BACKGROUND
Project Request
The applicant, Fernando Baluyot (Sign Development Inc.), representing the property
owner/operator of the above referenced V� lero Service Station, is requesting a Sign Exception
to allow for three (3) wall signs to provide the necessary sign visibility given the location and
the unique canopy orientation of the exi:;ting gas station (see applicant's full justification
statement on Attachment B). The wall signs proposed are:
➢ One (1) 14 square foot illuminated "Foc�d Shop & Deli" wall sign above the entry door on
the convenience store building (facing Sc>uth De Anza Boulevard)
➢ Two (2) 28 square foot illuminated "Val��ro" wall signs with associated illuminated gestures
on the north and south side of the f xeling canopy structure, facing the Coach House
shopping center (but visible from South De Anza) and Prospect Avenue, respectively
The project also includes the following that �io not require a Sign Exception:
➢ Re-facing and lowering the existing gr��und sign to the code-required eight (8) feet from
sidewalk grade (50 square foot sign face;
➢ Installation of two exempt Valero logo:�, which are non-illuminated and less than nine (9)
square feet per section 17.16.010 (K) of tr�e Sign Ordinance
➢ Adding yellow vinyl banding along basE� of the canopy fascia
Currently, the site has a detached convenience store and fueling canopy. The site is currently
being renovated as part of a tenant improvement permit (approved under DIR-2007-17). Also,
construction has commenced on a separat�� building permit (approved under U-2009-02 and
ASA-2009-02) to add a self-service car wash tunnel and make other site improvements.

DISCUSSION
Ordinance Allowance
According to Section 17.24.050 of the Sigr. Ordinance, a business with exterior frontage is
allowed one (1) wall sign. One (1) additicnal wall sign is allowed for a business without a
ground sign and adjacent to more than one �treet. The project site does have an existing ground
sign and is located at the northwest corner of Prospect Road and South De Anza Boulevard.
Therefore, the site is technically allowed onyo une (1) wall sign. With the exception of the two
additional illuminated wall signs proposed ��n the gas station canopy, all of the proposed signs
are consistent with the requirements of the Sign Ordinance (including but not limited to sign
area, linear width, height and location).
It should be noted that generally the City'� wall sign provisions are intended to address the
conventional sign needs of commercial busi�lesses that are part of a shopping center or located
on a stand alone pad. Typically gas station� have different signage needs given their location
near street intersection and their unique l�uilding/structure arrangements (fueling canopy,
ancillary convenient store and/or car wash f.�cility).
Previous Approvals
A survey of the City's gas stations found th�.t approximately 10 out of the 12 stations had more
than one wall sign (illuminated and/or non-illuminated). Also, the following describes several
gas stations that have received similar sign exceptions and/or approvals from the City: The
Shell station at the northeast corner of StevE�ns Creek Boulevard and Stelling Road has two (2)
illuminated canopy signs and one (1) conveluence store illuminated wall sign (approved under
EXC-2003-07). The 76 station at the northwE st corner of North De Anza Boulevard and Valley
Green Drive has two (2) illuminated canop j� logos and one (1) convenience store illuminated
wall sign (approved under EXC-2006-05). TY�e Chevron station at the northeast corner of North
De Anza Boulevard and Homestead Roacl has two (2) illuminated canopy signs, one (1)
illuminated logo, and (1) illuminated conv �nience store sign (approved under DIR-2007-09).
Lastly, the Chevron station at the southwest corner of Stevens Creek Boulevard and De Anza
Boulevard has two (2) illuxninated canopy :;igns and one (1) illuminated wall sign (approved
under DIR-2007-10). See the table below for the survey data.

Staff supports the exception request to all �w three wall signs (two signs on the gas station
canopy and one on the convenient store bui lding) in order to provide reasonable sign visibility
from Prospect Road and South De Anza BoL levard.
Staff recommends that the Design Review Committee approve the project based on the following
findings (Section 17.44.040):
The literal enforcement of the provisions in I' itle 17 of the Cupertino Municipal Code will result in
restrictions inconsistent with the spirit and inte�zt of this title;
The project is consistent with the intent of th e Sign Ordinance in that it provides architectural
and aesthetic harmony with the building/canopy design and provides good visibility for the
public and the needs of the business while nunimizing distraction to the pedestrian, bicyclist,
and motorist.
The granting of an exception will not result in c� condition which is materially detrimental to public
health, safety, or welfare;
The two (2) additional wall/canopy signs w_ll not result in a condition materially detrimental to
public health, safety, or welfare.
The exception to be granted is one that will reqeiire the least modification of the prescribed regulations
and the minimum variance that will accomplish the purpose
With the exception of the two additional w�ill signs, the proposed wall signs are consistent with
the other requirements of the Sign Ordinanc�e. Further, the proposed additional signs are in line
with the previous sign exception approvals -�or gas stations.

NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the Application r1o. EXC-2010-10, is hereby approved; and
That the subconclusions upon which tr_e findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
EXC-2010-10 as set forth in the Minutes �f the Design Review Committee Meeting of
l�ovember 4, 2010, and are incorporated b y reference herein.
SECTION III: CONDITIONS AL�MINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the plan set ciated March 6, 2009 with a revision date of
October 12, 2010 consisting of nine sheets entitled, "Valero, 1699 DeAnza Blvd,
Cupertino, CA 95014" except as may l�e amended by conditions in this resolution.
2. ACCURACY OF THE PROTECT PLA]vS
The applicant/property owner is responsible to verify all pertinent property data
including but not limited to property boundary locations, canopy heights, sign
square footage, any relevant ease: nents and/ or construction records. Any
misrepresentation of any property �iata may invalidate this approval and may
require additional review.
3. APPROVED SIGNAGE
Exception approval is hereby grant�d for the installation of two (2) additional
illuminated 28 square foot "Valero" �vall signs and associated illuminated gestures
on the north and south fascia of the fL.eling canopy.
Approval is also granted for one (1) i:.luminated 14 square foot "Food Shop & Deli"
wall sign on the east elevation of the i ood shop; two (2) non-illuminated 4.25 square
foot "V" logos on the north and souih fascia of the fueling canopy; adding yellow
vinyl stripes along the base of the car opy fascia; and the re-facing and lowering the
base of the existing ground to no higr.er than eight (8) feet above sidewalk grade.
4. RESTRICTIONS ON FUTURE SIGN�.GE
No further permanent wall signs a��e permitted onsite, including the future car
wash tunnel, unless approved by the City through a Sign Exception.

5. TEMPORARY SIGNS
Temporary signs shall comply witr� Chapter 17.32 of the Municipal Code. A
temporary sign permit is required fc►r all banners, a-frame or other freestanding
signs, and promotional devices.
6. ILLUMINATION INTENSITY AND �[OURS OF ILLUMINATION
The intensity of the illuminated signs �hall not exceed 250 foot-lamberts. All
illuminated signs shall be turned off by 11:00 p.m.
7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approva: set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amoL nt of such fees, and a description of the
dedications, reservations, and other e xactions. You are hereby further notified that
the 90-day approval period in whi�:h you may protest these fees, dedications,
reservations, and other exactions, pu rsuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66(120, you will be legally barred from later
challenging such exactions.
