BACKGROUND
At its meeting of June 13, 2006, the Planning Commission voted (3-1-0, Giefer no, Wong
absent) to recommend approval of this project to demolish two single-family residences
and construct four single-family dwellings at 20055 & 20065 De Palma Lane (See
Planning Commission Resolutions and Exhibit A-1).
DISCUSSION
Planning Commission Comments
One Commissioner was concerned with the higher FAR houses proposed and a
perceived "canyon" visual effect along the street. A townhouse-style product in
keeping with the project next door was preferred. Another Commissioner was
concerned with the lack of public attendance at this hearing. The applicants stated that
they had met with all of the neighbors. One Commissioner pointed out that the homes
were 24 feet tall, which is less than the City maximum height of 28 feet for R-1 style
dwellings. A majority of the Commissioners supported the project as presented.
Public Comments
No members of the public attended the hearing.
Applicant Comments
The proposed houses are all for family members who desire to live in Cupertino. The
applicant said they shared their housing plans with the De Palma Lane neighbors and
they are supportive of the development. The applicant has agreed to be part of the
private association that pays for the maintenance of De Palma Lane, which is a private
street.

Staff Comments
Public meeting notices for this project were sent out to property owners within a 1,000-
foot mailing radius, which is over three times the distance of the mailing for the
abutting R&Z townhouse development approved five years ago.
Staff recommends that an additional condition of approval be added to the project:
PRIVATE STREET MAINTENANCE
The applicant shall enter into a recorded agreement to share in the financial
responsibility of maintaining De Palma Lane, which is a private street.

2. DEVELOPMENT APPROVAL
Approval is granted to construct four single-family detached dwellings ranging
in size from 3,265 TO 3,297 square feet.
3. ACCESSORY BUILDINGS/STRUCTURES
Accessory buildings and structures are allowed and permitted in accordance
with Cupertino Municipal Code Section 19.80, governing accessory buildings
and structures.
4. PRIV ACY LANDSCAPING AND GUEST PARKING
Privacy landscaping to mitigate visual impacts and the visual mass and bulk of
new two-story homes shall be planted and modified in accordance with
Cupertino Municipal Code Section 19.28.070, governing Rl Zoning District
landscape requirements. Guest parking stalls shall be improved with pavers on
a sand base to provide improved storm water infiltration.
5. BUILDING DESIGN CHANGE TO UNIT #3
Sheet A.16 of the approved plan set exhibit is modified to delete the low wall
surrounding the patio cover.
6. IMPROVED SANTA CLARA V ALLEY WATER DISTRICT ACCESS
The applicant shall improve the Santa Clara Valley Water District (District)
access across the entire frontage of his property(ies) with District approved
landscaping and pavement. If final District approval cannot be obtained in a
timely fashion prior to completion of the residences, the applicant shall submit a
bond, guaranteeing the completion of the improvements to the satisfaction of the
Director of Community Development and the Director of Public Works.

7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER
EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPT.
8. STREET WIDENING
Street widening, improvements and dedications shall be provided in accordance
with City Standards and specifications as required by the City Engineer.
9. FIRE HYDRANT
Fire hydrants shall be located as required by the City, San Jose Water Company
and Santa Clara County Fire.
10. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the City.
11. GRADING
Grading shall be as approved and required by the City Engineer in accordance
with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404
permits maybe required. Please contact Army Corp of Engineers and/ or Regional
Water Quality Control Board as appropriate.
* A grading permit maybe required pending on the excavating, filling and
recontouring of the project site in conjunction with this application.
12. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer. If City storm
drains are not available, drainage facilities shall be installed to the satisfaction of
the City Engineer. Pre and Post drainage calculations shall be submitted to
determine if new facilities need to be constructed to mitigate the increase of off site
runoff.

13. FIRE PROTECTION
Fire sprinklers shall be installed in any new construction to the approval of the
City and Santa Clara County Fire.
14. UNDERGROUND UTILITIES
The developer shall comply with the requirements of the Underground Utilities
Ordinance No. 331 and other related Ordinances and regulations of the City of
Cupertino, and shall coordinate with affected utility providers for installation of
underground utility devices. The developer shall submit detailed plans showing
utility underground provisions. Said plans shall be subject to prior approval of the
affected Utility provider and the City Engineer.
15. IMPROVEMENT AGREEMENT
The project developer shall enter into a development agreement with the City of
Cupertino providing for payment of fees, including but not limited to checking
and inspection fees, storm drain fees, park dedication fees and fees for
undergrounding of utilities. Said agreement shall be executed prior to issuance of
construction permits.

17. DEDICATION OF WATERLINES
The developer shall dedicate to the City all waterlines and appurtenances installed
to City Standards and shall reach an agreement with San Jose Water for water
service to the subject development.
18. BEST MANAGEMENT PRACTICES
Utilize Best Management Practices (BMP's), as required by the State Water
Resources Control Board, for construction activity, which disturbs soil. BMP plans
must be included in your building plan submittal.
19. TOINT USE AGREEMENT
The developer must enter into a joint use agreement with the Santa Clara Valley
Water District to construct and maintain a trail along the District's right-of-way.

submitted in this matter, the application TM-2006-05 for a Tentative Map is hereby

The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,

IV. CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT

6. GRADING
Grading shall be as approved and required by the City Engineer in accordance
with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404
permits maybe required. Please contact Army Corp of Engineers and/ or Regional
Water Quality Control Board as appropriate.
* A grading permit maybe required pending on the excavating, filling and
recontouring of the project site in conjunction with this application.
7. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer. If City storm
drains are not available, drainage facilities shall be installed to the satisfaction of
the City Engineer. Pre and Post drainage calculations shall be submitted to
determine if new facilities need to be constructed to mitigate the increase of off site
runoff.
8. FIRE PROTECTION
Fire sprinklers shall be installed in any new construction to the approval of the
City and Santa Clara County Fire.
9. UNDERGROUND UTILITIES
The developer shall comply with the requirements of the Underground Utilities
Ordinance No. 331 and other related Ordinances and regulations of the City of
Cupertino, and shall coordinate with affected utility providers for installation of
underground utility devices. The developer shall submit detailed plans showing
utility underground provisions. Said plans shall be subject to prior approval of the
affected Utility provider and the City Engineer.
10. IMPROVEMENT AGREEMENT
The project developer shall enter into a development agreement with the City of
Cupertino providing for payment of fees, including but not limited to checking
and inspection fees, storm drain fees, park dedication fees and fees for
undergrounding of utilities. Said agreement shall be executed prior to issuance of
construction permits.

RECOMMENDATION:
Staff recommends that the Planning Commission recommend to the City Council
approval of the rezoning, use permit, architectural & site approval and tentative map
per the model resolutions.
BACKGROUND:
Site Description:
This project is located on two 14,2002=. square foot lots, each developed with a single-
family residence. The properties take access off a private driveway/easement that
extends to De Palma Lane, a private street. The property is surrounded by a variety of
residential types: to the east is a one and two-story single-family planned unit
development, to the north are one-story duplexes, to the west are two-story
townhomes, and to the south is Regnart Creek and one and two story single-family
dwellings.
Project Description:
The applicant is proposing four single-family residences (Exhibit A). There are two
floor plans ranging in size frQm 3,266 square feet to 3,297 square feet. They are 3-4
bedrooms/3.5 baths with a fourth room that may be used as a den or 4th bedroom in the
3-bedroom plans. All of the units are accessed via a shared driveway off De Palma
Lane. Each residence has onsite parking equal to 5 parking stalls per unit (2 in garage,
2 in driveway apron and one guest parking stall.) The project includes an improved
access way along a segment of Santa Clara Valley Water District right-of-way that
encompasses Regnart Creek that will connect to a path in front of the townhouses to the
west.
DISCUSSION:
General Plan Confonnance:
General Plan residential density is calculated on the gross acre basis, which includes a
la-foot wide access easement abutting the property. The maximum allowable dwelling
unit yield for this site is 6 units. The applicant is proposing 4 units, which is still
consistent with the General Plan density range of 5-10 dwellings per gross acre, at a
density of 5.73.
Site Design, Architecture and Setbacks:
The project was designed to provide a strong creek orientation with the main entries
and front porches rotated to face the creek. This is important in creating an open
community and providing visual security along the creek that parallels its only access.
The building setbacks are typical for an Rl zoning district with greater, side setbacks
toward the rear (nearly 15 feet) where it abuts the rear yards of the d1:lplexes.
The architecture is a typical ranch style home with stucco siding, concrete mission roof
tiles with some stone accents at the base and entries.

TreesjPrivacy:
There are no specimen trees on the properties. Trees proposed for removal are fruit or
ornamental trees, including: grapefruit, cherry, orange, olive, red leaf plums, birches
and pines.
The applicant is proposing privacy landscaping to screen views from second story
windows into adjacent yards. A condition has been added to the resolution to ensure it
meets the R1 zoning standard.
Project Floor Area Ratio (FAR):
This project has an average sitewide FAR of 52.1 %. This is comparable to the adjacent
