SUBjECT: RETROACTIVE TREE REMOVAL PERMIT ACTION LETTER - Application TR-2010-45:
This letter confirms the decision of the Director of Community Development, given on November 2,
2010, approving a retroactive tree removal permit for the severe pruning (over 25 percent of the
functioning leaf and stem area) of a Coast Live Oak tree at 10367 Byrne Avenue with the following
conditions:
1. APPROVED PROTECT
The approval is based on the arborist report prepared by Arbor Resources on October 23, 2010,
except as may be amended by conditions in this resolution.
2. REMEDIAL PRUIVING
The applicant shall consult a state-licensed tree service company (D-49 classification) that has an
ISA-certified arborist in a supervisory role, and abides by ANSI A300-2001 (Pruning) standards
and ANSI Z133.1-2006 (Safety Operations) to conduct remedial pruning to involve the reduction
of heavy limb weight and a light thinning, but shall not exceed more than ten (10) percent of the
remaining live foliage.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
=" you fail to file a protest within this 90-day period complying with all of the requirements of -
Section 66020, you will be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance.

You have asked me to perform the following items in connection with oak trees located at
the above-referenced site:
• Identify the species and evaluate the condition of one recently pruned oak.
• Estimate the amount of foliage removed of the pruned oak.
• Provide measures to remediate or mitigate the pruning performed.
• Present recommendations for pruning an additional oaks behind the home.
I viewed the trees on October 19, 2010, and this letter presents my observations,
conclusions and recommendations.
RECENTLY PRUNED OAK
This is a seemingly healthy and sizeable coast live oak (Quercus agrifolia) regarded as a
'"protected tree" pursuant to Section 14.18.035 of the Cupertino Municipal Code. It is
situated in the backyard along the home's north side, and photographs are presented on the
following page.

The subject pruning created a one-sided and highly misshapen canopy, where all foliage
that previously overhung the hoine was removed (see photos above). Remaining foliage is
concentrated and distributed towards and over the northern neighboring property, and
increases the risk of remaining branches to break. Additionally, subsequent or ensuing
growth of weakly-attached branches towards the home can be expected from the newly
exposed trunk and limbs.
Alang the tree's lower southern section, there are old cuts likely created at the time the
existing home was built. The recent cuts can be observed above these older cuts, and
based on their amount and review of the image on Google "Street view," I estimate they
account for 25- to 30-percent of functioning leaf and stem area.

Pursuant to Section 14.18.020(� of the City Code, the pruning incident is regarded as
"severe pruning" as more than 25-percent of the functioning leaf and stem area was
removed. The work also contradicts professional industry standards set forth by the
International Society of Arboriculture, as well as ANSI (American National Standards .
Institute) A300-2001 Pruning standards.
Although the extent of pruning can be regarded as severe, the tree's health and remaining
foliage appears sufficient to warrant retention and remedial pruning. This pruning should
involve the reduction of heavy limb weight and a light thinning, but should not exceed
more than 10-percent of remaining live foliage. All work shall performed by a California
state-licensed tree service company (D-49 classification) that has an ISA (International
Society of Arboriculture) certified arborist in a supervisory role, and abides by ANSI
A300-2001 (Pruning) standards and ANSI Z133.1-2006 (Safety Operations). Permission
and access onto the neighboring property will be necessary to complete the work.
OAKS AT REAR OF HOME
These oaks are situated in a grove at the home's rear, and a deck covers their bases. Their
pruning 4�vould involve clearing the home, raising their canopy as needed, reducing heavy
limb weight, removing any deadwood one-inch and greater in diameter, and possible
thinning. The work should be limited to removing no more than 25-percent of live foliage
over a two- to five-year period, and should be performed by a company described above.
