Subject: Director's Minor Modification, DIR-2010-41, to allow repainting of the
building exterior and minor sit�� improvements located at 20300 and 20320
Stevens Creek Boulevard.
Chapter 19.132 of the Cupertino Miinicipal Code allows for administrative
approval of minor changes in a prc►ject. The Director reports his decision
to the City Council and Planning C:ommission in time to allow an appeal
of the decision within fourteen cale:ldar days.
DISCUSSION
The applicant is requesting a modificatio�i of a previously approved Architectural Site
Approval to modify an existing office bu ilding and associated hardscape areas on the
property. Since the property is located in a Planned Development area, any changes to �
the exterior and the site must be approved with a Director's Minor Modification.
The proposed changes to the building arE� limited to painting the mullions around the
windows a different color.
The proposed changes to the site include:
1. Removing the existing brick pavi�ig and concrete subslab and updating these
with concrete pavers and poured ccmcrete paving
2. Removing the existing cladding of the water features on site and updating these
with a different veneer
3. Replacing walkways to allow for disabled persons access
4. Conversion of a portion of the pavi:lg area to planting area
5. Changing the outdoor furniture anc� planters
6. Replacing the existing bollards
ACTION
The Director of Community Development deems the modification minor and approves
the proposed changes (see Attachment 1) �Nith the following conditions:
1. TREE REMOVALS
No tree removals are approved with this Director's Minor Modification.

2. LANDSCAPE INSTALLATION R:EPORT
Prior to final occupancy, the applic�.nt shall provide a Landscape Installation
Report (per CMC section 14.15.080)
3. LANDSCAPE MAINTENANCE AGREEMENT
Prior to final inspections and final cccupancy, the owner(s) of the property shall
enter into a formal written landsca� e maintenance agreement with the City. The
Agreement shall be recorded again�.t the property or properties involved, with
the County of Santa Clara Recorder's Office and it shall be binding on all
subsequent owners of land served ti�y the proposed landscape.
The landscape maintenance agreem ent shall require that the installed landscape
not be modified and that maintenar�ce activities not alter the level of water
efficiency of the landscape from its �riginal design, unless approved by the City
prior to the commencement of the ��roposed modification or maintenance
activity.
This approval of the modification is effective October 27, 2010. The fourteen calendar
day appeal period will expire on Novemb��r 10, 2010.

SECITON lA: SUMMARY OF WORK
1'his work consists of construction of site and landscape renovadons m an approsimatdy 4.6-acre office park as
indicated on the atrached drawings. Renovations to the esisting pavement, fomtains, sigfit lighting„ udlities
connections, plandng, and irrigadon are included in the work.
Thesc drawings and specifications were prepazed by Hart Howerton, Planners, Architects, and Landsriipe Architects,
Ltd., One Union Street, San Frandsco, Califomia 94111, for thc landscape renovation of 20300 Stevens Crak Blvd.
These drawings and specificadons are the property of Hart Howerton. Use of these drewings in any locadon otha than
indicated is not authorized by Hart Howerton. Hart Howerton assumes no responsibiliaes for unauthorized use of

SECTION 1C: PROJECT REQilIREMENTS
Eaecure the Work in strict compliance avith all applicable Srete, County, and City construction codes. Provide all
protective structures, devices and fire eatinguishexs necessazy for the safety of workmrn, equipment, the public and
property as required by State, Federa! or Municipal laws and reg�iladons.
The Drawings and Specificadons are coopeiadve. Informaaon shown on one or the otha is as if shown on both.
Conflicts betwern the Drawings and the Specificadons shall be brought to the Iandscape Architect's attmtion before
proceeding with the affated work. It s6a11 be assumed that the Contraaor has antidpated building the more
eaprnsive of the requiremrnts in bidding the job, and any resoludon of conflicting infom�adon will not result in an
increase in mst
The Conttactor shall be thoroughly familiaz with all of the requirements of this project. Prior to commrndng the work,
the Contracmr shall visit the sice to become fazniliarized with all of the site & local mndidons, and become informed
of the requiremrnts and procedures of the vazious authorides having jurisdiction over the pmject. This includes the
wnstruction ordinances and regtiladons escablished by The Gty of Cupertino. Note that Work will be govemed by the
city's noise ordinance, Chapter 10.48 Communiry Noise Control, avaiJable for review at www.cupertino.org. Work
hours are 7azn to 8p� Monday through Friday.
Thc Contractor shall become familiaz with the Drawings and the Specificadons and shall be responsible for the
compadbiliry of the vaaous mmponents of the project, induding, but not limited m: matedals and finishes. The
submission of a bid implies fiill and rnmplete undtrstanding of the documents, the reg�iladons, and the requiremencs
of the job.
The Contracmr shail provide all labor, materials, equipment, permia and inspections and shall do all work, pecmanrnt
or temporary, necessary to the compledon of the projat The work shall be rnmplete, deaned and ready for
occupanry.
A. Plan check and building pezmit fces will be paid by Owna.
B. The Owner will pay utility fees. The Contractor will coordinate with utilities for mnnecoion of water, gas, dectdcal,
and tdephone services u naessary.
C. Tempo:ary utilides are the responsibility of the Contractor.

The design, adequacy, and safety of erection btacing, shoring, oemporary supports, etc. is the sole responsibiliry of the
Contracmr and has not been rnnsidered by the I�ndscape Architect. The Contracmr is soldy responsible for stability
of the site work prior to the completioa of all components, including but not limited to: site walls, trellis trnovadons,
and 5nish materials. The Contracmr shall provide the necessary bracing m provide stabiliry prior to the mmpletion of
the aforemrntioned materials. Observadon visits m the site by the I.andscape Architect shall not include inspection of
the above itans.
The Contracmr shall protect adjoining properties from damage and be responsible for any repair m said properties as
well as to eaisting curbs, sidewalks and utiliaes.
The Contractor shall provide temporary toilet facilides and utilities, induding gas, wacer, dectridry and tdephone
service on the job site.
The Contractor shall provide and pay all eapenses for any required Reg}steted Professional Enginacr's certificadon of
staldng, layout, 5nish elevations, dimrnsions, survey monumrnts, or any otha Enginea's certification indicated on the
Drawings and Specificadons or required by the goveming building authoriry.
The Contractor shall provide erosion control, mre & plant protection and protection of adjacent areas from runoff or
co�taminadon due to the rnnstruction process.
The Contracmr shall provide dust control by means of water spray during all earthwork and gtading operadons.
SECI'ION 1D: SUBMITTAIS
The Contractor shall submit shop drawings, samples and product info:madon of all mmponrnts for the Landsrape
Architea's review, afta having bern reviewed and approved by the Genetal Contrador (if applicable), and prior to
plaang � final otder or installadon. Allow sufficirnt time for review and ordering to avoid delays. Allow the Landscape
Architect a minimum of trn (1 � worldng days for revieavs and requests for clarificadon. Shop Drawings & SubmittaLs
shall clearly delineare the following information: (a). Iandscape ArchitecPs name, project name & number (b). Drawing
dde, numba, date, and scale (c). Naznes of Contractor, Subcontracmr & Fabricator (�. Contractor s approval signature
and date (e). Worlang & erection dimensions (�. Indicate relation m adjacrnt wofk of otha trades, and deazly idendfy
field dimensions & coordinadon requiremrnts. Describe mlerences, finishes & composidon of the assanbly. (�.
Anangements & section views (h). Necessary details with rnnnections to or dearance from other work n. Kinds of
matcrials & 5nishes.
SECTTON ]E: MATERIAIS AND EQUIYMENT
Escept for :equired labds and openting data, do not attach manufacturer's nameplares or mademarks on surfaces
eaposed to view in occupied spaces or on the eaterior.
Deliva, store and handle pmducts in accordance with maciufacturer's instructions or remmmrndadons using methods
that will prevent damage, detaioration or loss. All materi�ls shall be ncw, unused and delivered to the job site in their
orig�nal mntainers. All wood, faus stone and similar materials shall be sm:ed off the ground and protected from the
inclemrnt weathez.
Comply with manufacturer s instructions & recommrndadons for instalJ�don of macerials & products. Anchor exh
produa securdy in place, accurately located & proteaed from damage until the Owna has indipted in writing d�t
he/she has accepted the work.
All work and materials shall be guaranateed for a period of one year, commencing from the date the Owner's
acceprrnce is issucd. The costs of cornctions, including labor and materials, shall be the Contraaor s responsibility.
SECT'ION 1F: CHANGES
No changes shall be made without the Landscape Architect's and/or (hvner s writtrn pemussion.
SECI'ION 1G: SUBS"ITI'LTITONS
Requests for substitution will be considered, if sufficient data is submitted danonstrating the qualiry of the proposed
substitudon to be equai to, or better than the produa orig�nally specified and the requesa azc recaved cvithin 60 days
afrer the nodce m proceed. The approval of subsdtutions shall be decermined solely by the Landscape Architect. The
Landscape Archiact shall rrnder dus decision in a timdy manna, but the Iandscape Architect shall not be responsible
for any effect to the cost or schedule caused by inmmplete or untimdy submimals.
Submit a separate reqixst for each product, supported with complete dat� drawings and samples as appropriate,
including detailed mmpazison. Include coordinadon infotmation, induding a list of changes required in other dements
of the Work because of the subsdtudon, effect on the mnstnxtion schedule, cost data, and availabiliry of maintenance
service, and source of replxanrnt materials. Indude a writtrn represenrrtion that Contraccor has investigated the
proposed Product and detemuned that it is equa! to or superior in all respects to that specified, will provide the same
warranaes or bonds for the subsdtution az for the Produa spea5ed, will cootdinate the installadon of an accepted
substitudon ineo the Work, and make such other changes as may be required m make the Wotk mmplete in all
respects, and waives all claims for addidonal rnsts which may subsequendy become appazrnt
SECI'ION 1H: PROJEC'I' CLOSE-OUT
1. Substantial Completion
a. The Contractor shall "pre-punch list" its own work and work of subcontractors. The Project will be
reviewed and "punch listed" by La�dscape Architect and the Oaner only after the Project is essrntially
complete.
b. Whrn the Contractor mnsiders the Work or a designated portion of the Work is substantially mmpiae, a
Snal inspecdon to detem�ine acceprance of the Project will be performed by the Landscape Architect and the
Oana.
c. From the infotmadon gathered from this inspecdon, the Iandscapc Architect will prepare � Cectifirate of
Substantial Completion with an attached "punch list" of work to be perfocmed, mrncted, or rnmpletod
before the Project will be accepted.
1. Work on the pnch list shall be mmpleted by the Contractor prior m �cccptance of the Project by the
Owna.
2. "Punch list" work shall be completed within (30) days unless othenvise mucually agrxd.
2. FinalInspection
a. When the Contractor mnsidas the Work is complete togetha with all "punch-list" items, it shall nodfy the
Landscape Arckutect and the Iandscape Architect, Contractur, and the Oana shall make � joint inspecdon
of the Woik m review thc "punch-list" itans.
b. Whrn the I.andscape Architect 5nds that the Wock is xceptable under the Contract Documrnts, it shall
request that the Contraaor make closeout submittals.
c. The Concrxror shall coorclinate with Counry inspectors a final inspection for the purpose of obraining an
occupanry catificate, as required.
3. Pmject Closeout Submitmis
a. Upon xceptu�ce of the Work by the Owna and befon 5nal paymrnt is made co the Cont:actvr, the
following shall be submitted to the Own«:

SECTION lI: QUALITY CONTROL
The Contractor shall urange for any required testing �ccording to the Geotechnical Engjneer's Consultadon
Recommendaaons letter, dated July 15, 2010, with suffident advance noace for the testing agency to respond for
grading and compaction. Submit all testing and inspection reports to the Building Departmrnt as required. If different
soils from those indicated in the Consultadon Remmmrndadons letta are rnmuntered, t�e Geotechnical Engfneer
shall be noafied to provide evaluadon and supplanrntal ttmmmrndarions u necessazy. Any addiaonal eequired
testing is also the responsibility of the Conmcmr.
The Contracmr shall azrange for soils testing savices as xequired by the attych�d Planting Spedficadons, which will be
paid for directly by the Owner. Obtain approval from tfie Iandscape Architect for selecrion of testing savice. Provide
copies of all test reports m the Iandscape Architect, and if required, officials of the goveming muniapaliry.
The Contractor is responsible for scheduling all inspecrions by the appropriate authoades as required by laav or local
building ordinances. In addition, the Conmector shall provide the Iandscape Architect with msonable nodce for his
/6a inspection of the wor� prior uo pouring mnaetc, upon mmpkdon of pncpatory danolition for the trellis work,
upon delivery of plant materials to the site, and upon substantial compledon fo the pmject. Refa m avil documrnts
for addidonal required inspections.
The Contrxmr shall remedy any defects due to faulty matetials and workmanship that appeat within a period of one
year from the date of the Occupanry Pemat, or within a longer period of rime as prescribed by laav or by the tam of
any spedal guarantee, wananty, or industry standard. The provisions of the guarantee apply ro work done by
Subcontractors as well as to work done by direct employees of the Contractor.
DIVISION 2: STTE WORK
SECITON 2A: SITE WORK - GENERAL
All site grading, trenching, and backfill shall be done in acmrdance with the recommrndations of the
Geotechniral Consultation Recommendations letter prepazod by Comerstone Earth Group, dated July 15,
2010, and the report is a part of these Contract Documents. Be thomughly familiaz with it, and follow all
requirements and recommrndations.
SECTION 2B: SiTE CLEARING

Locate ezisting underground udlities in advance of eacavation work. Pmvidc �dequate means of support and
protection u required to maintain utilities during earthwork openaons.

2. Excavadon, Trenching and Bacld'ill Operations:

required for walks. Minimum 48 inches dear.
