Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within f ourteen calendar days. DISCUSSION The applicant is requesting a modification to a previously approved use permit to add an apartment unit to an existing complex consisting of 123 apartments. The project proposes to convert an existing storage area (located at the northeast corner of the property) to a one-bedroom unit. No square footage is being added since the addition is in the existing footprint of the storage area. The original use permit was approved by the City Council. Since the property is located in a residential planned development zoning district, P(R3), any exterior modifications and/ or increase in units, must be approved with a Director's Minor Modification. Other associated exterior modifications and site improvements include: • A new exterior window for the new apartment unit • Eleven parking spaces • Landscaping enhancements • A wrought iron fence The project is consistent with the General Plan and Planned Development Zoning requirements. The current gross density of the project is 16.89 DU/Gr. Ac. With the addition of the proposed unit, the gross density will be 17.03 DU/Gr. Ac consistent with the General Plan density for the subject property of 10 - 20 DU/Gr. Ac. DIR-2010-40 10200 Miller Ave Page 2 The original use permit was approved with a ratio of 1.6 spaces per unit and there are currently 202 parking spaces available on site for 123 apartments. While the project is proposing adding only one unit, the applicant is adding 11 parking spaces for a total of 213 parking spaces and a ratio of 1.72 spaces per unit. The current Parking Ordinance requires two parking spaces per unit for High Density Multiple-Family projects with P or R3 zoning designations. While the project does not meet the requirements of the Parking Ordinance, parking regulations in Table 19.100.040A are meant for use as guidelines in Planned Development areas. The proposed project will improve the parking ratio for the existing project. In addition to adding parking spaces, the applicant proposes to make associated landscaping improvements by re-landscaping an existing landscape buffer. The approximate area of landscaping is 315 s.f. and conforms to the City's Landscape Ordinance requirements. ACTION The Director of Community Development deems the modification minor and approves the conversion with the following conditions: 1. PRIVATE OUTDOOR AREA The applicant shall provide a private outdoor balcony equaling ten percent of the gross floor area of the unit. The final design and location of the balcony shall be reviewed and approved by staff prior to issuance of building permits. The design of the balcony shall match the existing exterior treatments at the apartment complex. 2. HEIGHT OF FENCE The final design of the wrought iron fence shall be reviewed and approved prior to issuance of building permits. The height of the wrought iron fence shall not exceed three feet in height measured from the existing grade. This approval of the modification is effective December 8, 2010. The fourteen calendar day appeal period will expire on December 22, 2010.
