwalk system providing access to the apartments on the second floor is in
disrepair (see Attachment A). The property owner has applied for building permits to
retrofit the catwalk/stair system. As part of the project, the property owner would also
like to significantly improve the property by updating the existing courtyard fa�ade, the
interior courtyard features, and the general landscaping/site features throughout the
property. In accordance with the R-3 Ordinance (Section 19.36.080), all building and
landscaping modifications must be reviewed and approved by the Design Review
Committee. �,�
DISCUSSION

• Install freestanding terra cotta walls behind pool
• Plant new trees and otl�er landscaping
Pool area irnprovements:
• Install scored concrete with accent colors
• Install �netal sunshade/trellis
• Install fence columns with lighting
• Install new 5' Izigh metal pool fer�ce around the perimeter of the pool
'�No trees are removed as part of this application. All new landscaping installation shall
comply with the City's Landscape Ordinance.
STAFF RECOMMENDATION
Staff supports the project provided that the proposed exterior court yard fa�ade be
addressed with additional architectural features that would promote more articulation
and minimize its visual mass.
Currently, the front elevation of the existing courtyard perimeter wall is presented by the
photo below. It consists of a catwalk above a brick wall with arched entry points below
and a trellis feature above. The wall connects the two wings of the apartment complex.

The project proposes to rebuild the perimeter courtyard wall with a new wall system
with modern detailing. The new wall will no longer facilitate a catwalk that connects
the two apartment wings. Instead it will consist of two free standing terra cotta walls

(approximately 12 feet tall) with separate stairwells/catwalk systems attached and a
new centrally located metal entry feature. See the illustration below:

Given the height of the two solid terra cotta walls, staff recommends that the applicant
work with the Planning Department to explore additional architectural embellishments
and/or potentially provide wall cut-outs to enhance articulation and reduce the visual
mass of the wall. A condition has been added to reflect this recommendation.

OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING ENHANCEMENTS TO THE EXISTING COURTYARD FA�ADE AND ASSOCIATED
LANDSCAPING AT AN APARTMENT COMPLEX (FALLENLEAF APARTMENTS) LOCATED AT 7373
FALLENLEAF LANE
SECTION I: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an application for an Architectural
and Site Approval as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the
City of Cupertino, and the Design Review Committee has held one or more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the
following requirements:
1. The proposal will not be detrimental or injurious to property or improvements in the vicinity, and will not
be detrimental to the public health, safety, general welfare, or convenience;
2. The proposal is consistent with the purposes of this chapter, the General Plan, any specific plan, zoning
ordinances, applicable use permits, variances, subdivision maps or other entitlements to use which regulate
the subject property including, but not limited to, adherence to the following specific criteria:
a) Abrupt changes in building scale is avoided and a gradual transition related to height and bulk is
achieved;
b) The materials, textures, and colors of new buildings harmonize with adjacent development by being
consistent or compatible with design and color schemes, and with the future character of the
neighborhood and purposes of the R-3 zone. The location, height, and materials of walls, fencing,
hedges, and screen planting aLso harmonize with adjacent development.
c) The project is designed to protect residents from noise, traffic, light and visually intrusive effects by use
of buffering, setbacks, landscaping, walls and other appropriate design measures.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter,
the application for Residential Design Review is hereby approved, subject to the conditions which are enumerated
in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based and
contained in the public hearing record concerning Application ASA-2010-07 set forth in the Minutes of the
Design Review Committee meeting of January 6, 2011 and are incorporated by reference as though fully set
forth herein.

Approval is based on the plan set entitled: "7373 Fallen Leaf Lane Apartments, Cupertino, CA" prepared by
BDE Architects dated October 4, 2010 with a revision date of December 15, 2010 and consisting of nine (9)
sheets, except as may be amended by the conditions contained in this resolution.
SECTION IV: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. REVISION TO FRONT COURTYARD FA�ADE DESIGN
Prior to issuance of the Phase II building permit (for the exterior cosmetic work, pool fence, replacement of
the front courtyard fa�ade, and the upgrade of landscaping and hardscaping as part of Architectural and
Site Approval ASA-2010-07), the construction plans shall reflect the following revisions to the front
courtyard fa�ade along Fallenleaf Lane, to be reviewed and approved by the Director of Community
Development:
a) Additional architectural features that promote more articulation and minimize the visual mass of
the two front walls
b) A redesigned entry feature that is more prominent and inviting
2. COMPLIANCE WITH LANDSCAPE ORDINANCE
Prior to issuance of building permits, the applicant shall submit detailed landscape and irrigation plans to
be reviewed and approved by the Director of Community Development. If the modified landscape area is
greater than or equal to 2,500 square feet, a landscape project submittal per section 14.15.040 of the
Landscape Ordinance is required prior to issuance of building permits.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication requirements,
reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these
Conditions constitute written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval
period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally barred from later challenging
such exactions.
